WHEREAS, William E. Jaqua proposed the rezoning of certain
property from Light Industrial (M-1) Zone to Heavy Industrial
(M-2) Zone; and
WHEREAS, notice of hearing was given in accordance with law;
and
WHEREAS, the Hearings Officer held a hearing on the proposed
zone change on April 20, 1982; and
WHEREAS, the Hearings Officer recommended that the property
be rezoned from Light Industrial (M-1) Zone to Heavy Industrial
(M-2) Zone by decision dated April 26, 1982; and
WHEREAS, the decision of the Hearings Officer has not been
appealed to the Deschutes County Planning Commission; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. To amend Ordinance No. 80-201, Redmond Urban Area
Zoning Ordinance of 1980, to change the zoning from Light Indus-
trial (M-1) Zone to Heavy Industrial (M-2) Zone for the parcel of
real property described as:
Tax Lots 100 and 101, Section Twenty Nine
(29), Township Fifteen (15) South, Range
Thirteen (13) East of the Willamette
Meridian, Deschutes County, Oregon;
and depicted on the map marked Exhibit "A", attached hereto and by
this reference incorporated herein.
Section 2. To adopt as the Board of County Commissioners
Findings and Conclusions, the Findings and Decision of the

Hearings Officer dated April 26, 1982, relating to the Zone Change
Application Z-82-2, marked Exhibit "B", attached hereto and by
this reference incorporated herein.
Section 3. This Ordinance being necessary for the immediate
preservation of public peace, health and safety, an emergency is
declared to exist, nd this Ordinance takes effect on its passage.

Approval
The public hearing was held in Redmond, Oregon
on Tuesday, April 2.0, 1982 at 7:00 P.M. An
oral decision was rendered at that time.
In order to receive approval of this request
the applicant must meet the criteria set forth
in Redmond Urban Zoning Ordinance 80-201 and
the Redmond Urban Area Comprehensive Plan.
1. LOCATION:
The subject property is located southwest of the Redmond
Airport, south of Airport Way, and east of Highway 97. The
property is further described as Tax Lots 100 and 101,
Township 15 south, Range 13 east, Section 29.
2. ZONE:
The property is located within M-1, Light Industrial zoning.
3. COMPREHENSIVE PLAN DESIGNATION:
The property is designated as Industrial on the Redmond Urban
Area Comprehensive Plan and Zoning map.
4. SITE DESCRIPTION:
The subject parcel is approximately 56.7 acres in size and
lies within the Redmond Urban Growth Boundary. The topography
is slightly rolling with a vegetative cover of sagebrush and
juniper trees.

CONCLUSIONS:
The applicant has addressed the criteria set forth in the Redmond
Zoning Ordinance 80-201 and the Redmond Urban Area Comprehensive
Plan as follows:
This proposed change of zoning involves approximately 55.7 acres
located east of the railroad tracks on the south edge of the
Redmond Urban Growth Boundary. This is one of the largest parcels
in the Redmond area which that is desiganted as Industrial under
the Comprehensive Plan. The property is located in the approach
of runway 4/22 placing it in a higher noise area than other
industrial properties. The property is buffered by a railroad and
a stockyard on the west, on the south by open State land, to the
east by County lands, and to the north by City and private lands.
There are no residential developments located in close proximity
to the subject property.
One of primary goals and objectives of the Redmond Comprehensive
Plan is to provide a sound basis for orderly and efficient
urbanization by establishing proper relationships between
residential, commercial, industrial, public and open land uses and
transportation uses. The subject property was zoned industrial
prior to the adoption of the Redmond Comprehensive Plan. The
property is relatively isolated and contains a warehouse,
approximately 22,000 square in size. The property is bordered by
800 feet of railroad frontage and stock yard to the west. The
State and County lands adjoin the property from the south and
east. To the north lies land owned by the City of Redmond. The
Redmond Airport and runway 4/22 are also located to the east of
the property.
The property is within the Redmond Urban Growth Boundary and has
the potential for City water and sewage service. Any major
development on this parcel will require a site plan approval under
County and City Ordinances. In addition, any problems created by
excessive smoke, noise or dust or gas are prohibited under the
ordinances.
The Comprehensive Plan supports the General Industrial designation
for the area being rezoned. The Comprehensive Plan and map will
not be altered by this change.
The previous mentioned plans and ordinances encourage the
broadening of opportunities for economic expansion and
deversification, while at the same time the plan and zoning
ordinance provide restrictions on uses to ensure compatibility.
Proximity of the subject property to the railroad, highway and air
transportation makes this an effective location while buffers
surrounding the property are sufficient to minimize potential
conflicts with surrounding land uses.

DECISION: APPROVAL
DATED this day of April, 1982.
This decision becomes final fifteen days after the date mailed,
unless appealed to the Planning Commission by a party of interest.
