BACKGROUND AND POLICY IMPLICATIONS:
The Road Department received petitions and the appropriate fee to form the Beaver Special Road
District LID. A feasibility study was completed and mail poll ballots were mailed to the property
owners within the proposed LID boundary. The Road Department received a return of over 60% mail
ballots in favor of the project. This Order before the Board declares the County's intent to create the
Beaver Special Road District LID, accepts the Engineer's feasibility report and sets the public hearing
for remonstrance on July 2, 2008
FISCAL IMPLICATIONS:
Properties within the Beaver Special Road District LID will be assessed for 100% of the costs
associated with the LID (includes administration, design, construction, and financing costs). Upon
completion of the project, the Road District will be responsible for maintenance on this portion of
Foster Road.

BEAVER SPECIAL ROAD DISTRICT LOCAL IMPROVEMENT
DISTRICT
BACKGROUND
On April 2, 2008 the Board of County Commissioners (BOCC) referred the Beaver Special Road District
Local Improvement District (LID) to the Road Department to complete an Engineer's Report (see
attached) and to conduct a Mail Poll of the property owners.
DISCUSSION
The Engineer's report found the Beaver Special Road District LID project to be feasible and estimated the
cost of paving 11,150 feet of roadway to be $1,030,102. The property owners will be responsible to pay
for the cost to construct subgrade, base, and asphalt cement pavement. The portion of Foster Road to be
paved is not an established County maintained road but is maintained by the Beaver Special Road
District; therefore the Engineer's Report found that the costs associated with this project should be paid
' by the property owners within the road district. The Road District will be responsible for all engineering
and construction costs and will maintain the road upon completion of the project.
There are 91 lots and 97 assessments within the boundaries of the LID. The estimated cost of each
assessment is $10,619.60. There is no guaranteed "not to exceed" cost on this LID.
Deschutes County Code No. 12.48.166 requires that 60% if the owners must vote yes for the LID to be
eligible for further consideration by the Board.

RECOMMENDATION
The Road Department recommends that the Board approve the Order to set a public hearing and directing

ORDER NO. 2008-043
WHEREAS, the Board of County Commissioners, By Resolution 2008-034 initiated the improvement
of certain dedicated public road known as Beaver Special Road District L.I.D.; and
WHEREAS, the County Engineer has investigated the feasibility of making the improvements,
estimated the cost of the improvements, proposed a method of assessment and estimated the amount of the
assessments against each of the specially benefited properties, in accordance with 12.48.150 of the Deschutes
County Code; and
WHEREAS, the Board has considered the Engineer's report and has determined to proceed with the
proposed improvements, subject to the notice and hearing requirements of Chapter 12.48 of the Deschutes
County Code; and
WHEREAS, the Engineer conducted a mail poll of all the owners of all specially benefited lots within
the L.I.D. in accordance with Section 12.48.166 of the Deschutes County Code. The poll approval rate is 60%
of the owners of land representing over 60% of the total amount of the estimated assessment for the proposed
local improvement; and
WHEREAS, Section 12.48.170 of the Deschutes County Code requires that the Board provide notice to
specially benefited property owners and set a hearing for the purpose of hearing remonstrances to said
improvements; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY
ORDERS as follows:
Section 1. That the Engineer's report relating to the improvement of a certain dedicated public road
known as a portion of Foster Road Deschutes County, Oregon, marked Exhibit "A", attached hereto and by this
reference incorporated herein, be accepted and hereby approved.
Section 2. That a hearing be set on July 2, 2008, at 10:00 a.m. at the Deschutes County Services
Building, Board of Commissioner's Hearing Room 1300 NW Wall Street, Bend, Oregon for the purpose of
hearing remonstrances to said improvements.

Section 3. That, subject to the hearing process set forth by Chapter 12.48 of the Deschutes County
Code, the LID be formed and the improvements carried out as described in said Engineer's Report.

said hearing and proposed improvement, in a form substantially as contained in Exhibit "B", attached hereto and
by this reference incorporated herein.

SUBJ: Feasibility study for the Beaver Special Road District L.I.D.
This report is made pursuant to Section 12.48.150 of the Deschutes County Code concerning the
engineering investigation by the Deschutes County Road Department for proposed local road
improvement.
Deschutes County received a petition from certain property owners to improve a road known as
that portion of Foster Road from Beaver Drive to South Century Drive. Due to this petition, the
Deschutes County Board of County Commissioners initiated a Local Improvement District (LID)
by Resolution No. 2008-034 signed on April 2, 2008.
The Resolution was referred to the Deschutes County Road Department for the completion of a
feasibility study for the proposed local improvement in accordance with Deschutes County Code
12.48.150. This report constitutes the engineer's findings.
GENERAL DESCRIPTION OF THE ROAD AND SURROUNDING AREA
The area in which the road improvements are sought constitutes a rural area located
approximately 3.25 miles south of Sunriver, Oregon. Foster Road is classified as a rural
collector road and is a gravel road that is located between La Pine State Recreation Road and
South Century Drive. The portion of Foster Road in the LID is located between Beaver Drive
and South Century Drive and is within the boundaries of the Beaver Special Road District in
Township 20 South; Range 10 East. The Forest Service granted a right-of-way for this portion
of Foster Road which in recorded in Vol. 2003 Pg. 31011. This road is currently maintained by
the Road District and will continue to be maintained by them after the improvements are
completed.
Foster Road within the proposed LID is currently an unpaved gravel road that is maintained by
the Road District. Foster Road was not constructed to current County standards and since it is an
unpaved road it is prone to washboards, rutting and dust between the times it is graded. The

Road District wants to pave Foster Road to reduce the overall maintenance costs therefore
allowing them to use the monies saved on the local roads within the subdivision.
OPTIMAL LOCATION AND EXTENT OF THE IMPROVEMENT
Foster Road is classified as a rural collector road by the Deschutes County Transportation Plan.
Since the purpose of the LID is to improve this road to carry local traffic only, the design and
construction of the road will be to the rural local standards.
Since this segment of Foster Road between Beaver Drive and South Century Drive is a part of
the Beaver Special Road District and they are responsible for the maintenance of this roadway,
this is an optimal location and extent for the project. The proposed improved road will allow the
Road District to continue maintenance of Foster Road but at a cost less than that required for a
gravel surface thereby freeing up monies to use on the other local roads within the District.
BOUNDARIES OF THE LOCAL IMPROVEMENT DISTRICT
DCC 12.48.130 requires that properties to be assessed be included within the boundaries of a
designated LID. Properties to be included in a LID are properties that are benefited by the
proposed local improvement. A map showing the road and LID boundary proposed for
improvement is attached as Exhibit 1 of this report.
Properties abutting or that have access from the road improvement are presumed to benefit from
such construction. Accordingly, except as noted herein, the boundaries of the LID have been
drawn to include those properties abutting or have their access from the improved road. The
Local Improvement District boundaries are the same as the Special Road District Boundaries and
also include tax lot 2010000001900 owned by Oregon Water Wonderland Unit II Sanitary
District (OWW). This lot is included in the LID boundary per Road Maintenance Agreement
2004-29727 in which OWW agreed to participate in the process should the road be paved
through the Local Improvement District process. It also includes tax lot 2010000001901,
formerly owned by the Forest Service but now owned by William Sullivan. This lot will benefit
from the improvement to Foster Road and therefore is included in the boundary. All of the lots
in the Beaver Special Road District will be benefited by the reduced cost of maintenance to
Foster Road once the improvements have been made and OWW has direct access to Foster Road
for it's sanitary facilities so it too is benefitted by the improvement.
A map of the Local Improvement District is attached hereto as Exhibit 1.
DESCRIPTION OF THE CONSTRUCTION DESIGN
Foster Road will be constructed to the standards for local streets as found in the County Code
under DCC 17.48.010. Those standards require a pavement width of at least 24 feet, a base
depth of 6 inches of crushed aggregate and a surface of 0-9 oil -mat or 2" of Asphalt Concrete
(AC). The road must be designed to the safety and design standards of the American Association
of State Highway and Transportation Officials (AASHTO). These standards as adapted to rural
local streets reflect the designation and function of the improvement as a local street. This
engineer's report has been drafted anticipating that the work to be done will meet the rural local
road construction standards:

Mobilization — normal mobilization costs incurred in preparation of the work.
Construction Surveying — setting slope stakes, subgrade stakes, and base stakes for the
contractor to construct the road.
Traffic Control — signs and flaggers will be provided to warn, safeguard, guide, and
inform the public and workers.
Subgrade — earthwork will be required to construct subgrade within the roadway cross
section. There will be some construction required to provide proper drainage.
Base — placing, shaping, compacting, and fine grading of base rock will be required. A
six inch depth of aggregate base will be utilized for the roadway and a four inch depth of
aggregate base for the driveway approaches.
Paving — the roadway will be a 2" asphaltic concrete surface or an 0-9 oil mat surface.
The paved width for Foster Road will be 24 feet.
Miscellaneous — resetting mailboxes, moving utilities, and drainage work may be
involved.
Engineering and Administration — the expenses incurred by the County in the preparation
of plans and specifications, inspection, surveying, accounting, payment collection, and
interim financing costs.
From the staff's review of the proposal and the site, it does not appear that there is anything that
would make the proposal unfeasible from a technical standpoint. The easement for Foster Road
was granted by the Forest Service to Deschutes County on April 7, 2003 and measures 60 feet in
width. The road to be improved is already laid out and in use. The terrain is generally flat in
nature and minor excavation or embankment will be required.
CONSISTENCY WITH LAND USE REGUATIONS
There are two considerations to be looked at in assessing whether the proposed improvements
are consistent with zoning requirements. First, whether the class of the road improvement is one
that would require land use approval and second, whether the requirements of the applicable
zones would require land use approval.
Since this modernization does not include adding a lane, the proposed improvements would be
considered to be a Class III road or street project. Class III road and street projects are those
involving modernization, traffic safety improvements, maintenance, repair, or preservation of a
road or street. See DCC 17.08.030, definition for "Road and street project". Improvements falling
within this classification do not, as a general rule, require a land use permit.
The proposed improvement project is located within a Rural Residential Zone (RR -10). Class III
road improvement projects in RR -10 zones are outright permitted uses. See DCC 18.60.020 (F).

The proposed project is consistent with RR -10 zoning and may proceed without obtaining
permits.
DETERMINATION OF ESTIMATED ACTUAL COST
Under DCC Chapter 12.48; assessments for local improvements may include, in the costs to be
assessed to benefiting properties, the "actual cost of the local improvement project". Actual costs
include all direct and indirect costs incurred by the County to undertake a capital construction
project such as that proposed by Resolution No. 2008-034. "Actual costs" include but are not
limited to; the cost of labor, materials, supplies, equipment rental, property acquisition, permits,
engineering, financing, legal, administration, depreciation, amortization, reserve for
delinquencies, or defaults and debt service. Administrative expenses may include those incurred
in preparation for formation of a local improvement district, such as meeting with property
owners, preparing and processing the feasibility report, and providing notice and conducting
hearings.
Since this is not an existing County maintained road and the County has no plans to pave Foster
Road, the members of the Beaver Drive Special Road District will be responsible for the cost of
engineering and administration and to construct subgrade, base, and asphaltic concrete pavement.
The engineer has determined the construction cost for the roadway at $1,030,102.00. Therefore,
the property owners' cost for the proposed local improvement is estimated to be $10,619.60 per
assessment. The construction cost estimate is based on 2006-2007 project costs for similar types
of construction. A contingency has been added to the construction cost estimate to cover the
unexpected cost overruns due to unforeseen construction complications and to reflect the
possibility of higher construction costs due to the increase in the costs of materials and labor.
Because the County will not be taking this road into it's maintenance system after completion of
construction, the residents will be responsible for the actual cost of the project and the "not -to -
exceed" cost associated with the normal LID process will not apply to this LID.
A detailed schedule of the cost estimate is attached as Exhibit 2.
PROPOSED METHOD OF ASSESSMENT
The recommended method of assessment, to arrive at a fair apportionment of the actual cost of
the local improvement to the properties specially benefited, is to divide the total cost of the
project by the number of benefited lots. This per lot apportionment method is recommended due
to differing lot sizes, shapes, frontage lengths, the presence of corner lots and it takes into
account densities prescribed by zoning in the area. The differences amongst the lots make for
difficulties in apportionment of an alternative method based on frontage or acres. However, if the
properties can be legally divided without going through the land use process the property is
assessed for having the status of being as many lots that it can be divided into.
The boundaries of the LID have been drawn to include only properties that are in the Beaver
Special Road District and also the property owned by OWW and the Forest Service property
now owned by William Sullivan. The property owned by OWW will be assessed for four
assessments per the Road Maintenance Agreement 2004-29727. The property for William
Sullivan will also be assessed for four assessments since it is a 40 acres parcel which can be
divided into four separate parcels. All included properties are zoned RR -10. Given the existing

zoning, the size of the subject parcels, and the nature of existing development in the area, it is
reasonable to assume that future development on the vacant lots in the proposed LID will be for
residential uses.
SPECIAL BENEFITS TO ASSESSED PROPERTIES
By paving Foster Road, the following benefits will be realized by the residents assessed for this
improvement:
• After the improvements are finished, all properties proposed to be assessed will have the
main access to the subdivision and sewer treatment plant by way of a paved improved road
designed and constructed to County standards. County standards reflect the safety and
design criteria of the Association of State Highway and Transportation Officials
(AASHTO).
• A paved access road will reduce wear and tear on vehicles and generally make access to
the properties more convenient.
• Response time for emergency service vehicles, such as fire trucks and ambulances will be
enhanced as they will not be required to slow down to negotiate bad stretches of road.
• Reduced dust raised by vehicles traveling past residences on aggregate roads.
• Direct access from paved, improved roads will enhance the property values on a real
market value standard.
• Resources that were directed to maintain Foster Road can now be redirected to other roads
in the Road District.
For all these reasons, the properties to be assessed are specially benefited from the proposed
improvements
DESCRIPTION AND ASSESSED VALUE
The names of the property owners of record, a property description, assessed value of each lot or
parcel to be specially benefited by the local improvements and included within the LID
boundary, and the estimated cost of the improvement are attached as a benefited property list for
this LID.
A benefited properties list is attached as Exhibit 3 of this report.
ESTIMATED ASSESSMENT AGAINST EACH LOT
The estimated assessment against each lot or parcel to be included in the LID is:

This is the estimated assessment against each lot according to the preliminary estimate. The
residents of this LID will be responsible for the actual cost of the project as there is no "not -to -
exceed" cost associated with this LID.
FINANCIAL CONSIDERATIONS
DCC 12.48.150(B) addresses minimum requirements for the financial feasibility of the proposed
project. A financial feasibility study from the County Finance Director was performed to
evaluate the financial feasibility of the project.
A Financial Analysis by the County Finance Director is attached as Exhibit 4 of this report.

Financial Analysis
1. Assessment to Value Ratios
The ratio of assessed property value to the estimated LID assessment is one means of
determining the financial risk. The ratios and lot percentages in the LID are as follows:

The following information was compiled by the Deschutes County Road Department:
Approximately 11,150 feet of road is to be improved on Foster Road and ninety one lots
are to benefit from these road improvements. Engineers cost estimate is $1,030,102 with
an estimated per lot assessment of $10,619.60, two of the lots are going to be assessed
four assessments, for a total of ninety seven assessments on this project. This is currently
an unpaved, graveled road that is maintained by the Beaver Special Road District. The
property owners will be responsible all costs and will continue maintenance of the road
after completion, as there will not be a "not to exceed cost" on this LID.
There is one property owner who owns five lots and four property owners who own three
lots each within the boundaries of the LID.
The Assessor's records show 40 of the 91 lots developed; therefore DCC 12.48.330
"MINIMUM REQUIREMENTS FOR LOCAL IMPROVEMENTS INVOLVING
UNDEVELOPED LAND" does not apply. With the exception of four of the lots, the
remaining properties exceed the 2:1 value test in A.1.
II. Risk Related Undeveloped Land
Approximately 56% (51 lots) of the property within this area are undeveloped. Of the
undeveloped properties, four have value to assessment ratios less than 2:1, however; two
of these properties had recent changes which should increase their values. Forty six of
these lots have value to assessment ratios equal or greater than 10:1.
III. Interim Financing
Outside interim financing for this project may be required. If outside financing is
required, bonding for these assessments will be required on behalf of property owners.
IV. Long-term Financing
Ballot Measure 50 has not affected our ability to issue limited tax improvement bonds for
a project such as this one, according to our financial advisor for recent bond issues.
