TITLE OF AGENDA ITEM:
First Reading of Ordinance No. 2008-016, An Ordinance Declaring that Blighted Areas Exist in
Deschutes County, Oregon, Establishing the Need for an Urban Renewal Agency in the County and
Electing a Method for Exercise of the Powers of an Urban Renewal Agency Within the County.

BACKGROUND AND POLICY IMPLICATIONS:
The County, in December 2007, received a request from the City of Bend for the County to create an
urban renewal district that encompassed the Bend Airport, which, though it is owned by the city, is
entirely in the County's jurisdiction. In order to create an urban renewal district, the County must first
establish and activate an urban renewal agency, as provided for in ORS 457. Ordinance 2008-016
establishes the urban renewal agency and creates an urban renewal board consisting of the three
Deschutes County Commissioners.
An urban renewal district works by freezing the assessed valuation within the district's boundaries at a
fixed point in time. As growth and development within the district occur, the taxes paid on the
increased valuation generated by that growth go to the urban renewal agency, rather than the taxing
districts within the boundaries of the urban renewal district. The revenue -- known as the "tax
increment" -- is typically used to pay debt service on bonds that have been issued for infrastructure and
other public improvements within the district. The improvements have the effect of facilitating growth
and development, These projects, along with the district's maximum indebtedness and a finite
timeframe within which the agency may collect tax increment revenues, are contained in an urban
renewal plan that must be adopted by the agency. The city has hired a consultant who is currently
developing that plan. That plan will come before the urban renewal agency board by the end of .lune.
By establishing and activating an urban renewal agency, the County is not approving the urban renewal
plan or the creation of an urban renewal district.
It should be further noted that the word "blighted area," as used in ORS 457 has many different
definitions, and not just the common definition of a run-down, deteriorated area such as a slum or an
abandoned industrial area. Under ORS 457, virtually any area in which there are "inadequate streets
and other rights of way, open spaces and utilities" can be designated as a "blighted area."
FISCAL IMPLICATIONS:
There are no fiscal implications in establishing and activating an urban renewal agency. Fiscal
implications come into play when adopting the urban renewal plan, which requires a separate aztion.

Approve Ordinance No. 2008-016 on first reading.

An Ordinance Declaring that Blighted Areas Exist in
Deschutes County, Oregon, Establishing the Need for
an Urban Renewal Agency in the County and
Electing a Method for Exercise of the Powers of an
Urban Renewal Agency Within the County
ORDINANCE NO. 2008-016
WHEREAS, pursuant to ORS 457.035(1), there exists in Deschutes County, Oregon, a public
body corporate and politic to be known as the urban renewal agency of the County; and
WHEREAS, ORS 457.035 authorizes the County to activate the powers of its urban renewal
agency by adoption of a non -emergency ordinance declaring that blighted areas exist and that there is a
need for an urban renewal agency to function in the County and electing one of three ways to exercise the
powers of an urban renewal agency in the County; and
WHEREAS, blighted areas in the County impair economic values and negatively impact the
health, safety and welfare of its citizens; and
WHEREAS, some portions of these blighted areas may require acquisition and clearance, but
other portions of the blighted areas may be susceptible to conservation and rehabilitation and
development of adequate access, utilities and other appropriate actions to eliminate the conditions of
blight; and
WHEREAS, these acquisition, conservation, rehabilitation, development and redevelopment
activities and the prevention and reduction of blight are public purposes for which public money may be
spent and private property acquired pursuant to state law using the powers of an urban renewal agency.
NOW THEREFORE, THE BOARD OF COMMISSIONERS OF DESCHUTES COUNTY
HEREBY ORDAINS:
Section 1: The Board of County Commissioners declares that blighted areas, as defined by ORS
457.010(1), exist within the County and that there is need for an urban renewal agency to function within
the County.
Section 2: The Board of County Commissioners further declares that, pursuant to ORS
457.045(3), all of the rights, powers, duties, privileges and immunities granted to and vested in an urban
renewal agency shall be exercised by and vested in an Urban Renewal Agency Board consisting of the
Board of County Commissioners.

Section 3: The Urban Renewal Agency Board may appoint a managing board to oversee the
implementation of each urban renewal plan approved by the Board of County Commissioners. The
managing board shall work with staff to ensure that projects undertaken under the urban renewal plan are
on time, on budget and consistent with the stated outcomes of the urban renewal plan. The managing
board shall also review and recommend to the budget committee of the urban renewal agency an annual
budget to implement the urban renewal plan, as well as any amendments to the urban renewal plan.
Section 4: The corporate name of the urban renewal agency activated by this ordinance shall be,
and the agency shall be known as, the Urban Renewal Agency of Deschutes County.
