BACKGROUND AND POLICY IMPLICATIONS:
The Deschutes County Road Department has completed the construction of the Deschutes Junction
Phase II project and would like to set a temporary speed limit of 45 mph on both the Phase I portio i of
the project and the Phase II portion of the project. The speed zone will be from 78th Street (MP 0.33
Tumalo Road) to just past the entrance to the mobile home park east of the Burlington Northern Saata
Fe (BNSF) tracks (MP 0.62 Deschutes Market Road). The reason for the request is that there are
several intersections within a short distance on this stretch of roadway and design constraints requi -ed a
design speed of 45 mph to allow the crossing of the BNSF facility and connection into the existing
Deschutes Market Road east of the BNSF tracks. Per ORS 810.180(8), when a new or rebuilt road
nears completion, the road authority can issue a temporary speed zone order if the new section has
continuous restrictions on the travel speed. This temporary Order will be in effect for six months after
the signature of the Order or upon completion of the Oregon Department of Transportation (ODO7 )
speed study for this stretch of Road. The Road Department has submitted a speed zone study requ, st to
ODOT for a final speed study on this portion of the roadway.
FISCAL IMPLICATIONS:
The Road Department will install the necessary signs with their own crews.
RECOMMENDATION & ACTION REQUESTED:
The Road Department recommends signature of Order No. 2009 -067.

ORDER NO. 2009 -067
WHEREAS, the Deschutes County Road Department, pursuant to the provisions of ORS
810.180(8), has determined that the reconstruction of the Deschutes Junction Project, Phase 11 has
altered the character of the roadway to the extent that a speed lower than the statutory speed is
necessary; and
WHEREAS, the design constraints for Deschutes Junction Phase H required a design speeq of
45 mph to allow the crossing of the Burlington Northern Santa Fe (BNSF) facility and connection into
the existing Deschutes Market Road east of the BNSF facility; and
WHEREAS, based upon said engineering determination of danger to the public, the County
Engineer has found that when the speed designated in ORS 811.105 or ORS 811.111 or by
permanent written order is greater than the speeds designated below, a temporary speed reductior to
lessen the risk to the public is desirable; and
WHEREAS, an investigation by the Oregon Department of Transportation (ODOT) shall be
conducted within six months after the road in open to public traffic to establish a permanent speed
under ORS 810.180(5) and OAR 734 -20 -0015; now, therefore
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDERS as follows:
Section 1. That the designated speed for the following section of roadway be as follows:
Name: Tumalo Road and Deschutes Market Road
Project Name: Deschutes Junction Phase II
Designated Speed: 45 miles per hour
From: Milepost 0.33 Tumalo Road
To: Milepost 0.62 Deschutes Market Road
Section 2. That the Road Department shall install appropriate signs giving notice of the
designated speed per ORS 810.180, Subsection 8(d).

Section 3. That the signs installed pursuant to this order comply with the provisions of ORS
810.210 and 810.220.
Section 4 That this speed zone will be in effect for six months after signature of this Order or
the completion of the ODOT speed study, which ever occurs first
Section 6. That this Order shall be recorded with the Deschutes County Clerk, and copies
shall be filed with the Deschutes County Surveyor and County Assessor.
