PUBLIC HEARING ON THIS DATE? NO BACKGROUND AND POLICY IMPLICATIONS: Deschutes County has been involved in planning for the alteration and expansion of the jail facility generally north of Poe Sholes Drive between Britta Street and Jamison Street, Bend. During pre - construction meetings with Swalley Irrigation District we identified numerous crossings and encroachments on Swalley's facilities. We also became aware that existing encroachments have not been adequately documented. We agreed with Swalley that we would take this opportunity to document all the encroachments with standardized forms and an updated drawing. Swalley requires a variety of documents such as easements, crossing agreements and a construction agreement. If Swalley must have a document for each encroachment, there may be as many as 45 individual documents required for this project. Staff recommends that the Board authorize County Administrator signature on all of these documents as they are prepared, subject to Legal Counsel review. FISCAL IMPLICATIONS: None RECOMMENDATION & ACTION REQUESTED: Staff recommends approval of Order 2009 -062. Subject to Legal Counsel review, the County Administrator is authorized to execute a Construction Agreement, Easement Agreements, Easement Vacations, Easement Encroachments, Crossing Agreements and Fencing Permits related to the Swalley Irrigation District Rogers and Riley Canals on the public safety campus.
