MINUTES OF WORK SESSION
DESCHLTTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, FEBRUARY 10, 2010
Present were Commissioners Dennis R. Luke, Alan Unger and Tammy Baney.
Also present were Dave Kanner, County Administrator; Erik Kropp, Deputy
County Administrator,- and, for portions of the meeting, Joe Stutler, County
Forester; Tom Blust, Road Department; Nick Lelack and Peter Russell,
Community Development; Laurie Craghead, County Counsel; and six other
citizens. No representatives of the media were present.
Chair Luke opened the meeting at 1:30 p.m.
1. Forester Update.
Joe Stutler introduced George Chesley, Tom Andrade and Kevin Benton of the
Oregon Department of Forestry.
Mr. Stutler said that SB 360 is a Senate Bill passed in 1997 requiring property
owners to do certain things around their home to protect themselves from
wildfire. Representatives of the Department of Forestry are visiting all areas
and speaking with people about the issue. They have had good success because
of the County's efforts. The Act requires this to be done every five years. It
seems to work well and people are familiar with the process. Deschutes County
is probably the best organized in the State in this regard. It seems to be the only
truly successful program of this type in the entire western United States.
Mr. Chesley is the Chair of the committee, which also includes Fire Marshall
Gary Marshall and Ken Lane. A series of meetings were held to review the
over 31,000 parcels in the County that may qualify, and they used maps from a
classification project done five years ago. Deschutes was a pilot county for this
program. There was a benefit of the work done five years ago. The ratings are
shown as high, extreme, or high density extreme. The lower ratings apply only
on the west side of the Cascades.

They relied on the expertise of committee members and also took field trips.
They had five public meetings in various parts of the county, and another
meeting in December regarding Deschutes River Woods's rating.
Commissioner Luke asked how enforcement could happen. Mr. Andrade said
that they receive a letter in the mail with specifics on ho w the program works.
If a fire starts on a property that should have been treated, the property owner
could be liable up to $100,000 of the cost of fighting the fire if it extends
beyond their property. If a home is certified, the insurance companies like it.
The certification packets will be sent out in about a month.. Statistics over the
past nine fire season show very reduced instances of fire in these cases.
Residents of Starwood subdivision used a grant to help with defensible space
there. A grant program is available and some citizens have taken advantage of
this as well. If federal or state property is transferred to a private party, the new
rules apply.
Mr. Stutler then spoke of other activities, such as Fire Free. They referred to
some oversized maps of the area.
Mr. Stutler said that in the past few months they have treated about 4,000 acres
of County -owned land. He then spoke about the defensible space bid progress
and agreements.
2. Transportation System Plan Update.
Commissioner Baney said the Board will be asked about other locations for
transportation routes. She spoke with Paul Dewey regarding the 19th Street
extension, and Mr. Dewey mentioned that he feels Tumalo is more critical. At
another time, she also spoke with Tumalo residents regarding their
transportation needs. Mr. Russell said they are looking at access, connectivity
and other things long-term, on top of short-term fixes.
He is working with various entities to deal with about a half -dozers locations.
The Tumalo interchange is on the project list, but no one is actively seeking
funding for it. Commissioner Unger stated that cities have to contribute 20% to
improvements on federal or state road projects. Mr. Russell said that it varies
for the County, but is around 12%.

Commissioner Luke said that ODOT has priorities and is mostly concentrating
on Highway 97. Highway 20 is secondary to them. There are ways to make
roads safer but it may not always be convenient. Mr. Russell said short-term
fixes often just move the problem up the road.
Mr. Lelack said that Tumalo residents are trying to articulate what their goals
are to see if it will blend with the transportation plan.
Commissioner Unger asked if the intersection of Tumalo Road and the Old
Bend -Redmond Highway is going to be changed, as it is hazardous. Mr.
Russell said it is a known issue and some small changes have been made in the
past, with others solutions to come. Commissioner Luke asked for statistics on
accidents in that location.
3. Briefing on File #PA -09-2, Adding 19th Street between Redmond and
Deschutes Junction to the TSP Map (Hearing scheduled for 6 PM,
February 22).
Peter Russell referred to an oversized map of the area. He and Tom Blust
talked about the south Redmond collaboration group and its work with the
BLM, ODOT and other entities to address transportation issues between
Redmond and Deschutes Junction and Bend.
Commissioner Luke spoke about the trades that have taken place that affect
properties along this route.
Mr. Russell said that ODOT wants to close as many access points as possible
along Highway 97, and 19th Street improvements will help them in this regard.
There were differing opinions about which side of the railroad tracks it should
go. The federal planning process took several years, and included a NEPA
report. About 83% of the land along 19th Street is federal land. The property
has to be on the TSP for the federal government to move forward. One
component of the local planning process is getting an exception to Statewide
Planning Goal 3.
If the City does not take in part of the road, the County will be responsible for
maintenance. There may be agreements already in place regarding 19th Street
just south of the Fairgrounds. The Department of State Lands will need to
understand that the use of the land around the road may change over time.

Hearings have been held before the Planning Commission. About 65 residents
from Boonesborough have responded negatively about increasing the use of
Deschutes Market Road and extending 19th Street. They are asking why
Highway 97 cannot be widened instead of building a whole new road.
Commissioner Luke would like more information from the City of Bend about
proposed transportation corridors within Juniper Ridge. They need to be part of
this discussion. In addition, he would like to see something from Redmond
about access points and improvements.
Mr. Russell stated that the City of Bend owns most of the property on the west
side of Deschutes Market Road. There are many private driveways on the east
side and these have to be addressed. Major upgrades for that road need to
happen to accommodate increasing usage.
Mr. Lelack said that the City of Redmond designed Helmholtz properly, and the
City of Bend should do something similar. It involves a big right of way and
controlling access points. It should be built to County standards with bigger
setbacks.
Commissioner Unger stated that the cities can only spend money within their
urban growth boundaries. Commissioner Baney said they have other options,
such as using general funds. Commissioner Unger observed that everyone will
benefit, so it is important to determine early who will be responsible for what.
Commissioner Luke said that it still takes all the traffic into one spot, either at
Bend or at Redmond. Mr. Russell supports this because it provides a parallel
local facility, taking traffic off Highway 97. The choke points are an issue.
The Planning Commission debated this and supported a linkage between the
two cities, and denied the amendment because there wasn't more information
on why it is where it is and the federal part of it.
There was concern on the part of one of the Planning Commissioners about
taking 19th Street and rezoning it. It is BLM land, and they do not like having
fragmentation or a variety of uses.
Commissioner Unger asked if there is a plan for where Quarry comes across.
Tom Blust replied there is nothing in detail but a connection won't be difficult.
Commissioner Baney asked if there might be an overpass or exchange, why not
bring 19th Street into it. Mr. Blust said that factors are cost and priorities.
Commissioner Luke stated that fifteen or twenty years from now the entire road
could be developed and another interchange be established there. Mr. Russell
stated that everything in that quadrant will someday be new.

Commissioner Baney said that it adds another way to handle transportation.
But she does not see the need at this time. There are issues with other roads
that are urgent now.
Commissioner Luke said that Juniper Ridge is to going to happen and they need
to be ready.
Mr. Russell said that the railroad will have increasing traffic and will create
issues at roads. This plan would disturb the least amount of land possible.
From a transportation standpoint, it makes sense.
Mr. Blust said that none of it is that difficult. Mr. Russell said that the County
still has a lot to do with the road and potential uses.
Mr. Kanner stated that the City can just annex the road and build it accordingly.
Commissioner Luke said that it does not have to be big, but there are a lot of
access points to deal with.
4. Update of Commissioners' Meetings and Schedules.
Commissioner Baney discussed unfunded mandates in regard to Department of
Human Services programs. She is attending a meeting later this week in this
regard.
She spoke with Senator Wyden's staff regarding assistance with improvements
to Skyliners Road.
Commissioner Luke will be in Salem on Monday, which is a holiday.
Commissioner Unger meets with the Deschutes Water Alliance in Redmond on
Friday.
He spoke on KBND radio today, and only got one call regarding Skyliners
Road. Other topics were water quality and the jail bond.
5. Other Items.
BANEY: Move approval of Chair signature of the Family Access Network
and Early Headstart support letters and documents.

Commissioner Baney stated that Frank Moore sent a request for support for
veterans' facility in Linn County. Commissioner Baney feels that this is a
worthy effort, since the only other veterans' home in the State is in The Dalles.
Commissioner Luke stated that he believes that Klamath County is requesting
this as well. However, the deadline is Friday and they have not contacted
Deschutes County to ask for support.

Citizen Chris Miller told Commissioner Baney that she lives alone, and has a
big problem with smoke from woodstoves, federal slash burning and burning in
general. Her reaction is extreme. She may be in touch with the Board in the
future about her concerns.

Erik Kropp said that the A -frame cabins are evidently not coming to the Bend
area to house the homeless. Transportation is an issue, as well as reconstructing
the ones that need it.
Commissioner Luke asked if any progress has been made with Bethlehem Inn.
Mr. Kanner stated that a meeting is scheduled to help them figure out how to
run a fundraising campaign.
Commissioner Luke asked about the upcoming 19th Street hearing. If
challenged, both he and Commissioner Unger have been involved in the project
for a long time, so what happens. Laurie Craghead said it is legislative but also
under the comprehensive plan. The County governing body has to hear it. The
record just has to be built properly. There may be challenges as to the necessity
of having the road. Commissioner Baney stated that the City of Redmond
needs to demonstrate the need at that end, and may need to testify in that regard.
Commissioner Luke said that planning and developing projects such as these
take so many years, that by the time they are done they are way past being
needed or could even be inadequate.
Being no further items addressed, the meeting adjourned at 4:15 p.m.

MEMORANDUM
DATE: February 10, 2010
TO: Deschutes County BOCC

RE: Forester Update
For the last two months the following projects and issues have either been
accomplished or addressed:
1. Grant Applications—we learned last Friday that Deschutes County will
receive a stimulus grant of approximately $750,000 for fuels treatment and
biomass. We expect the funds to become available around March 1st
2. Existing Grants—Utilizing existing grants we have treated over 400 acres
this winter on county owned and private lands. Heart of Oregon and All
Season Cleanup along with Aspen Lakes continue working on fuels
treatment. We plan on approximately 12 projects this coming spring and
summer in neighborhoods across the county treating fuels.
3. The Senate Bill 360 classification process is complete and ODF
representative Tom Andrade will be sharing the update with the BOCC.
4. I have participated in two Incident Command System (ICS) courses at the
Redmond Regional Training Center to assist with the training of
approximately 100 federal, state and local government personnel this
winter for upcoming emergencies and wildland fire events.
5. We have begun the process of updating the Sunriver CWPP and have
scheduled meetings for the next several months to complete this process.
6. Project Wildfire/FireFree Programs—we have begun the process for
planning the FireFree campaign for 2010 which is scheduled for May 1-9
this spring, along with a fall program. FireFree has actually expanded to a
year around endeavor, we have leveled off @ approximately 35,000 cubic
yards from the landfill and we accumulate another 125,000 cubic yards
from around the county as a result of the sweat equity program.
7. I am working with a group of "collaboratives" throughout Central Oregon
which will enable the Deschutes National Forest to compete for significant
funding from the Collaborative Forest Landscape Restoration (CFLR)
program which was established by Congress in 2009. Congress has
allocated $40 million annually for this program and if selected could make
a significant difference in landscape restoration on public lands.

SUBJECT: Work Session summary for adding PA -09-2 (adding 19th Street to Transportation
System Plan map between Redmond and Deschutes Junction)
BACKGROUND
Staff initiated PA -09-2 to add a line depicting 19th Street, a future rural arterial, to the Deschutes
County Transportation System Pian (TSP) map between the existing 19th Street in south
Redmond and the Deschutes Junction interchange. The two-lane road will go east of the
Burlington Northern Santa Fe Railway tracks.
The Deschutes County Planning Commission (PC) held public hearings on Dec. 17, 2009 and
January 14, 2010, and deliberated on January 28, 2010. The PC voted 6-0 in support of a
transportation linkage between Redmond and Deschutes Junction, but voted 6-0 to recommend
the Board deny the specific alignment depicted in PA -09-2.
The alignment of PA -09-2 originated in a federal planning document, the "Upper Deschutes
Resource Management Plan" (UDRMP) which identified a'/2 -mile wide corridor across the
Bureau of Land Management (BLM) lands between Redmond and Deschutes Junction. The
UDRMP plan was a multi-year collaborative effort involving BLM, Deschutes County, City of
Redmond, Oregon Department of Transportation (ODOT), Department of Land Conservation
and Development Oregon (DLCD), Department of State Lands (DSL), and the Oregon Nationa
Guard.
PURPOSE OF WORK SESSION
Staff will provide background to the Board to prepare them for the Feb. 22, 2010, public hearin
on PA -09-2. Key issues will be 1) explain the alignment chosen for 19th Street, which requires
an exception to Statewide Planning Goal 3; 2) purpose of 19th Street; 3) summarize the
concerns of the PC as well as the general public; 4) summarize the support from the City of
Redmond, ODOT, and DSL; and 5) staff will answer any questions from the Board.
