Legal 388-6623 TITLE OF AGENDA ITEM: Consideration and Approval of Order 2008-093 Declaring the Results of the General Election on November 4, 2008 for the Bend Area Transportation District PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: On June 11, 2008 the Board of County Commissioners approved Order 2008-076 which referred to the voters the issue of formation of the Bend Area Transportation District on the November 4, 2008 ge ieral election ballot, together with the question of a permanent tax rate for said district. On November 4, 2008, a majority of the electors voted NO. Therefore, the Board must canvass the vote and declare the measure as having failed. FISCAL IMPLICATIONS: None. REVIEWED LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Declaring the Results of the General Election Held on November 4, 2008 For the Bend Area Transportation District * ORDER NO. 2008-093 * WHEREAS, an election in Deschutes County, Oregon was held on November 4, 2008 on the measure set forth in Exhibit A concerning the proposed Bend Area Transportation District ("District"); and WHEREAS, an Abstract of Votes, a copy of which is attached as Exhibit B, shows that a majority of those persons voting voted to not approve the measure; and WHEREAS, ORS 198.820(1) requires the Board to canvass the votes and dismiss the Petiti,bn if the Board determines that the majority of the votes cast were in opposition of formation of the District; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1: At the election held in DESCHUTES County, Oregon on November 4, 2008, as evidenced by the abstract of votes, a copy of which is attached as Exhibit B and incorporated by reference herein, 36,572 electors cast ballots on the issue of formation of the District and, of those electors, 17,315 electors voted YES, and 19,257 voted NO on the measure captioned TO FORM A TRANSPORTATION DISTRICT AND ESTABLISH TAX RATE LIMIT, as set forth in the attached Exhibit, incorporated by reference herein. Section 2: Because the majority of electors voted in opposition, the measure is declared to have failed. (Name of County or Counties) The following shall be the ballot title of the measure to be submitted to the district's voters on this dat( : CAPTION (10 Words) TO FORM A TRANSPORTATION DISTRICT AND ESTABLISH TAX RATE LIMIT QUESTION (20 Words) Shall Bend Area Transportation District be formed and impose $.393 per $1,000 assessed value as permanei t rate limit beginning 2009-2010? SUMMARY (175 Words) A transportation district would be established, covering the City of Bend and additional territory. The name of the district would be the Bend Area Transportation District. The purpose of the district would be to plan, establish, furnish and maintain a system for the transportation of passengers within the Bend area and to construct, maintain and operate any related facilities pursuant to ORS 267.510 et seq. If approved, this measure would authorize the district to tax properties within the district for the a bove listed services at a maximum permanent tax limit of $.393 per $1,000 assessed value and is estimate d to raise $2,800,000 in operating funds for the District in the first year. The district taxes would be imposed starting with tax year 2009-2010. If this measure passes, the election of the governing body will be held in March, 2009.
