That Ordinance No. PL -17, Sisters Urban Growth Boun ary Zoning Ordinance, as amended, is further amended in accordance with Exhibit "A," attached hereto and by this reference incorporated herein. Section 2. That the amended Sisters Urban Growth Boundary Zoning Map, marked Exhibit "B," attached hereto and by this reference incorporated herein, is hereby adopted as the Sisters Urban Growth Boundary Zoning Map. Section 3. That the findings marked Exhibit "C," attached hereto and by this reference incorporated herein, are hereby adopted. Section 4. This Ordinance being necessary for the immediate preservation of public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect its passage. EXHIBIT "A" The following amendment is made to the Sisters Urban Area Zoning Ordinance, Deschutes County Ordinance No. PL -17, in order to comply with statewide planning goals and fulfill the acknowledgement require- ments set forth by the Land Conservation and Development Commission. New material is underlined; material to be deleted is contained in brackets:[ ]. Section 20. CONDITIONAL USE PERMITS. page 36 (3) General Conditional Use Permit Criteria. (A) That the location, size, design and operation characteristics of the proposed non-residential use are such that it will have minimal adverse impact on [the property value, livability and permissible development of] the surrounding area. Consideration shall be given to compatability in terms of scale, coverage and density, to the alteration of traffic patterns and the capacity of surrounding streets, and to any other relevant impact of the proposed non-residential use. (B) That the site planning of the proposed non-residential use will, as far as reasonably possible, provide an aesthetically pleasing and functional environment to the highest degree consistent with the nature of the use and the given setting. Section 29. SITE PLAN APPROVAL. page 52 (1) Purpose. The purpose of Site Plan Aqproval is to insure compliance with the objectives and provisions of this ordinance and the Comprehensive Plan, where development may cause a conflict between uses in the s.ame, or adjoining districts, by creating unsightly, unheathful, or unsafe conditions, thereby adversely affecting the public health, safety, and general welfare. The purpose of this section is to influence location and design o the proposed use rather than to deny a use allowed within the zone. In considering a site plan, the Planning Commission shall take into account the impact of the proposed development on nearby properties, on the capacity and circulation of the street system, on the capacity of the utility and service systems, on land value and development potential of the area, and on the appearance of the street and the community. The Planning Commission may require the following, in addition to the minimum requirements and standards of this ordinance, as a condition of the Site Plan Approval. VOL 4 A,,;F 4 7 a EXHIBIT "C" FINDINGS OF FACT IN SUPPORT OF LEGISLATIVE AMENDMENTS TO ORDINANCE NO. PL -17, SISTERS URBAN GROWTH BOUNDARY ZONING ORDINANCE The amendments to the Sisters Urban Growth Boundary Zoning Ordinance, Ordinance No. PL -17, bring the Zoning Ordinance into compliance with State Land Use Goals 2 and 5, as set out below. 1. The Zoning Ordinance is in compliance with Goal 2, Land Use Planning, because all areas within the Urban Growth Boundary are now zoned, and amendments to the Zoning Map distinguish between UAR-22 and UAR-10 Zones. 2. The Zoning Ordinance is in compliance with Goal 10, Housing, because the amendments assure that needed mobile homes and multiple -family dwellings are subject only to clear and objective standards in the conditional use and site design review process.
