PUBLIC HEARING ON THIS DATE? No. BACKGROUND AND POLICY IMPLICATIONS: Contractor, Bend Obstetrics and Gynecology, LLC., provides prenatal medical services a minimum of 8 hours per week. The services are performed at the Deschutes County Health Department, by an MD or certified nurse midwife, trained and competent to render such services to obstetrical clients in accordance with a schedule approved by the County. In addition, Contractor provides physician level clinical consultation and direct medical services for HealthyStart clients who are too high risk for mid -level provider care at the high -risk HealthyStart Clinic. FISCAL IMPLICATIONS: Amendment #1 to Agreement #2008 -354 modifies the rate of funding for the period of July 1, 2009 to June 30, 2010. County agrees to pay Contractor on a fee - for - service basis at a rate of $10,344 per month. Such rate includes up to 94 deliveries. In the event the annual deliveries exceed 94, County shall pay Contractor an additional $910 per delivery. The maximum consideration authorized under this Agreement is $165,983, based upon a maximum of 140 deliveries. One original to Bend Obstetrics & Gynecology, LLC, 2450 NE Mary Rose Place, Suite 220, Bend, OR 97701 DOCUMENT NO. 2009 -343 AMENDING DESCHUTES COUNTY CONTRACT NO. 2008 -354 THAT CERTAIN AGREEMENT, Deschutes County Contract No. 2008 -354 dated July 1, 2008 by and between DESCHUTES COUNTY, a political subdivision of the State of Oregon ( "County ") and Bend Obstetrics and Gynecology, LLC., an Oregon Limited Liability Company, 2450 NE Mary Rose Place, Suite 220, Bend, OR 97701, Federal Tax ID# : 68- 0489850 ( "Contractor "), previously recorded in the Deschutes County Clerk's Records, is amended, effective upon signing of both parties, as set forth below. All other provisions of the contract remain the same and in full force. County Contract 2008 -354 is amended as follows: Former language has strikeout, while new language is in bold. 5. Considerations: a. From the period July 1, 2008 to June 30, 2009, the County shall pay Contractor on a fee -for service basis at a rate of $12,035.83 per month. Such rate includes up to 120 deliveries during the period July 1 2008 to June 30 2009. In the event the annual deliveries exceed 120 County shall pay contractor an additional $918 per delivery, which payment shall be due at the end of the year (June 30 2009). The parties agree to renegotiate the monthly flat fee in the event of a substantial increase in expected deliveries. Said rates to be the complete compensation to Contractor for services performed. The maximum consideration authorizer, under this agreement for the aforementioned time period is $171,970, which is based upon 180 deliveries. Consideration for each renewal period will be negotiated prior to July 1 o° each year and attached as an addendum to this contract. If the parties fail to agree on new consideration for a renewal term, Contractor may continue services at the previous year's fee or give written notice of termination sixty days prior to the date services under this Agreement are to be terminated. b.
