Legal 541.388.6623 TITLE OF AGENDA ITEM: Convene as both the Deschutes County Board of County Commissioners and the Governing Body of the Redmond Library County Service District for Consideration and Signature of Order 2012-015 Dissolving the Redmond Library County Service District. PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: In 1994, Deschutes County formed the Redmond Library County Service District for the purpose of financing capital construction oflibrary facilities in the City of Redmond. The District never acquired any assets or liabilities other than a general obligation bond approved by the voters for funding the construction of a library facility using the Jesse Hill School in Redmond. The construction ofthe library facilities was completed and all payment obligations for the bond will be paid as of June 1,2012. The Finance Department estimates that the District will collect surplus funds in the amount of$18,100 to $25,000 beyond what will be needed to pay the debt service on the bond. In accordance with ORS 198.955(3), those surplus funds, at the County Assessor's discretion, are then either "offset against that portion of the levies of taxing units levied against the property values of property within the dissolved district" or credited to the real property tax accounts for those properties within the district for the next fiscal year and the funds put in the unsegregated funds account to be distributed according to the statutes. The same will happen for any delinquent taxes collected in future years. The estimate for the cost of Assessor, Tax Collector and Legal staff time is less than $6,000 and those are the only known costs for the dissolution. The district has no assets or liabilities other than the surplus funds. Thus, no other dissolution plan is necessary to complete this dissolution. The order must be signed as soon as possible in order to submit the order to the Department of Revenue by March 31, 2012, in order to cease the levy of taxes for the 2013 fiscal year and forward. FISCAL IMPLICATIONS: The Redmond Library District will no longer levy any taxes to pay for the bond. Thus, the taxes for those properties within the district will be reduced for future tax years, beginning 2013. RECOMMENDATION & ACTION REQUESTED: Approve and sign Order 2012-015. ORDER NO. 2012-015 * WHEREAS, the Redmond Library County Service District ("District") was formed in 1994 for the purpose of financing capital construction of library facilities in the City of Redmond, See Exhibit C to INTERGOVERNMENTAL AGREEMENT RELATING TO THE TRANSFER OF ASSETS FROM DESCHUTES COUNTY TO THE DESCHUTES PUBLIC LIBRARY DISTRICT, recorded in the Deschutes County Commissioners Journals at Vol. CJl999, Page 994, incorporated by reference herein; and WHEREAS, the final payment on the District's bond will be completely paid as of June 1,2012; and WHEREAS, construction of the library facilities in the City of Redmond was completed and no further construction payments will be issued; and WHEREAS, the District has no other outstanding bond, coupon or other indebtedness, interest in real property, uncollected taxes assessment or charges, personal property or any other assets; and WHEREAS, because the library building construction is completed, all bond debt service and payments are completed and the district has no assets or indebtedness, the district is no longer necessary for the purpose for which it was formed; and WHEREAS, it is estimated that the district will have, as of June 30, 2012, between $18,000 and $25,000 in surplus funds; and WHEREAS, the Deschutes County Assessor must dispose of any District surplus funds in excess of the $6,000 in Section 2 below in accordance with ORS 198.955(3)(a)or (b); and WHEREAS, the costs to dissolve the District are for County Finance, Assessor and Legal Counsel staff time to prepare this order, the costs of the governing body approving this order and the Assessor's and Tax Collector's staff time disposing of any surplus funds, estimated to be a total ofless than $6,000; and WHEREAS, no other plan for dissolution is necessary except for disposition of surplus funds In accordance with ORS 198.955(3); now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ALSO ACTING AS THE GOVERNING BODY OF THE REDMOND LIBRARY COUNTY SERVICE DISTRICT HEREBY ORDERS as follows: Section 1. The Redmond Library County Service District is dissolved as of June 1, 2012. Page 1 of2-ORDER NO. 2012-015 /11 Section 2. In accordance with ORS 198.955(3), the County Tax Collector shall deposit in the Deschutes County General Fund $6,000 of any District surplus funds. Section 3. The Deschutes County Assessor shall dispose of any District surplus funds in excess of the $6,000 in accordance with ORS 198.955(3)(a)or (b).
