BACKGROUND AND POLICY IMPLICATIONS:
Resolution 2015-032 updates the Deschutes County Noxious Weed List (Exhibit A of the Order).
The Deschutes County Weed Advisory Board periodically reviews the Noxious Weed List and
recommends to the Board of County Commissioners ("Board") changes to the list. The list was
most recently approved by Order 2014-003. Under DCC 8.35.030, the Board is authorized to
declare certain noxious weeds that are not allowed to reproduce within the Deschutes County Weed
Control District.
A noxious weed list will be published on May 8,2015 describing the District and naming weeds to
be destroyed and prevented from reproducing within the District. Enforcement shall follow the
procedures outlined in DCC Chapter 8.35.
FISCAL IMPLICATIONS: None.

Re: 2015 Noxious Weed List
Submitted for your approval is the 2015 Noxious Weed List. The Deschutes County Weed Board recommends that one
noxious weed be added to the list. Hoary allysum was declared an A rated weed by the Oregon Noxious Weed Board
and was discovered in the County in 2014. The Noxious Weed Advisory Board recommends this plant, which is invasive
and toxic to livestock, be designated as an "A" weed. We are also recommending that the listing for yellow floating
heart be expanded from one species (Nymphoides peltata) to the entire genus (Nymphoides spp.) which also mirrors a
recent change by the Oregon Noxious Weed Board. Differentiating between the species of the Nymphoides family is
very difficult and all Nymphoides are considered highly invasive with negative effects to the aquatic environment.
Finally, the species name for spotted knapweed is corrected to reflect a change in the taxonomic name.
Resolution No. 2015-032 adopts the revised Deschutes County Weed list.

County Noxious Weed and Plant List. * RESOLUTION NO. 2015-032
WHEREAS, pursuant to Deschutes County Code ("DCC") 8.35.030, the Board of County
Commissioners is authorized to declare certain weeds and plants noxious for the purposes of DCC
Chapter 8.35 and ORS 569.350 to 569.495; and
WHEREAS, the Deschutes County Weed Control Board recommended that the County's Weed
List be updated with additional weeds and other plants; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. The Deschutes County Weed List shall be as provided in Exhibit A, attached and
incorporated by reference herein.
Section 2. The Weed Inspector shall publish the Notice, marked Exhibit B, attached and
incorporated by reference herein, describing the District and naming the weeds and plants to be
destroyed and to be prevented from producing seed and/or spreading within the District. This Notice
shall be published in The Bulletin on May 8, 2015.
Section 3. The Weed Inspector is authorized and directed to enforce the provisions ofDCC
Chapter 8.35 and ORS 569.350 to 569.495 regarding the list in Exhibit A immediately after the
publication and this Notice.

Section 4. The noxious weed and plant list attached as Exhibit A becomes effective on May 8,
2015.

Deschutes County Weed Policy and Classification System
"Noxious Weed" means any weed designated by the Deschutes County Board of County
Commissioners ("'Board") that is injurious to public health, agriculture, recreation, wildlife, or
any public or private property; any weed that impacts and displaces desirable vegetation, such as
Threatened and Endangered plant species, wildlife habitat, and livestock.
It is acknowledged that certain noxious weeds have become so thoroughly established and are
spreading so rapidly on private, state, county, and federally owned lands that they may have been
declared by Oregon Revised Statue 569.350 to be a menace to public welfare. Steps leading to
eradication where possible, and intensive control are necessary. It is further recognized that the
responsibility for such eradication and intensive control rests not only on the private landowner
and operator, but also the county, state and federal government.
Noxious Weed Control Rating System
Noxious Weeds, for the purpose of this system, shall be designated "A", "B" or "c"
1. An "A" designated weed is the highest priority noxious weed designated by the
Deschutes Weed Board as a target weed species. The Weed Control District will comply
with a state wide management plan and/or implement a county wide plan for intensive
control and monitoring. An "A" rated weed may also be a weed of known economic or
ecological importance which occurs in small enough infestations to make eradication or
containment possible; or one that is not known to occur here, but its presence in
neighboring counties make future occurrence here seem imminent.
Action: Infestations are subject to intensive eradication, containment or control when and
where found.
2. A "B" designated weed is a weed of economic importance or which is limited in
distribution in the County. Intensive control will occur at the County level as resources
and situations allow.
Action: Intensive control, containment and monitoring.
3. A "C" designated weed is a weed that has the potential to cause economic or ecological
harm to agriculture, recreation, wildlife and transportation systems and is locally
abundant.
Action: Control and monitoring by the landowner is recommended.

The Board of County Commissioners' of Deschutes County, Oregon ("Board") has
declared that Deschutes County, described in ORS 201.090, to be a Weed Control

The Board appointed a County Weed Inspector who has the power to enforce Deschutes
County Code Chapter ("DCC") 8.35 and ORS 569.350 to 569.495, including the right to
enter upon land or premises and destroy noxious weed or control them in such manner as
will destroy all seeds of such noxious weeds. The County Weed Inspector is authorized
to place liens upon real property to recoup the expenses (including the wages ofthe Weed
inspector) necessarily incurred in the destruction of noxious weeds.
Every person, firm or corporation owning or occupying land within Deschutes County
shall destroy or prevent the seeding on such land any noxious weeds within the meaning
ofDCC 8.35 and ORS 569.350 to 569.495 or declared to be noxious by the Board. No
weed declared noxious shall be permitted or allowed to produce seed and/or spread by the
owner or occupier of land within the Deschutes County Weed Control District.
