MINUTES OF BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, MARCH 5, 2008
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Dennis R. Luke and Michael M. Daly; Commissioner
Tammy Melton was out of the office. Also present were Dave Kanner, County
Administrator; Erik Kropp, Deputy County Administrator; Laurie Craghead, Legal
Counsel; Teresa Rozic, Property Management; Sue Brewster, Sheriff's Office;
Kathleen Christensen, Health Department; Sherri Pinner, Mental Health
Department; a media representative of KOHD TV and five other citizens.
Chair Luke opened the meeting at 10:00 a.m.
1. Before the Board was Citizen Input.
Tony Aceti, who lives at 21235 Tumalo Road, testified that he submitted a
letter to the Commissioners on March 3, and wants to meet personally with the
Board regarding a land use issue. Commissioners Daly and Luke said that they
had received the letter. Mr. Aceti went on to read his letter at this time.
In response to Mr. Aceti's statement that neighbors have not made any
complaints, Commissioner Luke said that the statement was not correct. Mr.
Aceti clarified that perhaps someone had complained at some point in the past.
He said he had a two -hour meeting with Tim Grunderman, a Code Enforcement
Officer, and feels that the court may not drop this issue until it is cleared up. He
feels that it is one sided when presented by staff. He does not want to spend
any more money to submit another application and wants to work it out with the
Board.
Commissioner Daly said that he is willing to meet but is not sure if it is proper
at this point. He did try to call this up to try to address an appeal, but the other
Commissioners were not supportive. Now this is in Code enforcement.

Mr. Aceti said that Code does not allow him to rectify this for another six
months, but he would like a stay for six months to take out another application
at that time. He does not want to have to go to court in the meantime.
Laurie Craghead said that Mr. Aceti is represented by counsel and she cannot
talk directly with him. She said that the Board should discuss this issue with
her at another time. A public records request has been made by the attorney,
and there is potential litigation.
Commissioner Daly stated that he would like to forestall another Code
enforcement action for some time. This was discussed by the Board earlier.
Ms. Craghead said that this was discussed under executive session and cannot
be brought up at this time.
Mr. Aceti said that he would like to hear from the Board directly. His attorney
is working on another part of the issue.
Commissioner Luke said that as long as he is represented by counsel, without
Mr. Aceti obtaining permission from his attorney, he cannot be contacted
directly.
2. Before the Board was Consideration of Signature of Document No. 2008-
110, an Intergovernmental Agreement between Benton, Jackson and
Deschutes Counties for the Male Advocates for Responsible Sexuality
(MARS) Program Expansion.
Kathleen Christensen gave a brief overview of the item and the program. It is
more likely to be grant funded if the program includes multiple locations. This
will allow the group to go forward to apply for funding.

3. Before the Board was Consideration of Signature of Document No. 2008-
111, an Amendment to an Intergovernmental Agreement with the Oregon
Department of Human Services regarding Mental Health Services.
Sherri Pinner presented the item, which increases the capacity to offer services
to people with mental illness.

4. Before the Board was Consideration of Chair Signature of Document No.
2008 -114, an Intergovernmental Agreement with the Oregon Department
of Human Services regarding Alcohol and Drug Screenings for Parents
Involved in the Child Welfare System.
Ms. Pinner stated that this program provides on -site services at the State offices
in Bend. If an alcohol or drug problem is suspected, the person is referred to
the County for evaluation and assistance.

5. Before the Board was Consideration of Signature of Document No. 2008-
104, a Lease Amendment with Munchkin Manor Preschool at the County.
Teresa Rozic explained the lease amendment, which would extend the lease for
three years. She then gave an overview of the services provided.

6. Before the Board was Consideration of Signature of Documents No. 2008-
106 and 2008 -107, Amendments to Agreements with the Humane Society of
Central Oregon and the Humane Society of Redmond regarding Animal
Shelter Services.
Ms. Craghead explained that this is not a renewal; just an amendments to
provide for payment for larger animal impounds and some additional reporting
requirements from the agencies. It has taken about a year of negotiations to
reach agreement.
Pat Roden of the Humane Society of Central Oregon, and Jamie Kanski of the
Redmond Humane Society then came before the Board.
Commissioner Luke said that he has received e -mails about requiring cats to be
altered before they are adopted out. There was also discussion about requiring
chips for animals before leaving the shelter. Ms. Craghead said that this
information was not discussed with them as the agreements are up for renewal
next year. However, the County does provide funding beyond the building and
impounds.
Commissioner Luke asked if they require cats to be altered before they go out,
and would this mean fewer would be adopted. Commissioner Daly said one of
the e -mails they received said the shelters get $1 a pound for cremations and
this is a cash cow, causing them to euthanize more than they should.
Jamie Kanski replied that altering is included in the adoption fee and is a
requirement of the adoption. They always alter before adopting out, with a few
exceptions if the cat is too small or isn't healthy enough for surgery, and staff
follows up to make sure it is done.
In regard to cremations, gasoline needed to pick up animals from vet clinics is
expensive and natural gas prices are higher, so there is very little money made
on cremations.
Pat Roden said that they alter all of the animals that they can before the animals
leave the shelter. A vet is on staff about 35 hours a week.
Regarding cremations, they are not making money due to the cost of gasoline
and natural gas. They spent $70,000 on natural gas alone last year.

Commissioner Daly asked how the Redmond shelter collects when they take in
animals from other counties. Ms. Kanski replied that they try to concentrate on
the local area, but in regard to the Christmas Valley puppy mill seizure they got
some funding from that county, volunteer labor and donations. They are
working on another case in Deschutes County. The biggest problem is having
to hold the animals until the court case is resolved. The first group of dogs was
held for two months. The court imposed a $125,000 bond on the owners, who
did not comply, so the dogs can now be relinquished to the shelter for adoption.
Ms. Roden read from their annual report to the public. In 2007 they held 77
fundraising events and had 124 events for education and adoptions. They did
38 school visits, reaching over 1,700 students. There have been 49 community
services projects with students. They also do a lot of media outreach.
Dave Kanner asked if the crematorium upgrade funded by the County has been
completed. Ms. Roden stated that the crematorium is out of operation this
week, but they should be able to do the first big burn by Saturday.

7. Before the Board was Consideration of Signature of Document No. 2008-
053, a Noise Permit regarding Construction at the Bend Municipal
Airport.
Kristen Maze presented the final version of the permit. Commissioner Luke
said that he was surprised that citizens weren't present regarding this issue, as
he heard a woman complaining on the radio today about not receiving a notice.
He asked where the notices were sent. Ms. Maze replied that they were sent
within 1/4 mile of the airport, and were sent out earlier than required, about
fifteen days ago. Notification is not a perfect system, but they also noticed this
in the Bulletin and mailed it to people who had previously testified —
approximately 36 people, some of which who live in the general area. The
Airport Manager, Sue Palmeri, also had a neighborhood meeting but attendance
was very low.

Ms. Craghead said the permit is almost identical to the previous permit.
Commissioner Daly stated that if lots of manpower and equipment are there,
this is the fastest way to get it done. The contractor has to at least be able to
work an eight -hour day to make it cost effective.
Ms. Maze said that the application contained a task mission, but they could not
give exact times when they would have to do rock hammering due to the nature
of the job.

This morning I had a two hour conversation with code enforcement officer: Tim
Grundeman. He told me that an e-mail is before you, discussing whether or not to take
me to court on an alleged violation use of my property.
As you know, "modified equipment" used for hay was found to be allowed for
commercial use. After two attempts to rectify the problems, the limitations were
unacceptable and were not logical. However, the findings supported my activity in both
decisions.
Historically I have tried to operate under my CUP. What I believe is an allowed use,
CDD staff believes is a violation. I have the right to generate an income by performing
under my CUP. The property was uniquely impacted by the construction of the overpass.
This rendered the property unfarmable as compared to the use prior to my purchase.
The highest and best use of the property is not growing hay for profit. That is
impossible! The overpass, on so many levels, created a change of circumstance. The
point at hand today is that I cannot submit another land use application for six months
because county code does not allow new applications within this time frame.
In an executive meeting, I want the opportunity to discuss and solve this problem before
the court system is the judge.

Community Outreach
Community Events:
The Humane Society of Central Oregon schedules community outreach events throughout the year. Each event
day is targeted outreach for a specific purpose which includes; adoption, humane education or raising of funds,
food or supplies. Some event days are planned to encompass multiple goals.
The following chart depicts the number of event days per month that HSCO reaches out to the community beyond
normal shelter functions. This means that HSCO is out in the community at an event location other than the
shelter or has specifically marketed to bring community members to the shelter. Some event days HSCO is at
multiple locations.

HSCO Humane Education Program
The Humane Society of Central Oregon reaches all ages of people in our community through our education
program. Lynne Ouchida, humane educator for eight years, regularly visits Bend, LaPine and Sisters. The
program provides three basic programs; responsible pet care, bite prevention /safety around pets and the link
between human and animal abuse. Custom programs are created to meet the requirements of the teachers. The
education program also informs the community on HSCO's role in caring for the people and animals in our
community. The goal of the education program is to be a utilized as a first resource for animal welfare and to
teach humane treatment and respect for all animals.
An increasing number of schools, classes and youth group come to HSCO for presentations and tours. Many of
these visits incorporate community service projects of making things for the animals (cat toys, beds, scratching
posts, biscuits, etc) or volunteering their time.
HSCO's humane education program reaches public and private school, at -risk youth program, private and public
pre -K daycare programs, adult service groups, life skills program through public and private schools and Eend
Parks and Recreation programs.

Humane Society of the US (HSUS) Animal Fighting Workshop October 29, 2007, co- sponsored by HSCO and
other shelters, County DA and ACO's and Bend PD. HSUS, ALDF, Deschutes and Jefferson County District
Attorney's presented information on animal fighting to local humane society, County and City Animal Control
Officers from Deschutes, Jefferson and Lane Counties.
