As you can see in the attached memo from Captain Tim Edwards, the Sheriffs Office is recommending that we oppose the renewal of the liquor license of RJB's Restaurant and Sports Lounge, which is located in the Sunriver Business Park. As you can see, Capt. Edwards' memo originally came to me in July. I've held off on scheduling a work session mostly due to vacation schedules and a desire to have all three of you available to weigh in on a recommendation that could potentially lead to putting someone out of business. Note that the final decision is up to OLCC. The Board only makes a recommendation, which OLCC can accept or ignore in its sole discretion. In June of every year OLCC sends a list of those establishments to the local governing body for their recommendation to approve or deny the re -licensing of each establishment for the following year. At the request of the county I have reviewed the history of each business from June 2009 to June 1 2010, for alcohol related incidents. Of all the businesses in unincorporated Deschutes County licensed to sell alcohol only 4 had some type of alcohol related incident reported to law enforcement, as follows. Terrebonne Depot —1 incident After consuming alcohol in the restaurant a customer had a motor vehicle accident in the parking lot and fled the scene. Based upon witness statements it is likely that the customer was intoxicated but law enforcement was not able to contact her until several days later. Village Bar and Grill- 1 incident 1 subject arrested who stated they had been drinking at Village Bar and Grill. Tumalo Tavern 2 incidents A husband and wile were both arrested for DUII after drinking at Tumalo Tavern and switching drivers before Deputies caught up with them. A subject drinking in the bar became belligerent with other customers when he believed another man was flirting with his wife. A visibly intoxicated subject was seen continuing to drink inside the bar and was later arrested for Probation Violation as they had a no alcohol condition. A Domestic Assault occurred at home after the wife had become intoxicated drinking at RJB's. A customer was assaulted in the parking lot by two other patrons. A customer had his jacket and keys stolen from inside the bar and the suspect used the keys to steal his car from the parking lot. This is an improvement over last year when RJB's had 11 incidents, but once again the number of incidents far exceeds any other establishment irl the county. Recommendation These incidents were documented in reports from the Deschutes County Sheriffs Office and the Sunriver Police Department, and does not include any incidents or DUII arrests that may have been handled by the Oregon State Police. Based on the above incidents the Deschutes County Sheriffs Office again recommends that you oppose the renewal of RJB's OLCC license when it expires on October 1, 2010. Theses licenses will expire on 10/1/2010. Oregon Revised Statute (ORS) 471.166 establishes the process for local governments to make recommendations to the OLCC. It also requires the OLCC to notify licensees of the license renewal application or processing fees charged by their local governments. According to our records, you charge: License Renewal Fee: 0 Off Premises Fee: 0 We will direct renewal applicants to mail the renewal fees to the address on this letter. Please notify us immediately if the fees or address are incorrect. Approximately 40 days after the licenses expire, the OLCC will send you a Iist of the licensees who filed a renewal application. You can use this Iist to verify that applicants have paid your fees. Recommendation Process: You have until 8/18/2010 to exercise one or more of the following options: I. Provide a written renewal recommendation to the OLCC for any or all of the licenses on this list. 2. Make a written request for additional time to investigate a specific renewal or renewals. The request must set forth the reason additional time is needed, state that the local government is considering making an unfavorable recommendation, and state the specific grounds being considered toward an unfavoragle recommendation. 3. Take no action. After 8/18/2010, the OLCC will process the renewal application as if you made a favorable recommendation. Please send any correspondence to OLCC License Renewals, P.O.
