DATE: April 1, 2008 FROM: Rebecca Brown Sheriffs Office Civil Division 388-6640 TITLE OF AGENDA ITEM: Consideration of Board Signature of Order No. 2008-029; An Order Declaring Certain Deschutes County Personal Property Surplus and Authorizing Sale. PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: In the past, the DC Sheriffs Office has held their own public auctions to sell off surplus property. DC Code 2.37.110 sets out the methods the county can use to dispose of surplus property which include: the use of public auctions. Holding our own auctions had a large fiscal impact on the Sheriffs Office when taking into consideration the fees for auctioneers and the overtime paid for employees. Current technology now allows us to utilize online auction websites which in this case is; publicsurplus.com. This allows the SO to quickly auction off surplus property that would otherwise devalue and be exposed to the elements as it sits around. Notice of the online auction shall be posted in the local newspaper. FISCAL IMPLICATIONS: The Sheriffs Office is charged a 7% surcharge by the website at the time of sale, but this is then passed on to the purchaser. RECOMMENDATION & ACTION REQUESTED: Approve and Signature of Order No. 2008-029 ATTENDANCE: Rebecca Brown, SO Civil DISTRIBUTION OF DOCUMENTS: Rebecca Brown, Sue Brewster; SO REVIEWED LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Declaring Certain Deschutes County Personal Property Surplus and Authorizing Sale. * * ORDER NO. 2008-029 WHEREAS, certain personal property described in Exhibit A, attached hereto by this reference incorporated herein, is no longer needed for public use by the County; and WHEREAS, it is necessary to dispose of this surplus personal property; and WHEREAS, it is appropriate to dispose of such property by auction; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. The Deschutes County Sheriff, or his designee, is hereby authorized and directed to dispose of the personal property described in Exhibit A to this order at public auction. Section 2. The Chair is authorized on behalf of the County to execute any and all documents necessary to complete the transfer of any personal property authorized to be auctioned in accordance with this order.
