BACKGROUND AND POLICY IMPLICATIONS:
In 2002, the City of Redmond and Community Development entered into an intergovernmental
agreement for building official, plans examination and inspection services (Contract 2002-288). The
City was in need of such services and Community Development was in a position to provide those
services to the city.
As time went on, City of Redmond began the pursuit of having their own Build Codes Department. In
2006, City of Redmond hired their own Building Official, Gary Lampella. Since that time, the city hate
hired both a commercial and residential plans examiners. City of Redmond plans to hire certified
inspectors in order to have a full service building codes department over the next three years.
Due to the significant changes in the services currently needed, a new contract has been negotiated.
The new contract better reflects the services and the costs associated with those services that are being
provided and allows for the transition plan developed by the city.Use as much space as necessary.
Provide enough information for the public to have a basic understanding of the item. Avoid jargon and
acronyms that are unfamiliar to the general public.
FISCAL IMPLICATIONS:
The revenue generated by this intergovernmental agreement is included in the 07-08 fiscal budget.
RECOMMENDATION & ACTION REQUESTED:
Recommend the Board agrees to the terms of the intergovernmental agreement and sign two original
copies of contract 2008-011.

CONTRACT FOR PROFESSIONAL SERVICES
BETWEEN
THE CITY OF REDMOND, OREGON
AND DESCHUTES COUNTY
This Contract is made and entered into by and between the City of Redmond, a municipal
corporation of the State of Oregon, hereinafter called the CITY, and Deschutes County, a
political subdivision of the State of Oregon, hereinafter called the COUNTY. Deschutes County
Contract No. 2002-288, entered into by the parties on August 27, 2002, is rescinded and declared
null and void.
WITNESSETH:
WHEREAS, CITY and COUNTY are authorized pursuant to ORS 190.003 through
190.110 to enter into an intergovernmental agreement for the performance of any or all functions
which a party to the agreement has the authority to perform; and
WHEREAS, CITY is in need of the services of code officials and inspectors duly
certified by the State of Oregon; and
WHEREAS, COUNTY is in the business of providing the services of code officials and
inspectors duly certified by the State of Oregon to governmental agencies and other parties; and
WHEREAS, CITY wishes to obtain from COUNTY and COUNTY wishes to provide to
CITY certain services of code officials and inspectors duly certified by the State of Oregon on
the terms and conditions set forth herein; and
WHEREAS, CITY is in a transition process to utilize its own employees to provide such
services; and
WHEREAS, CITY is currently providing the services for building and mechanical plan
review for all structures and intends to expand its provision of other services; and

WHEREAS, CITY's intends is to provide complete inspection and plan review services
within the CITY limits and the unincorporated Redmond Urban Growth Boundary ("UGB")
within the next three (3) years, eliminating the need for COUNTY code official and inspection
services; and
WHEREAS, until CITY provides complete inspection and plan review services, CITY
will continue to require COUNTY building official and inspection services on a gradually
decreasing basis; and
WHEREAS, both CITY and COUNTY find it beneficial to enter into this agreement to
continue to provide inspection services to the CITY for portions of the inspection program;
NOW, THEREFORE, in consideration of the mutual promises and the terms and
conditions set forth hereafter, the parties agree as follows:
1. TERM. This Contract shall commence upon signature of all parties, and shall continue in
full force and effect until terminated as provided in Section 13. Contract will be reviewed
for compliance six (6) months from the date of commencement.
2. SERVICES. Services to be provided by COUNTY to CITY under the terms of this
Contract shall consist of the following:
A. Upon request of CITY, the examination of building plans submitted to COUNTY
to ensure their compliance with the Structural, Mechanical, Electrical, Plumbing,
and One and Two Family Dwelling Specialty codes of the Oregon State Building
code as adopted by the CITY (State Building Code); and the Manufactured Home
and Recreational Vehicle Regulations adopted by the State of Oregon ("State
MHRV Regs"). COUNTY shall review all permit applications related to the
above building codes submitted to COUNTY by CITY and complete a plans
review report in a timely fashion, ordinarily within seven (7) working days after
receipt of all proper plans and applications. Promptly upon completion of its plans
review report, COUNTY shall approve such plans and notify CITY of such
approvals so CITY may issue appropriate permits or notify the applicant of any
deficiencies in the plan review report.
B. Upon request of CITY, provide building, mechanical, plumbing and electrical
inspection services for CITY and the Redmond Urban Growth Boundary at all
levels and oversee enforcement of the State Building Code, and the State MHRV
Regs by performing field inspections of building sites located within the
Redmond Urban Growth Boundary.
C. Make a good faith effort to provide inspections within one (1) working day
following COLTNTY's receipt of an inspection request; however, both parties
agree that two (2) working days to provide inspections required under the terms of
this Contract is not unreasonable. COUNTY shall notify CITY as soon as
possible if inspections will not be provided within two (2) working days.

D. Meet with permit applicants/holders and/or CITY staff at COUNTY Offices or
City Hall to address and attempt to resolve any issues arising under the applicable
State Building codes, State MHRV Regs or CITY Codes and Ordinances and
related issues.
E. Coordinate with CITY, including CITY Community Development Department,
CITY Fire Department (Fire Marshall) and CITY Public Works Department on
inspections, permit applications, plans reviews, code -required setbacks,
compliance with approved site plans, and a filing system to ensure that records of
all permits and applications are properly maintained.
F. Coordinate with CITY to complete any monthly surcharge reports on building
permits required by the State Building Code Division or its successor together
with any census reports required by the US Department of Commerce.
G. Upon receipt of written request and instructions from CITY, conduct other
inspections for compliance with the codes indicated in Section 2A and with
CITY'S applicable land use requirements, housing code or building maintenance
code, and other ordinances and regulations and notify the CITY of any existing or
potential violations.
H. Coordinate with other CITY functions and departments for plans and permit
application review, permit and Certificate of occupancy issuance, field
enforcement, and compliance with CITY'S ordinances and regulations for utilities
and land use requirements.
I. For development projects within the Redmond Enterprise Zone, waive a portion
of fees in accordance to the document.
J. Provide the related computer and network system administration and Information
Technology services described in Exhibit 1 attached and incorporated by
reference herein.
3. SERVICES PROVIDERS. COUNTY may use employees, agents or independent
contractors to perform the services required by it under the terms of this Contract so long
as such employee, agent or independent contractor is properly certified. If any
incompatibilities or conflicts arise involving COUNTY's employees, agents or
independent contractors, COUNTY and CITY agree to meet and make a good faith
attempt to resolve any such incompatibility or conflict. CITY will provide orientation for
new COUNTY employees that will provide service to CITY. CITY may participate in the
hiring process for COUNTY employees, when possible.
4. COMPENSATION.
A. Non -Electrical Plans Examinations.
1) For building, mechanical, plumbing, manufactured home set-up,
manufactured home, or recreational parks plans examinations services,
CITY shall pay to COUNTY 46% of plans examination fees collected

within CITY limits and 50% of plans examination fees collected in the
unincorporated UGB.
2) When services under Section 2.A. are provided exclusively by CITY,
CITY shall retain 100% of fees for such services provided.
B. Non -Electrical Inspections.
1) For building, mechanical; plumbing, manufactured home set-up,
manufactured home, or recreational parks inspection services provided by
COUNTY to CITY under the terms of Section 2.B of this Contract, CITY
shall pay to COUNTY 46% of permit fees collected within CITY limits
and 50% of permit fees collected in the unincorporated UGB_
2) When services under Section 2.B. are provided exclusively by CITY,
CITY shall retain 100% of fees for such services provided.
3) When the CITY performs a part of the inspection functions for a specific
type of permit, they shall retain a portion of the permit fees at a rate of
sixty-five ($65.00) dollars per hour based on the field time of CITY staff
performing the inspections including driving time.
C. Electrical Inspections and Plan Reviews.
1) As compensation for the following services to be provided by COUNTY
to CITY under the terms of Section 2.A and 2.B of this
Contract(redundant wording), CITY shall pay to COUNTY as follows:
75% of Electrical permit fee, 75% of electrical plan check fee, 75% of
investigation fee, 75% of Oregon State levied penalty fee,75% of master
permit and industrial in -plant program fee collected by the CITY within
the city limits and the UGB.
2) When services under this Section are provided exclusively by the CITY,
CITY shall retain 100% of fees for such services provided.
D. CITY agrees to pay COUNTY for administrative and information technology
services detailed in Exhibit 1 attached and incorporated by reference herein.
E. COUNTY shall not be entitled to compensation for the services provided under
subsections 2.D. through I.
F. Payment to COUNTY shall be based on the aforementioned fees and shall not
include or be based on any additional CITY fees the CITY may collect.
G. Any fees for services outside of the above permit revenue sharing shall only be
incurred after written authorization from CITY Community Development
Director or Designee.

H. COUNTY agrees to reimburse to the CITY any fees collected by the COUNTY
for plans examination performed exclusively by the CITY retroactive to August
18, 2006.
5. PAYMENT. Compensation due COUNTY by CITY shall be paid as follows:
A. COUNTY services provided under Sections 2.A. through C.
1) COUNTY shall submit billing statement(s) for payment of COUNTY'S
share of fees collected during the previous month by the 5th day of the
immediately following month and CITY shall pay such billing
statement(s) on or before the 25th day of the month in which the billing
statement is received.
2) CITY agrees to pay COUNTY a late payment charge of 1.5% per month
for any billing statement(s) received by CITY on or before the 5th day of
the month, which is not paid, by the 25th day of that month.
B. COUNTY provided administrative and information technology services listed in
Exhibit 1
1) All billings from specified COUNTY Departments will be submitted to
CITY on or before the 15th day of the month and CITY shall pay such
billing statements on or before the 5th day of the following month in which
the billing statement is received.
2) CITY agrees to pay COUNTY a late payment charge of 1.5% per month
for any amounts due and not paid after the 5th day of the following month
in which the billing statement is received.
C. Payment by CITY of any such billing statement shall release CITY from any
further payment obligation to COUNTY for services performed or expenses
incurred as of the date of the billing statement.
6. CITY'S OBLIGATION. In addition to the obligations in Paragraphs 4 and 5 above, in
order to facilitate the services to be provided by COUNTY to CITY under the terms of
this Contract, CITY agrees to do the following:
A. Receive all permit applications and messages and promptly advise COUNTY of
such receipt.
B. Issue permits, collect fees, and provide related administrative services.
C. Require all applicants to pay building, mechanical, electrical, plumbing, and
manufactured home permit fees, plan check fees, and manufactured home park
and recreational vehicle park fees prior to the issuance of any permit. CITY shall
charge fees in accordance with its: (i) building, mechanical, electrical, plumbing,
and manufactured home set up and recreational vehicle park permit fee schedules;
(ii) valuation schedules, and (iii) any additional fees assessed or required by

CITY. ORS 455.210 shall govern maximum structural, plumbing, electrical,
mechanical, manufactured home set up and recreational vehicle park permit fees.
D. Review plans for compliance with CITY'S Development Code and other
applicable CITY ordinances and requirements, and notify COUNTY in writing of
any concerns or issues by notations on the building plans.
7. LIMITATION. This agreement is expressly subject to the provisions and requirements
of ORS 279A and 279B and to the debt limitation of Oregon counties as set forth in
Article XI, Section 10, of the Oregon Constitution, and is contingent upon funds being
appropriated therefore. In the event sufficient funds are not appropriated for the payment
of consideration required to be paid under this agreement, and if City has no funds legally
available for consideration from other sources, then either party may terminate this
agreement in accordance with Section 13 of this agreement. Any provisions herein, which
would conflict with law, are deemed inoperative to that extent.
8. NON-DISCRIMINATION._ Each party agrees that no person shall, on the grounds of
race, color, creed, national origin, sex, marital status, or age, suffer discrimination in the
performance of this agreement when employed by either party. Each party agrees to
comply with Title VI of the Civil Rights Act of 1964, with Section V of the
Rehabilitation Act of 1973, and with all applicable requirements of federal and state civil
rights and rehabilitation statutes, rules and regulations. Additionally, each party shall
comply with the Americans with Disabilities Act of 1990 (Pub. L. No. 101-336), ORS
659A.142, and all regulations and administrative rules established pursuant to those laws.
9. PARTNERSHIP. Neither party is, by virtue of this agreement, a partner or joint
venturer in connection with activities carried out under this agreement, and shall have no
obligation with respect to the other party's debts or any other liability or obligation of the
other party of whatever kind or nature.
10. CITY's REPRESENTATIVE. CITY's authorized representative for the purposes of
this Contract shall be the Redmond Community Development Director or the Director's
designee.
11. COUNTY's REPRESENTATIVE. COUNTY's authorized representative for the
purposes of this Contract shall be Deschutes County Community Development Director
or the Director's designee, 117 NW Lafayette, Bend, Oregon 97701, phone 541-388-
6558, fax 541-385-1764.
12. SUBCONTRACT - ASSIGNMENTS AND DELEGATION. This Contract, and all of
the covenants and conditions hereof, shall inure to the benefit of and be binding upon
CITY and COUNTY respectively and their legal representatives and successors. Except
as otherwise proved herein, COUNTY shall not assign any rights nor delegate any duties
incurred by this Contract, or any part hereof without written consent of both parties, and
any assignment or delegation in violation hereof shall be void.

13. TERMINATION OF CONTRACT. COUNTY or CITY may terminate this Contract at
any time upon 30 calendar days written notice. In addition, CITY may terminate this
contract upon not less than sixty (60) calendar days written notice to COUNTY if
COUNTY breaches any of the terms herein or in the event of any of the following:
Insolvency of COUNTY; voluntary or involuntary petition in bankruptcy by or against
COUNTY; appointment of a receiver or trustee for COUNTY; or an assignment for
benefit of creditors of COUNTY; or any violation of the terms of this agreement.
14. ACCESS TO RECORDS. CITY shall have access to such books, documents, papers
and records of COUNTY as are directly pertinent to the services performed under the
terms of this Contract for the purpose of conducting an audit or examination or obtaining
excerpts and transcripts. The COUNTY shall have reciprocal access to CITY planning
and building files.
15. FORCE MAJEURE. Neither party to this Agreement shall be liable to the other party
for delays in performing the Services or for the direct or indirect cost resulting from such
delays that may result from strikes, riots, war, acts of governmental authorities,
extraordinary weather conditions or other natural catastrophe, or any other cause beyond
the reasonable control or contemplation of either party.
16. NON -WAIVER. The failure of CITY to insist upon or enforce strict performance by
COUNTY of any of the terms of this contract or to exercise any rights hereunder shall not
be construed as a waiver or relinquishment to any extent of its right to assert or rely upon
such terms or rights on any future occasion The COUNTY shall have reciprocal rights to
insist upon or enforce strict performance by the CITY of any of the terms of this contract.
17. ATTORNEY FEES. In the event suit, action or arbitration is instituted to enforce any of
the terms of this Contract, the prevailing party shall be entitled to recover from the other
party such sum as the court or arbitrator may adjudge reasonable as attorney's fees at trial
or on appeal of such suit or action, in addition to all other sums provided by law.
18. APPLICABLE LAW. This Contract will be governed by the laws of the State of
Oregon.
19. INDEMNIFICATION. To the extent permited by Article XI, Section 10, of the Oregon
Constitution and the Oregon Tort Claims Act, ORS 30.260 through 30.300, COUNTY
agrees to indemnify and to hold harmless the CITY, its Officers, Employees, and Agents
against and from any and all loss, claims, actions, suits, including costs, and attorney's
fees, for or on account of injury, bodily or otherwise, to, or death of persons, damage to
or destruction of property belonging to CITY, COUNTY or others, resulting from, arising
out of, or in any way connected with COUNTY's negligent, intentional or reckless acts.
COUNTY agrees to defend all such claims on behalf of the CITY, whether frivolous or
not. CITY acknowledges and agrees that to the extent COUNTY is an agent of CITY in
carrying out COUNTY'S duties and responsibilities under the terms of this Contract,
COUNTY is covered by CITY'S insurance policy and entitled to the protections of an
agent of CITY under the Oregon Tort Claims Act. The parties understand COUNTY does

not provide its own professional liability insurance for the building official and inspection
duties and services to be performed hereunder.
20. ARBITRATION. Any controversy or claim arising out of or relating to this Contract,
including without limitations, the making, performance, interpretation or enforcement of
the Contract and any provisions contained herein, shall be settled by binding arbitration
in Deschutes county, Oregon, in accordance with ORS 36.300 — 36.365, and judgment on
the arbitration award may be entered in any court having jurisdiction over the subject
matter of the controversy.
21. COMPLETE CONTRACT. This contract and any referenced attachments constitute the
complete Contract between CITY and COUNTY and supersede all prior written or oral
discussions or agreements. This agreement may not be modified or amended except by
writing signed by all parties to this agreement.

Exhibit 1
Administration and Information Technology Services
Compensation for COUNTY administration and information technology services for
operation support and system maintenance is outlined below.

with the computer network and application support services
provided by COUNTY Information Technology (IT)Department.
Services include IT staff time to maintain current level of
COUNTY computer and network operation for the services
provided in the Contract. Examples include Helpdesk and
application support. The rate is the actual cost of service ("ACS")*
for each COUNTY staff person assigned to this service.
Infrastructure support: includes all costs for COUNTY services

will be reviewed annually by COUNTY. Based on the results of

year and $625 per printer per year. The first invoice will cover the
period from start of this Contract through end of the fiscal year 07-

JBase License Agreement: JBase is required to access Accuterm,

contract, and is based on a per license rate. JBase licenses are
invoiced to COUNTY IT annually by JBase licensing provider.
COUNTY IT will in turn invoice CITY for JBase licenses assigned
to CITY. The 2008 rate is $56 per year per JBase license dedicated
to CITY use. A 30 -day notification of change in licensing rate will
be provided to CITY based on the change in invoiced amount by
licensing provider. The first invoice will cover the period from the

effective date of this contract through end of the fiscal year 07-08.
Subsequent annual invoices will be billed each July 1.
*"ACS" means COUNTY employee's salary per hour plus the value of all benefits included in
the employee's COUNTY compensation package plus 15% for additional overhead costs to
COUNTY.

IVR administration, system maintenance and upgrades: For
COUNTY inspection services provided under this contract,
COUNTY and customers shall use the COUNTY IVR system
(inspection request/results computer program). The cost to CITY
for the use of this system includes COUNTY services for
administration and management of the COUNTY IVR system.
The designated COUNTY IVR Administrator will track total time
providing system operations administration. In addition to IVR
Administrator's time, a report from COUNTY IT for remaining
COUNTY IVR services and support by COUNTY staff will be
provided to COUNTY for billing purposes. An application report
will be written by COUNTY IT to calculate the percent of total
inspections performed by COUNTY for CITY for a rolling —12
month period (current month plus the previous 11 months). Using
the rolling 12 -month average percentage of total inspections
conducted by COUNTY for CITY, COUNTY will invoice CITY
for IVR administrative and support services by COUNTY staff.
The rate is ACS* for each COUNTY staff person assigned to this
service.
Laser Fiche consultation support: COUNTY will allow CITY to
use COUNTY Laser Fiche software to scan inspection related paper
documents for storage and public retrieval purposes. COUNTY
Laser Fiche administrator will provide instruction and consultation
pertaining to the management of CITY scanned Community
Development Department images upon request by CITY. The rate
for this service is ACS* for each COUNTY staff person assigned to
this service.
System Licenses and/or Maintenance Agreements: COUNTY
software licenses and maintenance agreements are required in order
to continue to use the COUNTY computer and network system or
system applications for services provided in this contract, including
the COUNTY IVR and the COUNTY Laser Fiche. IVR and Laser
Fiche each have annual license/maintenance agreements with
respective providers and are subject to annual increases by the

* "ACS" means COUNTY employee's salary per hour plus the value of all benefits included in
the employee's COUNTY compensation package plus 15% for additional overhead costs to
COUNTY.
