TITLE OF AGENDA ITEM:
Consideration and Signature by County Administrator of Document 2008-231, a Right -of -Entry for the
Oregon Department of Transportation to conduct site inspections on county -owned land in La Pine.
PUBLIC HEARING ON THIS DATE? No
BACKGROUND AND POLICY IMPLICATIONS:
The Oregon Department of Transportation (ODOT) is conducting surveys to determine potential impact
of the proposed alignment for their Wickiup Junction project, as required by the National
Environmental Protection Act (NEPA). ODOT completed the first phase of surveys last year.
ODOT requests permission to enter various county -owned parcels to do the second phase of field work.
The work involves environmental specialists conducting surveys for sensitive plant species and
wetlands as well as conducting a noise monitoring survey.
No ground disturbing activities will occur in this phase.
FISCAL IMPLICATIONS:
None.
RECOMMENDATION & ACTION REQUESTED:
Staff recommends signature by the County Administrator.

RIGHT OF ENTRY
Deschutes County, hereinafter referred to as "Grantor", does hereby grant to the State
of Oregon, by and through the Oregon Department of Transportation, its employees,
agents, or contractors, the right and license to go upon the real properties described
below for the following purposes:
Biological resources survey: This survey will require one or more environmental
specialists to walk the project area and look for sensitive plant species and wetlands.
No ground disturbing activities will take place. Photographs may be taken.
Noise monitoring survey: the noise monitoring survey involves having one or more
acoustic specialists hold a noise meter while on the property to measure noise. No
ground disturbing activities will take place. Photographs may be taken.
The estimated time frame for the surveys above is mid-May to the end of July 2008
depending upon receipt of Rights of Entries for all properties.

August 1, 2008 unless expressly revoked by Grantor before work is completed. It is;
further understood that the Oregon Department of Transportation shall, to the extent
permitted by Oregon law, be responsible for any damage arising from the activity o the

State, its officers, employees, agents, or contractors on said land and exercise of rights
under this Right of Entry either by repairing such damage or, at the option of the State,
by making an appropriate settlement with the above named in -lieu thereof.
Grantor hereby represents and warrants that he is the owner of said real property or
otherwise has the right to grant this permit for entry.
