TITLE OF AGENDA ITEM:
Consideration and Signature by County Administrator of Document 2008-216, a Right -of -Entry for the
U.S. Army Corps of Engineers to conduct a site inspection on county -owned land.

BACKGROUND AND POLICY IMPLICATIONS:
The U.S. Army Corps of Engineers ("COE") is conducting a site inspection at the former Redmond
Army Airfield, a formerly used defense site. The site has been identified as having used, stored,
produced and/or tested military munitions. According to Army records, this tract, owned by Deschutes
County, is on the former range. This tract is east of the Fair & Expo Center and is approximately 170
acres in size.
The COE requests permission to enter the property to determine if military munitions are present.
Activities will incude making a visual inspection, surveying with a metal detector and collecting soil
and/or water samples.
After the surveys, the COE will inform Deschutes County of its findings and will remove, at its sole
cost, any munitions found.

The undersigned, hereby grant[s] to the Department of the Army, its employees,
contractors, and subcontractors a right -of -entry on the property located in the State of
Oregon, County of Deschutes, and described as:
Parcel: 1513000000113
This right -of -entry is granted upon the following terms and conditions:
1. This right -of -entry may be exercised only for the purposes of making a visual
inspection of the property described above and surveying it with a metal detector or
other instrument for evidence of the presence of military munitions together with the right
to collect such soil and/or water samples, as may be necessary to permit a
determination of whether military munitions are present on the property.
2. This right -of -entry may be exercised at any time for a period of nine (9)
months which begin on the date this ROE is executed.
3. This right -of -entry does not grant any right to enter into any structure or
building located on the property described above.
4. This right -of -entry may be revoked in writing by the undersigned upon thirty
(30) days prior notice delivered to the Department of the Army at:

5. The Department of the Army will inform Deschutes County of its findings and
