TITLE OF AGENDA ITEM:
Consideration of Signature of Document 2008-104, a Lease Amendment between Deschutes County as
Lessor and Munchkin Manor Preschool at the County, LLC as Lessee.

BACKGROUND AND POLICY IMPLICATIONS:
Lessee operates as the Munchkin Manor Daycare & Preschool at the Mike Maier Services Building.
Priority for open slots for daycare are first to county employees, then state employees who are housed
as tenants in county facilities, then the general public.
The lease expires March 31, 2008; this is a three-year extension. Lessee requested an amendment to the
lease so that she could adjust the rate schedule. Lessee desires to grant annual salary increases to staff
to help offset increases in costs of living. The amendment also memorializes the agreement with the
nonprofit organization Mary's Place to provide supervised visitation in the leased premises.
FISCAL IMPLICATIONS:
County provides the space and utilities free of charge in exchange for reduced daycare rates. Lessee
provides its own janitorial services and supplies. Lessee is also responsible for maintaining appropriate
and necessary certifications and any costs associated with this. Staff feels it is reasonable to allow an
annual rate increase to keep up with inflation and salary increases.

Staff recommends signature of Document No. 2008-104.

LEASE AMENDMENT
THIS LEASE AMENDMENT is made and entered into by and between DESCHUTES
COUNTY ("Lessor") and MUNCHKIN MANOR PRESCHOOL AT THE COUNTY, LLC ("Lessee").
WITNESSETH:
WHEREAS, Lessor and Lessee entered into a Lease (DC 2005-019) with an effective date
of June 1, 2005, for property located at 1130 NW Harriman, Bend, Deschutes County, Oregon, and
WHEREAS, Lessor and Lessee entered into an Amendment To Lease Agreement (DC
2006-388) with an effective date of September 1, 2006, and
WHEREAS, Lessor and Lessee wish to extend the term of the Lease and make other
changes;
NOW, THEREFORE, Lessor and Lessee agree that the Lease is hereby amended to read
as follows:
Section 1. 1. Term. The term of this Lease shall be effective June 1, 2005, and shall
continue through March 31, 2011.
Section 2. 4. Use of Premises. In addition, when the premises is not being used for
childcare and preschool, Lessee shall allow the nonprofit organization Mary's Place to use the
premises for supervised visits and monitored exchanges for parents going through divorce or separation
when issues of child custody are involved.
Section 3. The tuition rate schedule is attached as Exhibit 1 and shall take effect on and
after September 1, 2008.
In all other respects the Rental Agreement shall be and remain in full force and effect.
