DATE: 05/13/08 FROM: Teresa Rozic Property and Facilities 385-1414 TITLE OF AGENDA ITEM: Consideration and Signature by County Administrator of Document 2008-255, a Right -of -Entry for Pacific Crest Affordable Housing, LLC to conduct site inspections on county -owned land in La Pine. PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: Pacific Crest Affordable Housing LLC ("Pacific Crest") wishes to develop an affordable housing project on county -owned land in La Pine. The Board of County Commissioners has conditionally approved Pacific Crest's application for funding to the Oregon Housing and Community Services Department. The OHCS has reserved funds for the project. Pacific Crest must conduct surveys to determine the environmental impact of the project in order to qualify for the state funds. This is a request to conduct plant surveys in the current season. No ground disturbing activities will occur in this phase. FISCAL IMPLICATIONS: None. RECOMMENDATION & ACTION REQUESTED: Staff recommends signature by the County Administrator. ATTENDANCE: Teresa Rozic DISTRIBUTION OF DOCUMENTS: Return original to Teresa Rozic RIGHT OF ENTRY Deschutes County, hereinafter referred to as "Grantor", does hereby grant to Pacific Crest Affordable Housing, LLC ("Pacific Crest"), its employees, agents, or contractors, the right and license to go upon the real property described below for the following purposes: Biological resources survey: This survey will require one or more environmental specialists to walk the project area and look for sensitive plant species and wetlands. No ground disturbing activities will take place. Photographs may be taken. The estimated time frame for the surveys above is mid-May to the end of July 2008. Property Description: A portion of Parcel 2, Partition Plat 2004-47, also known as Tract 2 of the La Pine Neighborhood Planning Area Neighborhood 1 — SW Quadrant, comprising 5.23 acres as shown on the attached Exhibit "A". IT IS UNDERSTOOD AND AGREED that this right and license shall continue until August 1, 2008 unless expressly revoked by Grantor before work is completed. It is further understood that Pacific Crest shall, to the extent permitted by Oregon law, be responsible for any damage arising from the activity of Pacific Crest, its officers, employees, agents, or contractors on said land and exercise of rights under this Right of Entry either by repairing such damage or, at the option of Pacific Crest, by making an appropriate settlement with the above named in -lieu thereof. Grantor hereby represents and warrants that he is the owner of said real property or otherwise has the right to grant this permit for entry. Dated this day of , 2008.
