HomeMy WebLinkAboutTitle 19 Revisions MEMORANDUM To: Board of County Commissioners From: Peter Russell, Senior Transportation Planner Date: Nov. 19, 2014 Re: Housekeeping amendments for Title 19 to clarify County’s authority Background Deschutes County Code (DCC) Title 19, Bend Urban Growth Boundary Zoning Ordinance, governs lands that are known as the Bend Urban Area Reserve (UAR). These are lands that are adjacent to the Bend Urban Growth Boundary (UGB), which is co-terminus with the Bend city limits. Broadly speaking, the UAR lands are lands that are anticipated to urbanize in less than 50 years but not sooner than 20 years. Title 19 components are consistent with the Bend Area General Plan. Need for housekeeping amendments While the overwhelming majority of land use applications processed by the County fall under DCC Title 18, County Zoning, there is a consistent trickle of applications that fall under Title 19. City and County staff met in late October and identified several areas where it would be beneficial to clarify the language in Title 19 and the County’s Comprehensive Plan to more clearly indicate the County is the controlling jurisdiction when implementing the land use regulations for properties that are reviewed under Title 19. There would be no substantive changes to the County’s Comprehensive Plan or its policies nor to the allowed uses under Title 19. The amendment would simply allow for language that better explains the intent of the UAR lands and how the County administers zoning to those lands. The Title 19 housekeeping amendment would follow the County’s procedure for legislative amendments and would involved a work session and a public hearing before the Deschutes County Planning Commission and then the Board of County Commissioners.
