MINUTES OF WORK SESSION
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, FEBRUARY 4, 2008
Present were Commissioners Dennis R. Luke and Michael M Daly; Commissioner
Tammy (Baney) Melton was out of the office. Also present were Dave Kanner,
County Administrator; Teresa Rozic and Deborah Cook, Property and Facilities;
Erik Kanner, Deputy County Administrator; Mark Pilliod and Laurie Craghead,
Legal Counsel; Catherine Morrow and Peter Russell, Community Development;
and media representative Hillary Borrud of The Bulletin.
Chair Luke opened the meeting at 1:30 p.m.
1. Property Management Update — Planning for March 20 Land Auction.
Teresa Rozic provided the details of the upcoming real property auction. The
auction requires four weekly consecutive public notices; she is working with the
Sheriff's Office on coordinating the event.
All but three of the 18 properties are tax deed properties. The County collects a
small fee for handling the process but the balance goes to the taxing districts.
Eight are located in South County and have sewer available (Oregon Water
Wonderland); two others are outside the TDC area and three are within the
TDC area. Community Development is doing an analysis of the status of the
lots, as it is not known which are buildable.
Minimum bids will be set at 80% of market value. The Sheriff will close the
door at 2 p.m., at which time the bids will be reviewed. All but three properties
will require wildfire fuel treatment.

2. Solid Waste Update.
Timm Schimke said that the compactor inside the building is able to do such a
good job that there will be considerable space saved in the landfill.
Timm Schimke said that concerning the former landfill in Redmond, the
contract will be amended and a Phase II environmental inspection is needed. A
petition to close Negus landfill has gone to the DEQ. Mr. Schimke said that he
has a draft that requires a groundwater assessment at the site. The western
landfill was closed about ten years ago, and he found out that the document is
not specific to one site. Commissioner Luke said that a 2 -1/2 year extension is
okay, but at some point there needs to be a full bidding process again.
Mr. Schimke stated that there is a short time period allowed through DEQ. He
suggested caps over the pipes. There could be a variety of end uses, but no one
is sure what the community wants to have. A feasibility study would take into
account the proposed uses, but the economics were not examined. Park and
Recreation could work up a plan; however, too many ballparks should be
avoided because of potential settlement. Commissioner Luke suggested
growing alfalfa, since it would have to be cut anyway.
In regard to Negus, Mr. Schimke doesn't want Redmond to say it will go away,
as there needs to be another site. It's best to continue at the existing site, since
it is more cost effective and is operating at capacity now. A light industrial area
would more than likely mean a business park, which is really not a compatible
use. Probably between $2 million and $4 million will need to be spent on the
site in the next few years, and he wants to avoid moving it and losing that
investment. Finding another site that fits into Code requirements and zoning
will be difficult, now that the DEQ permit is gone and the grandfathered use
along with it.
Catherine Morrow said that she spoke with staff of the City of Bend regarding
the demo landfill's possible rezoning and master plan. There are various
alternatives. The County could do all the work, apply to the City for adoption
of the plan, and pay for the zone change. The second alternative would be for
the County to do the work, collaborate with the City, and let the City take it
forward and do the planning. The City may identify the land as important to
meet needs, and therefore use the third alternative, with the City providing
direction along with the urban growth boundary expansion, and they would
handle this as part of the City's UGB expansion.

Dave Kanner noted that the DEQ says this devalues the property. The County
could master plan and the DEQ would then say which protective measures
should be taken. DEQ indicated that based on what they know, the property
should be able to be developed with the waste in place. It is unknown whether
the wood waste is valuable enough to be removed for hog fuel.
Ms. Morrow stated that this project is not on the Community Development
work schedule, and funding is needed to address it. Mr. Kanner said that funds
from the Solid Waste Department could be used. He would like to see DEQ
involved up front to help advise on potential uses. He added that some
developers have already indicated that they are okay with leaving the waste in
place.
3. Discussion of South Redmond Tract — Alternative E.
Peter Russell said that he met with representatives of the City of Redmond,
ODOT and the State Division of State Lands last week to discuss what to do
with 19th Street. They are meeting again in a few days. He then referred to an
oversized aerial photograph of the area and discussed the proposed layout of
19th Street.
Dave Kanner said that the proposed alignment puts private property uses
adjacent to the Fairgrounds, which is a problem. There needs to be a buffer
around the Fairgrounds and there may be a possible future expansion of the RV
park, which requires at least twenty acres. This alternative provides neither.
Mr. Russell added that this proposal doesn't help with Pronghorn Resort either.
Catherine Morrow said that the other entities have already been told this. Mr.
Russell noted that 19th Street should go to Deschutes Market Road on the east
side of the railroad. Ms. Morrow stated that the DSL says that this will be a
regional industrial use that cannot be done elsewhere; Commissioner Luke
noted that Juniper Ridge could provide for that use. Mr. Russell said that
getting across the railroad is an issue as well.
Ms. Morrow stated that it might be possible to get an urban growth boundary
adjustment per amended Goal 9; this would be a land use process for both the
City and County. Commissioner Luke said that the DSL needs to be a partner
in the 19th Street expansion project, which will ultimately access into the north
part of Juniper Ridge.

4. Consideration of Economic Development Grant Requests.
None were discussed.
5. Update of Commissioners' Meetings and Schedules.
None were discussed.
6. Other Items.
The Ethics Committee has suggested that if a group is advisory only and is
presenting non - binding recommendations, they are not affected by the new
ethics rules.
The Peace Corps has asked that a proclamation be read supporting their work.
It appears a letter was sent to numerous entities requesting this action. The
Commissioners indicated that they are not interested, since they receive so
many requests to read proclamations, and staff time and meeting time
limitations need to be considered.
Being no further discussion, the meeting adjourned at 4:20 p.m.

BACKGROUND AND POLICY IMPLICATIONS:
On May 10, 2006, the Deschutes County Commissioners approved the Conceptual Master Plan (CMP)
for the Thornburgh Resort (File No. CU- 05 -20). The County's final approval was appealed to the Land
Use Board of Appeals (LLTBA) and portions of the LUBA decision were appealed to the Oregon Court
of Appeals. Ultimately, the County's decision on the CMP has been remanded back to the Board.
Because the Board of County Commissioners (Board) was the final decision - making body for this
decision, the remand findings are required to be made by the Board.
FISCAL IMPLICATIONS:
NONE
RECOMMENDATION & ACTION REQUESTED:
The Board weighs the arguments regarding those specific issues as outlined in the Land Use Board of
Appeals and Oregon Court of Appeals remand. A final decision on the Conceptual Master Plan for the
Thornburgh Resort will be made through this process.
