DATE: October 22, 2008 FROM: Cynthia Smidt Community Development Department 317-3150 TITLE OF AGENDA ITEM: Consideration of Signature of Document No. 2008-579, a Deed of Dedication from Syncopation, Incorporated for a minor amount of right-of-way for Burgess Road. PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: Syncopation, Inc. (Terry Mowry, owner) was conditioned through land use file nos. MA -07-15, SP- )7- 20, and LL -07-35 to dedicate to the public 10 feet of road right-of-way along the north property boundary (approximately 254 feet in length) that abuts Burgess Road near the intersection of Day It )ad and Pine Forest Drive (see condition no. E., Findings and Decision). To resolve irregularities at this intersection, right-of-way dedication was needed from the property owner on the south side of Burgess Road. Acceptance of the Deed of Dedication by the Board of County Commissioners finalizes this process. FISCAL IMPLICATIONS: None. The right-of-way was not purchased by Deschutes County. RECOMMENDATION & ACTION REQUESTED: The Planning Division and Road Department recommend Board signature of the Acceptance Deed.
