No. BACKGROUND AND POLICY IMPLICATIONS: Building on the accomplishments of Regional Problem Solving, a National Demonstration Project, a Groundwater Protection Program, and a draft Local Rule, starting in July 2008, a steering committee interfacing with south county stakeholders will provide policy direction for updating the Deschutes County Comprehensive Plan. The steering committee will specifically evaluate the cumulative impacts of developing approximately 1,500 high groundwater lots (areas with less than 2 feet of separation from groundwater). These properties are located near critical ecological areas, including riparian areas, wetlands, and deer migration corridors. An Oregon Department of Land Conservation and Development Technical Assistance Grant consisting of $90,000 will help offset the expenses associated with providing support for a steering committee and associated stakeholder involvement processes to address land -use and water quality issues in the region. Besides contributing to staff expenses, the grant will also recoup costs associated with professional facilitation and U.S. Geological Survey modeling. FISCAL IMPLICATIONS: The $90,000 state grant, recognized as revenue is budgeted for fiscal year 2008/2009. The grant agreement number TA -R-09-178 indicates the total amount of our offer and lists the standard and special conditions Deschutes County must meet. Please read them carefully. You will find your grant agreement in a separately attached PDF file. Please print two copies. Both originals of the agreement must be signed by Deschutes County and both originals must be returned to my attention at the address listed on the letterhead and received in the Salem Office by April 4, 2008. Where the terms of this grant agreement and proposal differ, the terms of this grant agreement shall prevail. 2. Grantee agrees that all reports, studies, and other documents produced under this grant agreement must indicate on their cover or the title page an acknowledgement of the financial assistance provided by the Department of Land Conservation and Development. 3. Grantee agrees to submit a written report with each interim payment request that describes the progress to date on each grant product undertaken during the billing period, Other written andlor verbal progress reports will be provided upon reasonable request by the DLCD Grant Manager, 12, Grantee agrees to consult closely with the DLCD Grant Manager to ensure completion of grant products within the approved grant payment schedule for this grant. 13, Grantee agrees to no more than a interim payments and a final payment by DLCD during the term of this grant, and agrees that payments will be made only upon submittal of qualifying products in accordance with the terms of this grant agreement, 14. Grantee agrees to submit hard copies of all maps, in addition to submitting maps in GIS format on CD- andlor DVD -ROM, and to attach GIS specifications to grant products, 15, Grantee agrees that all products and data specifically generated with grant funds shall be the property of DLCD and, as such, DLCD may display the appropriate products on its "home page" andlor incorporate into state agency databases the GIS data generated as part of work funded by this grant and any additional data provided that is not specifically restricted, DLCD shall include a disclaimer acknowledging that the Grantee and agents of the Grantee are not responsible for the accuracy of said data. DLCD may also share such data specifically generated with grant funds with other agencies and organizations. 16. Grantee agrees to have a final work plan for the 2009-2011 Biennium that includes the process, product description and time line for completion of the remaining project elements, including the adoption of comprehensive plan policies and land use regulations, produced by the High Groundwater Work Program under this grant (See Grant Item #8, below), 17. DLCD Funds: DLCD certifies that on the effective date of this grant sufficient funds are available and authorized. 2, Reporting: At any time during the grant period, when requested by the DLCD Grant Manager, Grantee shall provide a written report on the status and progress of work performed under this grant, 3. Payments, DLCD payments to Grantee under this grant agreement shall be made in accordance with the grant payment schedule described in the "Products, Activities, andlor Payments" table of this agreement. Payment is contingent upon DLCD's acceptance of the products produced under the grant. Grantee agrees that reimbursement of all amounts requested by Grantee is contingent upon compliance with all the terms and conditions of this grant agreement. 4. Penalty: Payments to Grantee may be withheld or reduced if DLCD determines that work performed under the grant is unsatisfactory, based on the best professional judgment of the DLCD Grant Manager, or if one or more terms or conditions of this agreement have not been met to the extent provided by law. S. Termination, a. DLCD's Right to Terminate at its Discretion, At its sole discretion, DLCD may terminate this Grant Agreement: i, For its convenience upon thirty (30) days' prior written notice by DLCD to Grantee; Immediately upon written notice if DLCD fails to receive funding, appropriations, limitations, allotments or other expenditure authority at levels sufficient to pay for the work or products hereunder; or iii, Immediately upon written notice if federal or state laws, regulations, or guidelines are modified or interpreted in such a way that the DLCD's financial assistance under this Grant Agreement is prohibited or DLCD is prohibited from paying for the work or products hereunder from the planned funding source. b. DLCD's Right to Terminate for Cause. In addition to any other rights and remedies DLCD may have under this Grant Agreement, DLCD may terminate this Grant Agreement immediately upon written notice by DLCD to Grantee, or at such later date as DLCD may establish in such notice, or upon expiration of the time period and with such notice as provided below, upon the occurrence of any of the following events: i. Grantee is in default because Grantee institutes or has instituted against it insolvency, receivership or bankruptcy proceedings, makes an assignment for the benefit of creditors, or ceases doing business on a regular basis; Department of Land Conservation and Development Page 7 of 9 2007.2009 General Fund TA Grant Agreement Deschutes County TA -R•09.178 Grantee is in default because Grantee commits any material breach or default of any covenant, warranty, obligation or agreement under this grant agreement, fails to perform any of its obligations under this grant agreement within the time specified herein or any extension thereof, or so fails to pursue its work hereunder as to endanger Grantee's performance under this grant agreement in accordance with its terms, and such breach, default or failure is not cured within 14 calendar days after DLCD's notice, or such longer period as DLCD may specify in such notice. c. Grantee's Right to Terminate for Cause, Grantee may terminate this grant agreement with written notice to DLCD upon the occurrence of the following events: i, DLCD is in default because DLCD fails to pay Grantee any amount due pursuant to the terms of this grant agreement, and DLCD fails to cure such failure within thirty (30) calendar days after Grantee's notice or such longer period as Grantee may specify in such notice; or DLCD is in default because DLCD commits any material breach or default of any covenant, warranty, or obligation under this grant agreement, fails to perform its commitments hereunder within the time specified or any extension thereof, and DLCD fails to cure such failure within thirty (30) calendar days after Grantee's notice or such longer period as Grantee may specify in such notice, d. Return of Property. Upon termination of this grant agreement for any reason whatsoever, Grantee shall immediately deliver to DLCD all of DLCD's property (including without limitation any work or work products for which DLCD has made payment in whole or in part) that is in the possession or under the control of Grantee in whatever stage of development and form of recordation such property is expressed or embodied at that time. Upon receiving a notice of termination of this grant agreement, Grantee shall immediately cease all activities hereunder, unless DLCD expressly directs otherwise in such notice of termination. Upon DLCD's request, Grantee shall surrender to anyone DLCD designates, all documents, research or objects or other tangible things needed to complete the work and the work products. e. Termination under Section 5 shall be without prejudice to any claims, obligations, or liabilities either party may have incurred prior to such termination. 6. Failure to Comply: If a part,' fails to comply with any of the requirements or conditions of this agreement, the other may, without incurring liability, refuse to perform further pursuant to this agreement, DLCD shall make no further reimbursement to Grantee and Grantee shall upon demand by DLCD promptly repay DLCD all unexpended grant funds and grant funds expended in breach of this grant agreement. 7. Accounting and Fiscal Records: Using standard accepted accounting and fiscal records, the Grantee shall maintain records of the receipt and expenditure of all funds subject to this grant agreement for a period of three years after the closing date. Grant accounting records will be separately maintained from other accounting records, 8. Closeout report: The Grantee shall submit a closeout report to DLCD within 30 days after termination of the grant period. 9. Subsequent funding: Eligibility for subsequent funding is contingent upon receipt of such reporting by DLCD, Department of Land Conservation and Development Page 8 of 9 2007.2009 General Fund TA Grant Agreement Deschutes County TA -R-09-178 10. Closeout Payment: Reimbursement up to the total amount of remaining grant funds will be made upon submittal of all required grant products, up to and including those required for the final reimbursement, and a signed DLCD closeout form acceptable to DLCD, DLCD shall authorize payment to the Grantee within 90 days of such submittal for all required work and grant products that are accepted by the DLCD Grant Manager after review for compliance with the grant conditions, 11. Closeout Penalty: DLCD reserves the right to reduce or withhold final payment if a closeout report is submitted to DLCD after the 30 days, as referenced in Standard Condition Number 8. 12. Audit, The Oregon Secretary of State, Attorney General of the State of Oregon and the Director of DLCD or any other duly authorized representative of DLCD shall have access to and the right to examine any records of transactions related to this agreement for three years after the final payment under this agreement is authorized by the department, 13. Indemnity: Grantee shall defend, save, hold harmless, and indemnify the State of Oregon and DLCD and their officers, employees and agents from and against all claims, suits, actions, losses, damages, liabilities, costs and expenses of any nature whatsoever resulting from, arising out of, or relating to the activities of Grantee or its officers, employees, subcontractors, or agents under this Agreement. 14, Appropriate use °Hands: unds: Grant funds cannot be used for any purpose other than for work done in accordance with the work plan during the grant period. 15.Amendments: Amendments must be facilitated by the DLCD Grant Manager. An amendment may be initiated at any time during the grant period, but at least 30 days prior to the end date on a grant period of one year or less. These wastewater treatment systems are located on lots platted prior to state-wide planning legislation Provided in the Exhibit A is a timeline of events related to water quality in the region, Exhibit B provides a summary of County related projects starting with Regional Problem Solving in 1996 as well as other environmental activities occurring in the Upper Deschutes Basin, The Deschutes County Board of County Commissioners (Board) will be holding a public hearing on March 19, 2008 in La Pine to take testimony on a final draft of a Local Rule, The Local Rule specifies onsite nitrogen -reducing requirements, in addition to referencing other techniques like sewer to maintain safe drinking water standards in the La Pine sub -basin, If adopted, Deschutes County will initiate a steering committee, described in detail below to discuss the cumulative impacts of developing high groundwater lots. Steering Committee Building on the accomplishments of Regional Problem Solving (RPS), a National Demonstration Project, a Groundwater Protection Program, and a draft Local Rule, starting in July 2008, a steering committee interfacing with south county stakeholders will provide policy direction for updating the Deschutes County Comprehensive Plan. The steering committee will specifically evaluate the cumulative impacts of developing approximately 1,500 high groundwater lots (areas with less than 2 feet of separation from groundwater). These properties are located near critical ecological areas, including riparian areas, wetlands, and deer migration corridors. An Oregon Department of Land Conservation and Development Technical Assistance (TA) Grant will help offset the expenses associated with providing support for a steering committee and associated stakeholder involvement processes to address land -use and water quality issues in the region. Besides contributing to staff expenses, a TA grant will also recoup costs associated with professional facilitation and U.S. Geological Survey (USGS) modeling, Professional facilitation will be instrumental as we establish a public process (Goal 1) that includes diverse civic, local, state and federal stakeholders in managing public meetings and ultimately formulating recommendations to the Board. Additionally, the use of the USGS Nitrate Loading Management Model will provide for a greater understanding of the water quality impacts (Goal 6) of development in high groundwater areas and its relation to increases in wastewater treatment needs for currently developed or developable lots platted prior to state- wide planning legislation. A cost -benefit analysis can then be performed to understand the effect High Groundwater Work Program Final Work Plan — Page 1 2/7/08 of high groundwater development on retrofitting costs to current land owners in order to maintain safe drinking water standards. South county stakeholders will also have opportunities to evaluate the cumulative impacts of high groundwater areas as it pertains to other elements of the County Comprehensive Plan, including Goal 5 (Wildlife Habitat, Wetlands, Open Space), Goal 7 (floodplains, wildland urban interface), Goal 12 (Transportation), etc. Ultimately, the steering committee and south county stakeholders will present recommendations to the Planning Commission and Board regarding the impacts resulting from development of high groundwater areas to ensure that the quality of the only source of drinking water for the region meets state, and therefore federal, standards while also meeting other adopted land -use goals and objectives. Based on steering committee recommendations, Deschutes County will then draft policies and implementation measures (Goal 2) to address, systematically the impacts of developing high groundwater table lots. I, Project Background Surf cialandSubsurface Geology The La Pine sub -basin of the Upper Deschutes River is underlain by a shallow aquifer that is the only source of drinking water for approximately 18,000 people. The soils in the region are highly porous and permeable with no intervening layer protecting the aquifer from contamination sources. The water table ranges in depth from ground surface to about thirty feet below land surface. Recharge occurs from infiltration of precipitation and averages 2.0 inches per year. Groundwater discharges by way of the Deschutes and Little Deschutes Rivers, evapotranspiration, and wells. Groundwater velocities are low and, at the water table, groundwater is generally oxic; however, at depths ranging from near zero to more than fifty feet below the water table it becomes suboxic, a boundary where nitrate can be reduced (denitrified). Denitrification thus keeps portions of the La Pine aquifer essentially nitrate -free, but the oxic portions remain vulnerable to nitrate contamination from onsite systems, the primary anthropogenic source, Field Research and Study Extensive field research and study by the USGS shows that the groundwater underlying the La Pine sub -basin is highly vulnerable and threatened by nitrates from continued reliance on traditional onsite wastewater treatment systems (standard, pressure distribution and sand filter systems). These systems, when properly located, constructed, and maintained, can reduce bacteria and other common contaminants, but cannot remove nitrogen from wastewater. USGS scientific investigations represent a large part of many efforts by Deschutes County and the Oregon Department of Environmental Quality to assess environmental impacts in a 250 -square - mile area near La Pine, where increasing residential development has led to higher nitrate concentrations in groundwater that is tapped for domestic water supply and that discharges to rivers. High Groundwater Work Program Final Work Plan — Page 2 2/7/08 Draft Local Rule / Wastewater Treatment Alternatives The Oregon Department of Environmental Quality declared a probable health hazard for the south county that triggers a mechanism for residents to justify a sewer system in rural areas, without taking an exception to Statewide Planning Goal 11 (Public Facilities), During discussions with the Oregon Department of Environmental Quality (DEQ) about a draft Local Rule, Deschutes County committed to initiate a public process to determine whether or how development could be allowed on properties with less than 24 inches of separation from ground surface to the highest level reached by groundwater. This commitment is embodied in the detailed work plan below. It is important to emphasize that the steering committee work program is predicated on the adoption of a Local Rule. Recipient proposes to use a technical assistance grant of $90,000 that will be administered through the DLCD, Recipient will provide $89,138.96 as a 49.7 percent match to the project. Initiate a stakeholder involvement program that allows a diverse steering committee, south county residents, and other stakeholders to participate in the high groundwater discussions. 2. Protect the aquifer that provides the only source of drinking water to the residents in south Deschutes County as well as surface water quality by maintaining compliance with state groundwater quality standards for nitrate -nitrogen (7 mg/L) concentrations; 3. Develop coordinated plans, procedures and processes that provide an efficient and sustainable delivery of planning and environmental services to south county residents and community by completing the High Groundwater Work Plan and including the results in the County Comprehensive Plan and regulations; 4. Use the USGS Nitrate Loading Management Model to understand water quality impacts (Goal 6) caused by development in high groundwater areas in relation to existing and predicted groundwater quality impacts from currently developed or developable lots platted prior to state-wide planning legislation; High Groundwater Work Program Final Work Plan — Page 3 2/7/08 5. Collect and synthesize existing data and identify data gaps that if acquired can contribute to a more comprehensive baseline assessment of the physical and natural conditions of the La Pine sub -basin; 6. Evaluate the implications of development in high groundwater areas as it pertains to other elements of the County Comprehensive Plan, including Goal 5 (Wildlife Habitat, Wetlands, Open Space), Goal 7 (floodplain, wildland urban interface), and Goal 12 (Transportation); and, 7. Draft policies and implementation measures that reflect the recommendations of the stakeholder involvement process to define the level of development in high groundwater areas that should be allowed. If additional development in these areas is recommended, the policies need to balance or mitigate, systematically, the impacts of developing high water table lots with other relevant Statewide Planning Goals (Goals 5, 6, 7, 11, 12), III, Detailed Work Plan High Groundwater Work Program — Deschutes County has a long history of working to promote groundwater and other natural resource protection in south Deschutes County culminating most recently in a Groundwater Protection Project. A steering committee is the primary conduit of the high groundwater work program. It will be composed of diverse civic, local, state and federal organizations, Besides providing recommendations, they will work with staff to engage south county residents to discuss issues related to the development of high groundwater lots using onsite wastewater treatment systems or sewer systems. Starts; Due: Description: Retain Technical Assistance from U.S. Geological Survey to Apply Nitrate Loading Management Model March 1, 2008 February 28, 2009 As part of a previous study, the USGS developed a model capable of simulating the fate and transport of nitrate within the ground -water system. The model was developed using the USGS MODFLOW code (Harbaugh and McDonald, 1996) to simulate ground -water flow and the MT3D-MS code (Zheng) for simulation of the advection and dispersion of nitrate. Model calibration, input parameters, boundary conditions, and limitations are documented by Morgan et al (2005a). This model was later enhanced by adding optimization capability to create the nitrate loading management model 1' LMM), The NLMM uses the output from the fate and transport simulation model and specified environmental and onsite system performance constraints to generate "nitrate reduction solutions" for existing and future development located in 94 subareas of the La Pine area. The County's task will be to evaluate the cumulative impacts of developing high groundwater lots with onsite or sewer systems. This analysis will provide the steering committee with a framework for categorizing subareas based on their nitrate reduction solution, number and characteristics of lots (developed versus vacant), neighborhood profile, and age of existing septic systems. Ultimately, these queries should aid the steering committee in understanding mitigation approaches for retrofitting or replacing or existing certain onsite systems with denitrification technology if high groundwater lots are developed. High Groundwater Work Program Final Work Plan — Page 10 2/7/08 EXHIBIT B Deschutes County — Regional Problem Solving Partially due to the community's interest in preventing groundwater contamination, La Pine residents engaged the county in Regional Problem Solving (RPS). Beginning in 1996, Regional Problem Solving was a $157,000 state funded, four year project that allowed the citizens of La Pine and local, state and federal stakeholders to develop comprehensive approaches related to groundwater protection and other land -use issues in the south county. In 1998, as a result of Regional Problem Solving, Deschutes County adopted new comprehensive plan policies pertaining to: (1) Water quality threatened by septic systems; (2) High water table; (3) Existing subdivisions with unbuildable lots; (4) development impacts wildlife, especially deer migration corridor; (5) Extreme wildfire potential; (6) Poor quality roads; and, (7) Lack of evacuation routes. Deschutes County — National Demonstration Project Starting in 1999, the DEQ received a $5.5 million grant to test innovative wastewater treatment systems in the La Pine sub -basin. The La Pine National Decentralized Wastewater Treatment Demonstration Project identified innovative nitrogen reducing onsite systems and examined the geochemistry and groundwater flow of the aquifer during development of the 3-D groundwater and nutrient fate and transport model. Deschutes County — Transferable Development Credits In 2002, the Deschutes County Board Commissioners adopted a Transferable Development Credit (TDC) Program that made the Neighborhood Planning Area, which included the Baldwin-Herdon Trust lands as the receiving area for transferable development credits, The intent of the program was to transfer some future residential development from "sending areas" served by onsite septic systems outside LaPine's urban unincorporated area, to the Neighborhood Planning Area, which is served by sewer Deschutes County — Groundwater Protection Program The La Pine Sub -basin Groundwater Protection Project implements local controls on the impacts of development using pollution credit trading and nitrogen reducing onsite systems to protect the region's drinking water source. In 2006, the TDC program was amended to a pollution reduction credit trading program, Pollution Reduction Credits transfer resources from a Neighborhood Planning Area to homeowners outside the city of La Pine. Developers of Neighborhood Planning Area are to do one or ;wo things: (1) Work with homeowners to retrofit existing septic systems with nitrogen -reducing technology; (2) Pay into a "Partnership Fund" that would then be made available to property owners interested in retrofitting their existing wastewater treatment systems. High Groundwater Work Program Final Work Plan — Page 11 2/7/08 The study titled, "Characterization of Natural Attenuation Capacity in a Near -Stream Groundwater Environment" sampled shallow groundwater in different near -stream environments of the Deschutes and Little Deschutes Rivers. Results from the study show that intact riparian and wetland areas of the La Pine sub -basin protect surface waters from the impacts of nitrate -rich discharges from onsite wastewater treatment and dispersal systems, Some protection measures for these resources are available at the local level but the existing information is uncoordinated and/or in a form that is unavailable for spatial analyses or public distribution. Other Sub -basin Activities - Federal Clean Water Act Clean Water Act directives are driving development of basin -wide water quality targets (TMDLs). The Oregon Department of Environmental Quality is expected to start TMDL modeling within the next year in the Upper Deschutes and Crooked River basins with TMDLs targeted for completion in 2008. The Crooked and Deschutes and Little Deschutes Rivers, in addition to a number of tributaries are water quality limited under the Clean Water Act 303 (d) List. The Deschutes and Little Deschutes Rivers are included on the Clean Water Act 303(d) List for not meeting water quality standards for several different standards, including dissolved oxygen. Data for developing TMDLs in the upper Deschutes and Little Deschutes sub -basins were collected in 2001 and a preliminary review of the data indicates both rivers are nitrogen limited. Because of this, the introduction of even small amounts of anthropogenic nitrogen (such as wastewater nitrate in groundwater discharging to rivers) could cause a significant increase in primary productivity and affect dissolved oxygen and pH levels in the rivers. Nitrate is a nutrient that can stimulate excessive growth of aquatic plants and algae, which in turn can cause large variations in dissolved oxygen concentration and pH that can be harmful to fish and other aquatic organisms, Other Sub -basin Activities - Federal Endangered Species Act In June 2005, the Federal Energy Regulatory Commission issued a 50 -year license for Portland General Electric and the Confederated Tribes of Warm Springs to operate the Pelton Round Butte Hydroelectric Project. The new license included conditions for operations, water quality, aquatics, terrestrial wildlife and recreation. This attachment incorporates by reference, the standards specified by the FGDC's Content Standard for Digital Geospatial Metadata into the attached grant agreement. The standards can be found on the state website http://gis.oregon.gov Additionally, DLCD requires the following: • All grant products are publicly useable. • The grant product be submitted in electronic form compatible with Environmental Systems Research Institute's (ESRI) ArcGIS (coverage, shapefile, or geodatabase). • Data should be free of topological errors. • The projection of the data may be determined by the grantee. All data shall have the projection defined within the dataset and must be documented in the metadata. • Include the FGDC compliant metadata in an electronic file. Thank you.
