TITLE OF AGENDA ITEM:
Consideration of Approval of Document No. 2009 -672, the re- execution of a Bargain and Sale Deed,
mistakenly issued to Trust instead of Trustee.
PUBLIC HEARING ON THIS DATE? No.
BACKGROUND AND POLICY IMPLICATIONS:
In 1998 the County conveyed by Bargain and Sale Deed certain property to the Boyer Family Trust,
which was established by William and Ann Boyer. The property is located at Lot 27, Block 1, Low er
Bridge Estates. At the time of the conveyance the deed recited the grantee as the Trust itself, rather than
the Trustee of the Trust. A representative of the Trust has requested that the county issue a new deed
which correctly recites the Trustee as the grantee.
FISCAL IMPLICATIONS:
None.
RECOMMENDATION & ACTION REQUESTED:
Approval.
ATTENDANCE: No one.
DISTRIBUTION OF DOCUMENTS:
After the Board signs the deed and their signatures are notarized, the deed needs to be recorded in the
property records of the Clerk's office. Thereafter it will be returned to the Trustee of the Trust.

Family Trust U/T /A dated February 28, 1983, Grantee, whose address is 17575 Jordan Road
Sisters, Oregon 97759, the following described real property:
Lot 27, Block 1, Lower Bridge Estates, Deschutes County, Oregon.
SUBJECT TO: All encumbrances of record and those common and apparent on the land.
BEFORE SIGNING OR ACCEPTING THIS INSTRUMENT, THE PERSON TRANSFERRINC
FEE TITLE SHOULD INQUIRE ABOUT THE PERSON'S RIGHTS, IF ANY, UNDER ORE
195.300, 195.301 AND 195.305 TO 195.336 AND SECTIONS 5 TO 11, CHAPTER 424

The true consideration for this conveyance is to correct vesting in that Bargain and Sale Deed
recorded in Deschutes County Official Records on June 23, 1998, at Record No. 98- 26659.
