BACKGROUND AND POLICY IMPLICATIONS:
The Deschutes County Board of County Commissioners ("Board") held a duly noticed public hearing
on August 6 to consider approval of Order 2008-076. That order is the final approval of the district
formation that specifies the services to be provied, the permanent tax rate, and the district's legal
description and maps. That order also sets which election the voters will vote on the formation and
permanent tax rate for the proposed district and approves the Notice of District Measure and
Explanatory Statement. The hearing was continued three consecutive weeks with this final hearing on
August 25, 2008 in order that the City may meet with the residents of Deschutes River Woods to clarify
with those residents as to the purpose for including that are in the district's boundaries and to correct the
legal description and maps that will be required or the Board to approve and send to the appropriate
county and state agencies. August 25, 2008 is the last hearing date available for the Board to approve
the formation and staff to have enough time to provide the documents to the County Clerk for placing
on the ballot for the November 4, 2008 ballot.
In Order 2008-073, the Board already approved the formation of the district with essentially the
proposed boundaries that were requested by the City of Bend in the City's resolution 2960. Since then,
however, the City realized that the legal description and the corresponding map approved by the City
Council was not correct and included territory the City did not intend to include in this district's
boundary.
FISCAL IMPLICATIONS:
Fiscal implications have been provided in previous agenda requests.

WHEREAS, pursuant to ORS 267.520(1), the Board of County Commissioners of Deschutes
County, Oregon (Board") approved the formation of the Bend Area Transportation District ("Distrir;t")
on July 21, 2008 in Order No. 2008-073, incorporated by reference herein; and,
WHEREAS, the Board finds that a permanent tax rate limit of $.393 per $1000 assessed value
is sufficient to assure adequate revenue to operate the District; and,
WHEREAS, the governing body of the district shall consist of seven members elected at large
for four year terms; and,
WHEREAS, if the District formation and permanent rate limit is approved, the election of the
District Board Members shall be at the election held on the third Tuesday of May, 2009; and,
WHEREAS, ORS 198.810 (3)(a) requires an election be held on the question of forming the
District and setting a permanent rate limit and the November 4, 2008, general election is the first
available election; and,
WHEREAS, a Notice of District Measure Election and Explanatory Statement for the County
Voters' Pamphlet must be sent to the Deschutes County Clerk no later than August 26, 2008 but
providing these documents to the County Clerk earlier aids the Clerk in completing all voter's
pamphlet materials in accordance with the state regulations; and,
WHEREAS, ORS 198.815 (1) requires the Board to cause notice of the election to be published
by two insertions in a publication of general circulation in the proposed District; now, therefore.
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. The Bend Area Transportation District is hereby declared to be formed subject to
the approval of the electors in the proposed district in the November 4, 2008 general election.
Section 2. The name of the district shall be the Bend Area Transportation District and the
boundaries shall be as legally described in Exhibit "A" and depicted on the map Exhibit "B," both
exhibits being attached hereto and by this reference incorporated herein.

Section 3. That the proposed Bend Area Transportation District, if formed, will have a permanent
rate limit for operating taxes of $.393 per $1,000 assessed value that will raise an estimated $2,800,000
in operating funds for the District in the 2009-2010 fiscal year.
Section 4. That the Bend Area Transportation District shall be authorized to take all necessary
and proper steps to plan, establish, furnish and maintain a system for the transportation of passengers
within the Bend area and to construct, maintain and operate any related facilities pursuant to ORS
267.510 et seq.
Section 5. The Bend Area Transportation District governing body shall be elected at an
election held the second Tuesday of March, 2009.
Section 6. In accordance with ORS 198.810 (3)(a), the issue of forming the Bend Area
Transportation District and authorizing the permanent rate limit for operating taxes shall be referred to
the qualified electors of Deschutes County at the November 4, 2008 general election for approval or
rejection.
Section 7. The Deschutes County Clerk is hereby directed to place this matter on the November
4, 2008, general election ballot.
Section 8. The Board Chair is authorized to sign the Notice of District Measure Election and the
Explanatory Statement.
Section 9. No later than August 27, 2008, the Notice of District Measure Election and
Explanatory Statement, in substantially the form set forth in Exhibit "C" and area Map as set forth in
Exhibit "D," attached hereto and by reference incorporated herein, shall be submitted to the
Deschutes County Clerk who shall cause the Map in Exhibit "D" to be included with the ballot for the
election.
Section 10. Published notice of the election shall be given in substantially the form set forth in
Exhibit "D," attached hereto and by this reference incorporated herein. The recording secretary shall
cause the notice to be published in The Bulletin on October 7, 2008 and October 21, 2008.

EXPLANATORY STATEMENT FOR COUNTY VOTERS' PAMPHLET (2008)
Ballot Title Caption: TO FORM TRANSPORTATION DISTRICT AND ESTABLISH TAX RATE LIMIT

The City of Bend ("City") filed a resolution with the Deschutes County Board of County Commissioners ("Board")
requesting the initiation of the formation of the Bend Area Transportation District ("District"). The purpose of the District
is to plan, establish, furnish and maintain a system for the transportation of passengers within the Bend area and to
construct, maintain and operate any related facilities. As part of the efforts to provide for the transportation of
passengers, the City developed a Capital Improvements Program to be presented to the District governing body that
will maintain and enhance the fixed -route bus system and the current Dial -A -Ride service for eligible seniors and
disabled persons. Formation of the District provides eligibility to obtain federal and state matching funds for these
transportation projects.
If the District is approved by the voters, an election will be held in March, 2009 to elect the governing body of the
District. The governing body shall consist of seven members elected from the District at Targe for four-year terms with
the first members having staggered terms.
If approved, the maximum amount that the District could levy each fiscal year would be $.393 per $1,000 assessed
value. The District, however, need not levy the full amount of the permanent tax rate in any given year. The District
Governing Body will determine the amount to levy each year based upon the fiscal budget approved each year by the
District Budget Committee consisting of the District governing body and seven electors from the District appointed by
the District Governing Body. The District Budget Committee and District meetings will be open to the public. The
estimated first year ad valorem tax levy is $.393 per $1,000 assessed value and is expected to raise 2,800,000 in
operating funds for the District in the first year.

A transportation district would be established, covering the City of Bend and additional territory. The
name of the district would be the Bend Area Transportation District. The purpose of the district would be
to plan, establish, furnish and maintain a system for the transportation of passengers within the Bend area
and to construct, maintain and operate any related facilities pursuant to ORS 267.510 et seq.
If approved, this measure would authorize the district to tax properties within the district for the above
listed services at a maximum permanent tax limit of $.393 per $1,000 assessed value and is estimated to
raise $2,800,000 in operating funds for the District in the first year. The district taxes would be imposed
starting with tax year 2009-2010. If this measure passes, the election of the governing body will be held in
March, 2009.
