NO. BACKGROUND AND POLICY IMPLICATIONS: Due to Redmond City Limit Annexation, portions of Northwest Way and NW Maple Avenue now lie within the Redmond City limits and the County has been requested to surrender these portions of Northwest Way and NW Maple Avenue to the City of Redmond. FISCAL IMPLICATIONS: The City of Redmond will be responsible for all maintenance and planning duties for these section; of Northwest Way and NW Maple Avenue and they will be removed from the County's maintenance responsibility RECOMMENDATION & ACTION REQUESTED: The Road Department recommends signature of Order No. 2008-096 ATTENDANCE: George Kolb, County Engineer DISTRIBUTION OF DOCUMENTS: Copy to Wanda Callahan (ext. 7103) at the Road Department and a copy to Kelly Morse, City Recorder, 716 SW Evergreen Ave., Redmond, OR 97756 after recording. REVIEWED LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Surrendering portions of Northwest Way and NW Maple Avenue to the City of Redmond, Oregon Pursuant to ORS 373.270. * * ORDER NO. 2008-096 WHEREAS, by Resolution 2008-51, the City of Redmond has requested surrender of jurisdiction of portions of Northwest Way and NW Maple Avenue located within the Redmond city limits as set forth in Exhibit "A" attached hereto and by this reference incorporated herein, and WHEREAS, the Board of County Commissioners finds that it is in the public interest to surrender jurisdiction and accept the request set forth in Resolution No. 2008-51 dated the 28th day of October, 2008 of the City of Redmond; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREEY ORDERS as follows: Section 1. That effective as of 12:00 AM, December 11, 2008, the Board of County Commissioners hereby surrenders jurisdiction of portions of Northwest Way and NW Maple Avenue in Resolution No. 2008-51 of the City of Redmond; attached hereto as Exhibit "A", to the City of Redmond Section 2. DALY, Commissioner PAGE 1 OF 1- ORDER No. 2008-096 CITY OF REDMOND RESOLUTION NO. 2008-51 A RESOLUTION OF THE CITY OF REDMOND REQUESTING THE TRANSFER OF CERTAIN COUNTY RIGHTS-OF-WAY FROM DESCHUTES COUNTY. WHEREAS, the City Council has agreed to take jurisdiction of certain County roads within the City limits; and WHEREAS, pursuant to ORS 373.270(6), the City Council wishes to initiate transfer of such jurisdiction to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDMOND, OREGON, AS FOLLOWS: SECTION 1: That the City hereby requests that Deschutes County surrender jurisdiction to the City of Redmond of certain County rights-of-way described in Exhibit B and Exhibit C attached hereto as of 12:00 a.m., November 14, 2008. SECTION 2: That the jurisdiction of Deschutes County over the rights-of-way described in Section 1 hereof, and for the right-of-way improvements, construction, and repair shall cease upon transfer of the property to the City of Redmond. SECTION 3: This resolution shall be effective October 28, 2008.
