MINUTES OF BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, OCTOBER 27, 2008
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Dennis R. Luke, Michael M Daly and Tammy Baney.
Also present were Anthony Raguine, George Read and Kristen Maze, Community
Development; Laurie Craghead, Legal Counsel; six other citizens plus a
representative of the media.
Chair Luke opened the meeting at 10:00 a.m.
1. Before the Board was Citizen Input.
None was offered.
2. Before the Board was Consideration of Approval of Document No. 2008-
526, a Request for a Noise Permit from ODOT for Nighttime Construction
on Highway 97 North of the Bend City Limits.
Kristen Maze gave an overview and explained that this is required to operate
construction equipment after 10 p.m., and authorizing temporary stockpile pits
since vehicles will be visiting the pits during nighttime hours.
Jay Davenport, ODOT said that the stockpile pits are located east of town. The
process is continuous, including grinding, removal and repaving. Jack
hammering is included as well since there are some ADA ramps that may need
to be removed and rebuilt, although most of this would happen within the city
limits. The work will begin late spring.
Commissioner Luke opened the public hearing at this time. No testimony was
offered, so the hearing was closed.

3. Before the Board was Consideration of Signature of Document No. 2008-
576, an Amendment to an Improvement Agreement for Overnight
Accommodations at the Tetherow Destination Resort.
Anthony Raguine explained the item. The applicant's burden of proof has
necessitated a change in the type of improvements to be done. The amendment
will revise the number of overnight units as well. They will be unable to
transfer the units to another lot.
Laurie Craghead said that the 198 units are required to maintain the ratio. This
would then provide a bond to include these units. There is more than one
developer involved in development of the resort.
Chair Luke said that he met with attorney Tia Lewis and her client, along with
Legal Counsel, on this issue last week. Commissioners Baney and Daly said
that they also met with them.
Commissioner Luke asked what happens if the market improves and they want
to go back to more elaborate, but fewer units. Tia Lewis said that the bond
would be $8.69 million, which is 110% of the bond. If the market changes,
there will be signed purchase agreements. They will release only what it costs
to improve, so this would have to be proven to the County that there is
sufficient funding available.
Don Bauhofer of Arrowood Development /Tetherow stated that if the market
allows them to do so, they can upgrade the units later.
Commissioner Luke asked why the original bond was at $16 million. If they
decide to go with the bigger units, perhaps the revised bond will not be enough.
Ms. Lewis said the cost of construction was overbid from the beginning. The
lender pulled out of the loan package. Oversight was controlled by the lender,
and the bond was part of a larger package. The lower pricepoint product was
not readily available until now. There were a lot of factors in play when the
original was planned.

Ms. Craghead said that the fit and finish would be a determining factor. At
some point, removing the bond is up to the County's discretion.
Commissioner Luke asked how the units could be built if there is a lower bond
amount. Commissioner Daly stated that he understands these will not be "spec"
units.
Mr. Belbaumer stated that Tetherow is in an ideal location for overnight
accommodations. This is a public access community that will enhance use by
many people. Tetherow has been planned to be a part of Bend and not separate
from the community. The last thing they want to do is not build the units. This
will hold down bond expenses while they get going with a lower priced model.
It is 709 acres total, including the golf course. Much of it has already been
developed. Part of it is located within the City of Bend.
Brett Evert signed up to speak but declined to testify.
Commissioner Baney said she is glad they have asked to adjust their project
instead of not going forward in tough economic times. Although they have
been contacted through e -mails about the amount being bonded, she has
analyzed the numbers and is not concerned about its feasibility.
Commissioner Luke questioned whether the figures for constructing the units
comes from the developer. Tia Lewis said that an independent engineer has
done the cost estimates based on the industry and the units to be built.
Commissioner Daly said that he went through the engineer's study and feels
that the numbers are accurate. Commissioner Luke stated that the Board takes
very seriously the bond amounts and what is being built. They have
demonstrated that the bond is in line with the costs.

579, a Deed of Dedication for a Minor Amount of Right -of -Way for
Burgess Road.
Cynthia Smidt gave a brief overview of the item. There are irregularities where
the road is located and additional right of way is needed for a turn lane. The
applicant is paying $11,600 into a fund for future improvements of the

This letter is a request to add additional locations to the Noise Permit Application SOP082 submitted by
the Oregon Department of Transportation (ODOT) on August 14, 2008 for night time work during the
repaving of Hwy 97 between Bowery Lane to Romaine Village Way (Bend Parkway) scheduled between
March 15, 2009 and October 15 2009. This project will also include the stockpiling of pavement
grindings generated from the project on three ODOT properties during the night time operations. Work at
these sites will include the use of dump trucks and front end loaders equipped with back up alarms.
The properties to be added to the noise permit are as follows:

7. Request: A noise variance to grind out old pavement and repave US 97 between Bowery Lane and the northern
City of Bend limits and south of Bend City Limits to Romaine Village Way. A noise permit from the City of Bend will be
acquired for the work on the Bend Parkway within the city limits of Bend. The work will be conducted between the hours
of 7:00 pm and 6:00 am to minimize traffic delays and decrease the risk of construction related crashes on US 97. The
work will be done when nighttime paving temperatures are sufficient between March 15, 2009 and October 15, 2009.
The work may involve trucks, pavers, grinders, boom trucks, and support trucks. Most trucks are equipped with back
up alarms. In addition, other supportive work such as upgrading ADA ramps, signs and guardrails will be
accomplished. A more detailed description of the project is attached to this permit application.

US97: Bowery Lane to Romaine Village Way

Project Components:
• Grind out and repave 8.4 miles of US 97
between Bowery Lane and Romaine Village
Way. On and off ramps along the Bend
Parkway will be repaved or sealed.
• Install enforcement pads that will allow local
law enforcement to monitor traffic.
• Install durable lane striping and upgrade ADA
ramps and signs in the project area.
Why this project is needed: Rutting on the Bend Parkway (US 97).
US 97 is a critical part of the State's transportation system and carries a high volume of freight
and tourist traffic from the Washington to California borders. It is also an important highway for
local Bend traffic. Keeping roads in good condition and providing for safe travel are critical
parts of the Oregon Department of Transportation's (ODOT) mission.
This Project will grind out and repave 8.4 miles of US 97. This stretch of highway, particularly
the portion that is referred to as the Bend Parkway, is extremely rutted and the pavement is
beginning to come apart. The rutting allows rain, snow and ice to accumulate which causes
dangerous driving conditions. It also allows standing water to seep down into the pavement
further breaking up the road surface. To extend the life of the surface, the local ODOT
maintenance district has patched the ruts with asphalt patch three times in the past 10 years.
The average daily traffic count for the section of US 97 just south of the Empire interchange is
46,000 vehicles per day (as of 2006) which is 15% higher than what the traffic count was
projected to be in 2015. This is the busiest section of state highway in Central and Eastern
Oregon. Only 25% of the traffic on the Parkway is through traffic. A third of the local traffic is
short hops, using the Parkway for an interchange or two.
The pavement was expected to last until 2010-2012 but with the unexpected increase in traffic
and the large number of drivers using studded tires during the winter months, the pavement is
being replaced two to four years earlier.
What is being done:
The Project will grind out up to two inches of the existing pavement and repave with a two inch
asphalt inlay. The grinding will eliminate the rutting before the new asphalt is laid. The
grinding and paving will be done at night to minimize the impact to traffic.
On and off ramps along the Bend Parkway will be paved or sealed.
The running surfaces on the south bound bridges over Greenwood and Franklin Avenues will be
sealed before being resurfaced in order to protect the structures from water seepage.
Three enforcement pads along the Parkway will be constructed. These enforcement pads will
allow law enforcement officers to monitor traffic so they do not impede the flow but with quick
access to travel lanes.
Durable striping will be installed to delineate travel lanes. Once the paving is complete, where
the outside solid white lines (fog lines) and the dashed center lines are located will be ground
out. For the right hand fog line durable, reflective tape will be inserted. This type of striping is
used in heavy traffic areas. The left hand and center lines will be painted.
ADA ramps and signs along the Parkway will be upgraded to meet current standards.
Traffic Control during construction:
• The contractor will perform the cold plane pavement removal and paving work during the
night, between the hours of 8 p.m. and 6 a.m., from Sunday at midnight through Friday
mornings. During these construction times the contractor will close one lane while
controlling traffic in the workzone through the use of traffic control devices including
cones, barrels and variable message signs.
• There will be temporary closures of ramps during grinding and paving operations.
Variable message signs will alert motorists of planned closures.
• No lane closures will be allowed during weekends, from 3 p.m. on Fridays until 12
midnight on Sunday or on holidays.
• The contractor will be allowed to perform other work on the project, such as upgrading
ADA ramps and installing signs, during daylight hours.
