PUBLIC HEARING ON THIS DATE? NO BACKGROUND AND POLICY IMPLICATIONS: The Road Department uses an employment firm to hire seasonal temporary employees for the purpose of general labor and traffic control. The employment firm is responsible for all payrolls including employer's tax liabilities, worker's compensation and unemployment insurance. A Request for Proposal was advertised with five firms submitting proposals. Based upon a review o!' qualifications and cost by a review team, the Road Department recommends award of this contract t Express Employment Professionals of Bend, Oregon. FISCAL IMPLICATIONS: Funds are budgeted in the 2009 -2010 fiscal year with a maximum not to exceed amount of $250,000.00. The contract has a provision for additional extensions up to two years. RECOMMENDATION & ACTION REQUESTED: The Road Department recommends approval and signature of intent to award contract #2009 -509 by the Chair of the Board of County Commissioners to the most qualified firm, Express Employment Professionals of Bend, Oregon. The project was advertised in the Bend Bulletin on September 9 and September 14, 2009. DISCUSSION: A total of nine (9) firms acquired RFP documents with five (5) firms submitting proposals to the Road Department. Proposals were opened on September 26, 2009. All submitted proposals were reviewed and ranked based on predetermined criteria outlined in the RFP documents. The categories for revievk included: Financial Resources, Qualifications, Supportive Information, Past Performance, Approach and Understanding of the Project, Cost and Minimum Qualifications. Express Employment Professionals of Bend, Oregon was the most qualified firm. The Board of County Commissioners determined that the apparent responsible RFP for the project was Express Employment Professionals of Bend, Oregon. This Notice of Intent to Award Contract is issued pursuant to Oregon Administrative Rule (OAR) 137 - 047 -0610. A copy of this Notice is being provided to each firm or person that submitted a RFP for the project. Any firm or person who believes that they are adversely affected or aggrieved by the intended award of RFP set forth in this Notice may submit a written protest within seven (7) calendar days after the issuance of this Notice of Intent to Award RFP to the Board of County Commissioners of Deschutes County, Oregon, at the above address. The seven (7) calendar day protest period will expire at 5:00 PM on Wednesday, October 21, 2009. If a protest is filed, a hearing will be held at 10:00 a.m. on Wednesday, October 28, 2009 before the Board of County Commissioners of Deschutes County Oregon, acting as the RFP Review Board, in the Deschutes County Services Center, 1300 NW Wall Street, Bend, Oregon 97701. If no protest is filed within the protest period, this Notice of Intent to Award RFP becomes an Award of RFP without further action by the Board of County Commissioners unless the Board, for good cause, rescinds this Notice before the expiration of the protest period. The successful bidder on a Deschutes County project is required to execute three (3) copies of the Contract, which will be provided when the bids are finally determined. In addition to the execution of Contract, the contractor will be required to provide a performance bond, payment bond, and certificate of insurance. All contract copies will need to be returned to the County for execution. After all parties have signed the contract, a copy of the contract will be forwarded to you along with a notice to proceed.
