Consideration of corrections to the legal descriptions for Orders adopted pursuant to claims for
compensation under Measure 37 (DCC Chapter 14.10) and signature of Orders.

BACKGROUND AND POLICY IMPLICATIONS:
Orders to be considered are: (1) M37-06-116 (Burnside ); Order No. 2008-041; (2) M37-06-117
(Campbell); Order No. 2008-042.
FISCAL IMPLICATIONS:
None.
RECOMMENDATION & ACTION REQUESTED:
Adopt amended Orders as submitted.

ORDER NO. 2008-042
WHEREAS, On February 26, 2007, the Board of County Commissioners approved Order
No. 20007-048, entitled: "An Order Approving a Waiver of Land Use Regulations to Authorize
Estate of Beverly Campbell to Use the Subject Property as Allowed When he Acquired the
Property" ; and
WHEREAS, the legal description, which was attached to and made a part of
Order No. 2007-048, was an incorrect legal description; NOW THEREFORE,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, HEREBY ORDERS AS FOLLOWS:
Section 1: Order No. 2007-048 is amended by inserting a new legal description in
place of the legal description attached to Order No. 2007-048, which legal description is
marked Exhibit B, attached hereto and incorporated by reference.
Section 2: Except as provided in Section 1, Order No. 2007-048 shall, in all other
respects, be unchanged.
Section 3: Nothing contained herein shall be construed as granting or denying
any privilege or right that was not contained in Order No. 2007-048.

Section 4: This Order, together with Order No. 2007-048, except for the incorrect
legal description from the earlier Order, shall be recorded in the Deschutes County Deed
Records.
