HomeMy WebLinkAbout81-037I va 40 PAGUE 405 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Ordinance Amending Ordinance No. PL -15, Deschutes County ) Zoning Ordinance of 1979; ) Zoning Certain Property Forest ) Use (F-3) Zone; and Declaring , L- E an Emergency. ) _ 1 tr 1981 ORDINANCE NO. 81-037 ROSEMARY PATTERSO DESCHUTES COUNTY CLERK WHEREAS, Ordinance No. 81-224 amended the Sisters Urban Area Comprehensive Plan Map, and deleted certain property formerly within the Sisters Urban Growth Boundary; and WHEREAS, it is necessary to zone that property formerly within the Sisters Urban Growth Boundary; and WHEREAS, notice of hearing was given in accordance with law; and WHEREAS, the Deschutes County Planning Staff has recommended that the property be zoned Forest Use (F-3) Zone; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. To amend Ordinance No. PL -15, Deschutes County Zoning Ordinance of 1979, to zone certain property Forest Use (F-3) Zone, for the parcel of real property described as: Tax Lots 900 and 1000, Section 5, Township 15 South, Range 10 East of the Willamette Meridian, Deschutes County, Oregon, consist- ing of 80 acres; and depicted on the map marked Exhibit "A," attached hereto and by this reference incorporated herein. Section 2. To adopt the Board of County Commissioners' findings and conclusions, marked Exhibit "B," attached hereto and by this reference incorporated herein. Section 3. This Ordinance being necessary for the immediate preservation of public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. Legal Findings A. The subject property was previously zoned UAR-10, Urban Area Reserve and Forest Reserve on the Sisters Urban Area Comprehensive Plan and Zoning Map. B.. The subject property was subsequently removed from the Sisters Urban Growth Boundary in February 1981 by County Ordinance 80-224. C. The subject property now lies within the County Comprehensive Plan but remains un -designated. D. The Deschutes County Year 2000 Comprehensive Plan has been acknowledged; however, the Sisters Urban Area Comprehensive Plan is on a 120 day continuance order. II. Basic Findings A. The subject property is eighty (80) acres in size. B. The subject property is presently vacant. C. The subject property is in two 40 acre parcels, the northerly parcel is owned by Brooks Resources and the southerly parcel is owned by the U.S. Forest Service, D. The subject property is bordered on the north and west by F-2 (Forest Use); on the south by EFU-20 (Exclusive Farm Use) and the east by UAR-10 (Urban Area Reserve). III. Forest Resource Findings A. Localized information on forest land productivity in the immediate Sisters area, suggest the following: 1) The main determinant of forest land productivity is water levels. The number of inches per year in and around Sisters is 12"-13" which is adequate to sustain juniper and sagebrush. 2) The Society of American Foresters defines soil productivity is the ability to produce 20 cu. ft./acre/year. 3) The U.S. Forest Service Soil Resource Inventory was originally designed as a broad-based planning tool, and the degree of resuolution or accuracy is plus or minus 40 acres. 4) Regeneration of this area would be difficult and expensive due to the low amount of annual waterfall. The site exhibits the following timber qualities according to the Deschutes National Forest Soil Resource Inventory: --The approximately 60 acres on the north portion of the subject property is classified as Mapping Unit 37, Productivity Class 5 and 6 with a Site Index of 60 to 85 for Ponderosa Pine. --The approximately 20 acres not within the 5 and 6 class is within Mapping Unit 36 and is a non-productive soil type. IV. Conclusion and Recdmmendation This area exhibits marginally productive forest qualities, which in the opinion of Sisters Siviculturist, Michael Znerold, would not constitute economically productive land. Given the subject property's close proximity to the Sisters Urban Growth Boundary and the very marginal nature of the annual rainfall and soil type to maintain commercial forest activities, staff recommendation is to zone this area F-3.
