Also present were Tom Anderson, County Administrator; Ken Hales, Community Corrections; David Inbody, Health; Nick Lelack, Community Development; Chris Doty, Road Department; Susan Ross, Property & Facilities; Christina Partain, Finance; Elon Glucklich of The Bulletin, and representatives of seven other departments. Chair Baney opened the meeting at 1:35 p.m. ___________________________ 1. Discussion of 2014-15 Fee Schedules. Christina Partain provided a few changes from departments and the Sunriver Service District numbers. (These are attached for reference.) Some departments have either no or few changes. Nick Lelack referred to their recommended changes and their survey of other areas. Community Development wishes to add some fully-loaded costs that have not been funded in the past, such as technology, vehicle replacement and adding two FTE. Other jurisdictions are not seeing the activity that is being seen here, and they need to cover costs with appropriate fees. Few fees are increasing in other areas. Some of the department’s projects are very demanding of staff time, especially long-term planning. Mr. Lelack says they share the numbers with COBA (Central Oregon Builders’ Association) and COAR (Central Oregon Association of Realtors), and typically understand that the department is trying to keep pace with inflation and demand. He does not think they will oppose this. Minutes of Board of Commissioners’ Work Session Monday, April 28, 2014 Page 2 of 7 Regarding environmental soils, Chair Baney asked about an important piece relating to public safety that perhaps someone may turn a blind eye to if the costs are high. Lori Furlong of CDD said the increased cost is a pass-through from the State. Mr. Lelack said they testified against it, as they want to have the cooperation of the public. Mr. Anderson said the surcharge is high in his opinion. Commissioner Unger likes the concept of 2%, which is less than inflation. Commissioner DeBone agreed. Mr. Anderson noted that it is hard to plan for costs for the year, as much of it depends on volume and demand. Mr. Lelack stated that adding two FTE will help them remain efficient and a high level of customer service. Chair Baney agreed that the turn-around time is a big consideration. Mr. Lelack stated that he has spoken with COBA regarding a fee study, and COBA will participate if at some point it is felt this should be done. The cities’ fees are significantly higher than the County’s. Regarding Health and Behavioral Health, Chair Baney said she was most interested in who does what rather than the fee schedule. Commissioner Unger asked about some services that are being cut. Beth Raguine said that much of those services would be provided by community partners. Commissioner DeBone stated that it appears they will be reporting the true cost of performing services. Sherri Pinner agreed, so this will not show them discounting fees as they have in the past. The other regional counties met and agreed on how these numbers will be shown. Chair Baney wants to be sure they are providing the most services for the dollar for the services being provided. The County should not provide a service if another entity could do so at a lower cost. They need to be the right one to provide a service at the best cost as appropriate. Commissioner DeBone would like to hear from others if they think they can do the same work for a lower fee. Chair Baney said that people are watching these rates now, with the changing face of health care. ___________________________ Ms. Partain went over other minor changes in some departments’ fee schedules. ___________________________ Minutes of Board of Commissioners’ Work Session Monday, April 28, 2014 Page 3 of 7 Chair Baney asked if some of the Juvenile Justice fees are new. Mr. Hales said they are establishing a one-time supervision fee, which most agencies do, for being on informal supervision or formally accountability diversion. It is not intended so much as a revenue stream but to enhance accountability from youth, who are to pay for some things. They are paid for being on a work crew, and some of that is to go towards restitution. These fees have to be agreed upon by the Judge and District Attorney, and they have discretion if warranted. Everyone is made aware of the conditions early in the Court process. ___________________________ Chris Doty explained changes in the Surveyor section of the Road Department fee schedule. It has been six years or more since this was adjusted. There was a general fund subsidy at one point. This fee is based on cost recovery, and they compared rates with ten other counties. ___________________________ Regarding the Service Districts, Ms. Partain stated that the Black Butte Ranch County Service District has many fees that are not appropriate and are being deleted. There were minor changes at 9-1-1. The 4-H Extension is staying the same, and the Sunriver Service District has a few minor language changes. 2. The Board went back into executive session under litigation at 3:12 p.m. ___________________________ At 3:20 p.m., the Board went into regular session to take action. UNGER: Move County Counsel have settlement authority on a litigation case as discussed in executive session. DEBONE: Second. VOTE: UNGER: Yes. DEBONE: Yes. BANEY: Chair votes yes. Commissioner DeBone had to leave the meeting at this time. ___________________________ The Board went back into executive session under litigation at 3:20 p.m. At 4:00 p.m., the Board went into regular session to take action. UNGER: Move they direct staff to continue with ongoing talks with OSU Cascades as discussed in executive session. BANEY: Second. VOTE: UNGER: Yes. BANEY: Chair votes yes. Minutes of Board of Commissioners’ Work Session Monday, April 28, 2014 Page 5 of 7 ___________________________ Chair Baney asked if the litigation update could be streamlined, and the focus be on issues that need to be highlighted. Mr. Doyle said that they have a printout and can review that and look at just the items of most concern or interest. This update will be rescheduled. ___________________________ Tumalo Community Association. Commissioner Unger updated the Board on the situation regarding the Tumalo Community Association. They changed leadership recently, and some wanted the monument sign on the highway to be one thing while others wanted something else. He learned that the business people support the monument sign and were willing to take over the project. However, the Community Association did not agree. They eventually chose to go with this but some were not happy about it. There is little clarity on the issue. He said he advised that they have to consider the comprehensive plan, and needs to know who is able to support forward movement in Tumalo. Some wanted to be taken off the permit application, so he told them the County would carry the permit forward. The business group is stepping up and has some kin d of structure for a Tumalo Business Association, and will take responsibility for raising funds and getting the work done. ODOT does not care what happens, and wants the County to advise them what to do next. The business community is working on a path to develop and pay for a monument sign, and is asking the County to work with ODOT to create the signs. There needs to be traffic control at the time of installation. ODOT handles this on highways. Commissioner Unger wants to continue to support the business community there. There is a sign permit, and it was through the Community Association, but ODOT requires a public entity to be involved. The sign was developed and barely passed on the original design, and the new people involved in the Community Association then wanted something different. The business community say they will support it. The Community Association president has asked the County to decide on the signage. Minutes of Board of Commissioners’ Work Session Monday, April 28, 2014 Page 6 of 7 Commissioner Unger would like to see more work done with the business group that said they would pay for it. He understands it will not cost as much as originally thought anyway. According to Peter Russell, they would need a new permit if the business association were the new applicant. The question is whether the County should pursue this, or do they try to bridge the two groups. Central Oregon Mediation might be able to help, and it appears to be a long-term issue. Chair Baney said if they refile and there is a new Community Association board, then what. Commissioner Unger said the business community has a plan and some credibility. They seem to want the Board to decide. He wants to work with whoever has a plan so they can move forward. There is little consensus. The business owners will take care of this while the residents around there do not take care of their own properties. The business owners have more to gain from the signage. He will not promise then anything that costs the County money. Mr. Anderson said there is another issue of a porta-potty and dumpster on County owned land, and river access. A permit for this is needed from the Road Department. They will also need to cover liability. Chair Baney feels that having monument signs makes it clear to travelers that they are entering a town and need to keep that in mind. This is a safety issue. She does not want the liability of river access. Mr. Doyle says the County knows it is being utilized so there is liability in any case. You purchase a policy or transfer the liability. The cost is $100,000 a year. The County can purchase a policy and figure out how to cover it, or lease or license it. The Tumalo Community Association is a legal entity but not a nonprofit. The County could pay them what it costs to maintain the porta-potty, dumpster and grounds, and they in turn could use that money for a liability policy. Mr. Kropp said they could fence it off and say no trespassing. Mr. Doyle stated that just transfers the problem and the County will still know it is being used. Chair Baney worries about expectations and involving the County. They have the issue at Sunriver with the boat launch, and the recreational aspects in Tumalo. The County cannot make a big investment and deal with the liability. Commissioner Unger stated that they would need to post ‘no alcohol’ as well. ___________________________ Mr. Anderson asked if the Commissioners had any items to discuss at the upcoming joint meeting with the Redmond City Council. It was suggested they talk about no shooting signs on the Badlands property. Everything else would be recycled. If the Council has no items, they can skip this meeting. Mr. Anderson said AOC wants $3,000 in dues to advocate for veterans rights. Chair Baney said she spoke with him and suggested $1,500. Commissioner Unger said he would be willing to approve $2,000. They decided on $1,750 . Chair Baney asked if it could be determined what other counties pay in. The County Surveyor's Office is funded from two different sources, Plat Review/Filing Fees (Fund 328) and the Public Land Corner Preservation Fund (Fund 329). We are propOSing raising Plat Review/Filing fees to ensure full cost recovery of services performed. In recent budget cycles, plat review and filing fees represent approximately 7% of the fee revenue generated by the Surveyor's Office to fund operations. Background: Prior to 2005 the Surveyor's Office received a General Fund subsidy. In FY 06 the General Fund subsidy was eliminated and the office became entirely fee based. Due to the prior subsidy, review fees were extremely low and a phased approach was implemented to adjust the fees over the course of three budget cycles. The initial phases were implemented in FY 07 and FY 08. However, when the recession hit a countywide moratorium on fee adjustment was implemented for several budget cycles; subsequently the third phase of fee increase was never implemented. Until recently, the lack of plat review activity has downplayed the need to revisit fee rates. Recent plat activity has increased such that staff review time is not fully self-sufficient. Fee categories and adjustment methodology: The Surveyors Office has six fee categories as follows: 1. Subdivision (standard) 2. Subdivision (post monumented) 3. Partitions 4. Condominiums 5. Property Line Adjustments 6. Records of Survey The primary fee intensive services provided by the Surveyors Office are that of subdivision plat review and partition plat review. Based on review of recent activity, the average cost associated with staff review of a subdivision plat (18-lot average) is approximately $2,100 and a partition plat is approximately $750 . The proposal to adjust fees to recover cost reflects these average costs. Additionally, cost comparisons were performed with 10 other Oregon counties with similar survey activities to confirm that the proposed fees were comparable within the industry. However, in faster growing counties partitions have become more complex in nature due to their use by urban developers and national chains such as Walgreens and Wal-Mart. Statewide the review fees for partitions in more populated counties have risen to reflect this trend. In Deschutes County the average number of parcels in partitions has been 2. This fee is charged on cases in which the defendant applies for and is accepted into a Traffic Safety School or Seatbelt Class Diversion. The defendant must pay a fee to the court to track their case during the period of diversion. Judge Fadeley and I have completed some recent research into the amounts that other courts charge for their processing fee and have found that costs range from $25 to $200. We have also reviewed the amount of labor and time incurred by staff when handling cases in which this fee is charged and feel that $50 is more in line with the actual cost of processing. These details were discussed with Tom Anderson during our Preliminary Budget meeting, so he is familiar with the logic behind the request. If you need further information, please let me know. Kenneth Hales Date: April 11, 2014 Re: Juvenile Communil¥ Justice Fee Schedule Change The Community Justice Department seeks to impose two supervision fees to the Juvenile Community Justice division's current fee schedule. The enactment authority to impose these fees can be found in ORS 419C.449. The additional supervision fees that we are proposing are a 1) one time $100 Juvenile Probation Supervision Fee or each juvenile assigned to the department for probation supervision and 2) one time $50 Juvenile Informal/FAA Supervision Fee for each juvenile assigned to the department for informal supervision, a sole sanction or a Formal Accountabilil¥ Agreement. The reasons for these fees are three-fold: 1. Accountability Is a crucial part of the Balanced Approach to juvenile justice. We believe that in conjunction with the many other strong services we provide (skill development, treatment opportunities and public safety) a supervision fee will be an effective accountability component and is in-line with our Evidenced Based Practices of sanctioning anti-social behavior that we don't want to continue. 2. Revenue generated from these fees will help support Victim Restoration efforts by allowing us to expand our Fresh Start program, where youth who are unable to gain employment can perform communil¥ service work and earn restitution to make their victims whole; thus the fees, while Individually are an accountability measure, collectively they are a way to give back to those in the community who have been harmed by delinquent behavior. 3. Supervision fees are a type of sanction to hold youthful offenders accountable. As with any sanction, a graduated process Is most effective. These additional supervision fees align with our graduated sanctions as youth penetrate into the system further or increase their criminal behavior. With the additional fees, our graduated sanctions (with regard to fees) would be as follows: 1st time low level violation No fee, Parent Letter. 2 nd or subsequent low level violation $25 fee Referral handled by Informal Agreement or Diversion $50 Supervision Fee Referral handled by Formal Court involvement $100 Supervision Fee.
