Consideration of signature of Resolution No. 2008 - 034 initiating proceedings for the Beaver Special
Road District LID
PUBLIC HEARING ON THIS DATE? NO.
BACKGROUND AND POLICY IMPLICATIONS:
The members of the Beaver Special Road District approached the Road Department about the
possibility of using the LID process to finance the improvements to pave Foster Road which is a gravel
road located within the boundaries of the Special Road District. The Road Department discussed the
possibility of using the LID process with County Legal Counsel and they felt that it was a viable option
for the Road District and could be used even though the Board had issued a moratorium on LID's. The
difference with this LID is that the Road District will continue to maintain Foster Road after it is paved
and they will be responsible for all costs associated with the LID in that there wil not be a "not to
exceed" cost associated with this project.
FISCAL IMPLICATIONS:
Properties within the Beaver Special Road District LID will be assessed for 100% of the costs
associated with the LID (includes administration, design, construction, and financing costs).
RECOMMENDATION & ACTION REQUESTED:
The Road Department recommends signature of Resolution No. 2008 - 034

BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Initiating Proceedings for the
Beaver Special Road District L.I.D. to
Improve a Certain Dedicated Road Known as
a portion of Foster Road, Deschutes County,
Oregon, Describing the Road to be Improved;
Designating Where the Improvements Shall
be Made; Defining the Nature of the
Improvements; and Referring this Resolution
to the Engineer for Completion of a
Feasibility Study.
RESOLUTION NO. 2008-034
WHEREAS, the owners of property accessing the proposed improvement of that portion of Foster
Road from Beaver Drive to South Century Drive in Deschutes County, Oregon, have requested the Board
of County Commissioners to improve this road(s); and
WHEREAS, it appears that such road(s) should be improved; and
WHEREAS, it appears that it is in the public interest that the Road Department of Deschutes
County, Oregon, perform the required feasibility study for this improvement; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, as follows:
Section 1. That proceedings be initiated to improve a portion of Foster Road from Beaver Drive to
South Century Drive to Deschutes County Rural Local Road Standards for the benefit of the area
described in Exhibit "A", attached hereto and by this reference incorporated herein.
Section 2. That the dedicated road to be improved within the district described in Section 1 of this
Resolution is that portion of Foster Road from Beaver Drive to South Century Drive, shown on the map
Exhibit "B", attached hereto and by this reference incorporated herein.
Section 3. The road(s) to be improved as a result of this Resolution shall be improved to County
Rural Local Road Standards.

Section 4. Improvements to be made to the roadway within the district include, but are not limited
to, reconstruction of the roadway to a 24 foot wide paved road with 2 foot aggregate shoulders, and
adequate drainage, as well as related engineering, administration, mobilization and traffic control work.
Section 5. This Resolution shall hereby be referred to the Engineer for completion of a feasibility
study in accordance with Chapter 12.48.150 of the Deschutes County Code. The Engineer may engage
the services of any qualified engineer for all or part of the investigation required under Chapter 12.48.150
of the Deschutes County Code.

Benefited Lots
The benefited lots for the Beaver Local Improvement District are described as
follows:
All of the tracts of land lying within the following portions of Section 25 and
Section 35 of Township 20 South, Range 10 East, Willamette Meridian,
Deschutes County, Oregon:
1. The Southeast 1/4 (SE %) of said Section 25
2. The Southeast 1/4 of the Southwest 1/4 (SE 1/4 SW 1/4) of said Section 25
3. The Southwest 1/4 of the Southwest 1/4 (SW 1/4 SW 1/4) of said Section 25
4. The Northeast 1/4 of the Southwest 1/4 (NE 1/4 SW 1/4) of said Section 25
5. All of those portions of the Northeast % (NE 1/4 ), the Southeast 1/4 of the
Northwest 1/4 (SE 1/4 NW' ) and the Northeast 1/4 of the Northwest 1/4
(NE 1/4 NW 1/4) of said section 25 lying southerly of the South Century
Drive realignment as shown on that survey titled "South Century Drive
Realignment" and filed in the Deschutes County Surveyor's Office as
CS04456 on 5-6-1982.
6. All of that portion of the Northwest 1/4 (NW %) of said section 35 lying
easterly of the Deschutes River.
7. The Northwest 1/4 of the Northeast 1/4 (NW 1/4 NE 1/4) of Said Section 35
8. The Southwest 1/4 of the Northeast 1/4 (SW '/4 NE '/4) of Said Section 35
9. The East 1/2 of the Northeast 1/4 of the of the Northeast' (E 1/2 NE 1/4
NE 1/4) of said Section 35.
