PUBLIC HEARING ON THIS DATE? No. BACKGROUND AND POLICY IMPLICATIONS: In November 1998, Oregon voters decided to expand vote -by -mail to the primary and general elections. Prior to that only certain elections, mostly special elections, were authorized to be conducted by mail. Now all elections in Oregon are conducted by mail. It seemed prudent to retain the election supplies until the legislature repealed the statutes related to poll elections. The 2007 Legislature passed SB74 repealing statutes related to poll elections. Earlier this year the election supplies were inventoried in order to initiate the disposal process of those election supplies that are no longer needed or are not anticipated to be needed in the future as the County continues to grow. The election supplies have: been in storage and include metal ballot boxes, supply bags, portable voting booths and pencils. Recently, Oregon State Elections was contacted by the City of Denver, CO, who is planning to conduct all paper -ballot elections this year and asked if any Oregon counties had supplies remaining they would be interested in selling. This opportunity to sell all or part of these used election supplies to another government organization prompted this request now to declare the used, not needed in the future, election supplies as surplus and dispose of them by either sale or donation as outlined in the attached resolution. The City of Denver, CO, has been provided with an inventory of the used election supplies, pries, and payment and shipping requirements. Values (prices) were based on age and use of the election supplies, as well as current pricing as could be determined. A response back from them is pending. If the City of Denver, CO, does not purchase any or all of the used election supplies, it is anticipated that other government organizations will be contacted to dispose of the supplies. FISCAL IMPLICATIONS: If the City of Denver, CO, purchased all the used election supplies no longer needed by Deschl tes County, those have been valued at $5,085. The City could decide to purchase only a portion or none of the supplies. These funds had not been anticipated and not budgeted for. RECOMMENDATION & ACTION REQUESTED: Recommend approval and signature of Resolution No. 2008-035, Declaring certain personal property surplus and directing disposition. REVIEWED LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Declaring Certain Personal Property Surplus and Directing Disposition. * RESOLUTION NO. 2008-035 WHEREAS, certain personal property described as Used Election Supplies (30 metal ballot boxes. 65 supply bags, 455 portable voter booths and pencils) owned by Deschutes County are no longer needed by Deschutes County; and WHEREAS, the Board of County Commissioners (the "Board") finds it to be in the public interest to sell or donate the personal property described herein to another government organization that serves voters in another county or state, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. The personal property described as Used Election Supplies (30 metal ballot boxes, 65 si.pply bags, 455 portable voter booths and pencils) are hereby declared to be surplus property of Deschutes County. Section 2. The Deschutes County Clerk will sell or donate the supplies to another government organization. Section 3. The County Clerk is authorized to sign documents to transfer ownership. Section 4. This resolution shall take effect immediately upon its adoption and signing by the Board of County Commissioners. DATED this day of , 2008.
