4.010, 4.020, 4.030 and 4.040
of Ordinance No. PL -15,
Deschutes County Zoning
Ordinance of 1979, to Permit
Pre-existing Dwellings as
Ranch Hand Residences in the
Exclusive Farm Use Zones; and
Declaring an Emergency.

WHEREAS, the County Planning Commission has recommended to
the Board of County Commissioners that pre-existing dwellings
be allowed as ranch hand residences; and
WHEREAS, the utilization of a pre-existing dwelling as a
ranch hand residence will allow the owners of property to con-
struct a new permanent residence on the same property where a
residence exists; and
WHEREAS, notice of hearing was given in accordance with law;
and
WHEREAS, the Board of County Commissioners held a hearing on
June 1, 1983; and
WHEREAS, the Board of County Commissioners found that the use
of pre-existing dwellings as ranch hand residences would further
the purposes of the Exclusive Farm Use Zones and should be
permitted; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. Section 4.010(3) of Ordinance No. PL -15,
Deschutes County Zoning Ordinance of 1979, is amended by the
addition of new subsection (N), which reads:
"(N) Pre-existing dwelling as a ranch hand residence,
provided there shall not be more than one such
conditional use permitted for each 20 acres in
the farm unit and the Hearings Body finds that
the occupant of the dwelling will be an employee
of the owner, or an immediate family member,
engaged in the farm operation. No parcel of less
than 20 acres shall be considered a farm unit for

the purpose of this subsection unless it is
demonstrated to the Hearings Body that a smaller
land unit is a viable farm unit."
Section 2. Section 4.020(3) of Ordinance No. PL -15,
Deschutes County Zoning Ordinance of 1979, is amended by the
addition of subsection (N), which reads:

Section 3. Section 4.030(3) of Ordinance No. PL -15,
Deschutes County Zoning Ordinance of 1979, is amended by the
addition of subsection (N), which reads:

Section 4. Ordinance No. PL -15, Deschutes County Zoning
Ordinance of 1979, is amended by the addition of the following new
subsection (0-) at the end of Section 4.040(3):
"(N) Pre-existing dwelling as a ranch hand residence,
provided there shall not be more than one such
conditional use permitted for each 20 acres in
the farm unit and the Hearings Body finds that
the occupant of the dwelling will be an employee
of the owner, or an immediate family member,
engaged in the farm operation. No parcel of less
than 20 acres shall be considered a farm unit for
the purpose of this subsection unless it is
demonstrated to the Hearings Body that a smaller
land unit is a viable farm unit."

Section 5. This Ordinance being necessary for the immediate
preservation of public peace, health and safety, an emergency is
declared to exist, and this Ordinance takes effect on its passage.
