Luke and Alan Unger. Also present were Tom Anderson, John Griley, Tim Grundeman, Peter Gutowsky, Nick Lelack, Kristen Maze, Paul Blikstad, Doreen Blome', Anthony Raguine and several other employees of Community Development; and Laurie Craghead, Legal Counsel. Also present was a representative of KOHD TV. No other citizens were present. Chair Baney opened the meeting at 10:00 a.m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was Consideration of the Reading and Adoption of a Proclamation Declaring August 10 -14 to be Deschutes County Code Enforcement Officers' Recognition Week. Tom Anderson explained that the Governor's Office announced that the second week in August will be Code Enforcement Officers' Recognition Week in Oregon. The two Code Enforcement technicians for Deschutes County are John Griley and Tim Grundeman. He noted that this is one of the toughest jobs in his department. On a daily basis, these two individuals wrestle with significant issues, often involving different or conflicting perspectives on property rights versus the effects on neighboring properties of some uses. A balance has to be found. They handle over 250 cases annually. Mr. Anderson thanked the staff that supports the two individuals and also the Sheriff's Office for its part in handling these cases. The Board then recognized the work that Mr. Griley and Mr. Grundeman do every day. Commissioner Unger thanked them for helping to recognize potential problems early and said he would be happy to talk with citizens who have issues with whatever action has to be taken. Commissioner Luke stated that voluntary compliance is a good way to go, and that most of the time no citation is needed because of the professional way these situations are addressed. Chair Baney then read the County's Proclamation. LUKE: Move signature. UNGER: Second. VOTE: LUKE: Yes. UNGER: Yes. BANEY: Chair votes yes. The Board presented certificates to Mr. Grundeman and Mr. Griley at this time. 3. Before the Board was the Continuation of a Public Hearing on Files No. PA -083 and ZC -083, on an Appeal of the Hearings Officer's Decision regarding a Plan Amendment /Zone Change on Agricultural/EFU to Airport Development (Aviation Support District - Bend). Chair Baney reopened the hearing, which was continued from February 23, 2009. Anthony Raguine said that the applicant has asked to continue this item to summer of 2010 to allow time for the Bend Airport to update its master plan. The process on the plan has begun, but it is not known when it will be completed. Funding was secured to be able to hire a consultant to begin this work. Commissioner Luke asked what the purpose is of extending the file. There are other issues that need to be addressed at the same time by the plan. Mr. Raguine said that the applicant hopes that his property can be included at that time. Commissioner Unger stated that he feels the applicant has paid a fee and should not have to reapply with another fee. Ms. Craghead said that a decision would have to be made if it is not continued. However, the public is on notice that the hearing would be continued to a future date. A brief discussion took place regarding what date might be best to address this issue further. A date of February 10, 2010 was selected. Commissioner Luke asked Mr. Anderson about a question raised regarding appealing to the Department of Environmental Quality for a denial of a solid waste permit. Laurie Craghead said that it depends on whether it falls under the Administrative Rule. The status of the County's regulation is unclear at this time, but it might involve a Code enforcement action. Commissioner Unger asked about whether the County can be split in regard to on -site inspections, with part being handled by the County and the other handled by the State. Mr. Anderson said that this discussed is planned for an upcoming work session or executive session, whichever is appropriate.
