WHEREAS, persons who owned handicapped -accessible mobile
homes prior to the establishment of new regulations on mobile
home placement enacted by Deschutes County Ordinance No. 89-004
on February 22, 1989, are subject to a greater burden than other
mobile home owners in complying with the new ordinance; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS, as follows:
Section 1. That an exception may be granted by the Planning
Director to allow a mobile home to be placed in a subdivision
which does not meet the mobile home placement criteria estab-
lished in Section 5.145(B) or (C) of Ordinance No. PL -15 where
all of the following conditions exist:
A. The mobile home is specifically designed or has been sub-
stantially modified for wheelchair or handicapped access.
(Handicapped -accessible mobile home).
B. There are mobile homes in the subdivision located within
one-quarter mile of the lot upon which the mobile home will
be placed.
C. The handicapped -accessible mobile home and lot upon which
the mobile home is to be placed were purchased by the
applicant prior to the adoption of Ordinance No. 89-004 on
February 22, 1989.
Section 2. This Ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this Ordinance takes effect on its
passage.
