PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: On January 20, 2009, the City of Bend planner assigned to the Deschutes County Historic Landmarks Commission ( "HLC ") applied, on behalf of the HLC, for a Certified Local Government Grant, Grant Application No. 2009 -2011, to create new brochures and /or a home tours to enhance public preservation knowledge, update the County's comprehensive plan and regulations for historic preservation, provide financial assistance in coordination with the Deschutes County Historical Museum to scan historical property records /files that are currently stored at the museum, and to send HLC commissioners to training. The HLC, however, has no authority to apply for grants or to enter into grant agreements. Thus, in order for the grant application to be binding on Deschutes County, the Board of County Commissioners ("Board") will have to ratify the signature on and the submittal of the application. The $15,000 requested was awarded to the HLC. Legal Counsel has not been given a copy of the grant agreement as of the date of the submittal of this agenda request. Once there has been Legal Counsel review of the grant agreement and has an understanding of how the money was spent by the City of Bend, an additional resolution will likely be drafted for the Board to ratify the grant agreement. FISCAL IMPLICATIONS: The grant application was for $15,000 the money will be sent to the City of Bend and Deschutes County once the jurisdictions send an itemized list of completed projects their were outlined in the scope of work. Until Legal Counsel has the opportunity to view the grant agreement, staff is uncerth in as to what budget implications the grant may have. It may be that the 2009 -2010 budget will need a supplemental budget in order to properly appropriate this money. RECOMMENDATION & ACTION REQUESTED: Approve and sign Resolution 2009 -135 ATTENDANCE: Kristen Maze, Laurie Craghead DISTRIBUTION OF DOCUMENTS: Copy to Kristen Maze REVIEWED LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Ratifying Oregon State Grant Application 2009 -2011 Submitted by the City of Bend for the Deschutes County Historic Preservation Program. * * RESOLUTION NO. 2009 -135 WHEREAS, on January 20, 2009, the Deschutes County Historical Landmarks Commission ( "HLC "), through the City of Bend staff assigned to the HLC, applied for a Certified Local Government Grant, Grant Application No. 2009 -2011, to create new brochures and /or a home tours to enhance public preservation knowledge, update the County's comprehensive plan and regulations for historic preservation, provide financial assistance in coordination with the Deschutes County Historical Museum to scan historical property records /files that are currently stored at the museum, and to send HLC commissioners to training; and WHEREAS, the City of Bend staff submitted the application for the grant; and WHEREAS, the HLC has no authority to apply for a grant or enter into grant agreements on behalf of Deschutes County; and WHEREAS, the grant is in the best interest of the public because it aids the HLC in its function of preservation of and public education about historic landmarks; and WHEREAS, the Board of County Commissioners ( "Board ") wishes to ratify the above listed grant application as a co- applicant with the City of Bend; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. The Board approves and ratifies the signature on and submittal of Grant Application No. 2009 -2011, submitted on behalf Deschutes County as a co- applicant with the City of Bend.
