Luke, Michael M. Daly and Tammy Melton. Also present were Kristen Maze, Peter Russell, Cynthia Smidt and Anthony Raguine, Community Development Department; Ken Hales, Community Justice; and seven other citizens. Chair Luke opened the meeting at 1:30 p.m. 1. Report and Recommendation for the Crime Prevention Services Fund. Dave Kanner said that this was discussed during the budget process. Commissioner Melton stated that these funds would enhance work that is already being done. 2. Additional Discussion of a Proposed Text Amendment regarding Adding “Event Venue” in the MUA Zone. Anthony Raguine indicated he had maps showing which properties fit the criteria as far as lot size is concerned. Also, the cost to mail a notice to all MUA properties is about $2,500. Code requires a published notice as well. Commissioner Luke said that people have a right to know if they live on an adjacent parcel. Commissioner Daly stated that the Board should hear from people why this use should or should not be allowed; it should be compatible with the neighborhood. Mr. Raguine indicated he has heard from about twenty property owners so far. Commissioner Melton said she wants to hear from both sides, and some suggestions from staff so that the meeting can be concise. Laurie Craghead noted that in an exception area, they have to comply with the comprehensive plan. Some counties do allow this as a home occupation, however. Commissioner Luke was curious as to what other counties allow that Deschutes County does not. Peter Russell said he has concerns about the locations and how this affects local roads. Mr. Raguine stated that using minimum lot size as criteria is one way to handle it. MUA zones are intended for smaller impacts, such as a bed and breakfast. Perhaps the number of guests can be based on the size of the property. Ms. Craghead said that the Planning Commissioner felt like it was between a rock and a hard place; they wanted more information but had already closed the record. 3. Discussion of Medical Hardship Text Amendment (Use of RVs and Other Temporary Structures). Commissioner Luke said that he supports the idea of allowing an RV as a temporary structure for medical purposes. Discussion took place regarding people adding structures for temporary use; this will be addressed further at a later date. Commissioner Melton suggested they move forward with the RV provision. MELTON: Move first reading by title only. DALY: Second. VOTE: MELTON: Yes. DALY: Yes. LUKE: Chair votes yes. The second reading is scheduled for August 13. 4. Continuation of a Public Hearing, and Consideration of First and Second Readings, and Adoption by Emergency, of Ordinance No. 2008-018 regarding Hydroelectric Facilities in the Open Space and Conservation Zone. Laurie Craghead presented revised language. Cynthia Smidt said they eliminated much of the technical language regarding water rights and water flow, as this is already covered in Statute. Federal and State licensing information will need to be provided. She added that they deleted wording regarding landscaping as it is covered in other ways since these sites fall within the landscape management zone.
