WHEREAS, the Board of County Commissioners on July 11, 1990,
adopted certain amendments to the Deschutes County Comprehensive
Plan and Zoning Ordinance concerning surface mining, including a
revised inventory of surface mining sites and ESEE decisions
whereby certain sites in the County were designated for surface
mining zoning; and
WHEREAS, the Board of County Commissioners in Ordinance
No. 90-029 amended County zoning maps to reflect the ESEE surface
mining determinations and found as set forth in findings 21 and
25 therein and incorporated herein by reference, that certain
sites or portions thereof currently zoned SM or SMR and located
outside of any urban growth boundary were not included on the
revised mineral and aggregate inventory for Deschutes County
(referred to hereafter as "Residual" SM or SMR sites) and accord-
ingly should rezoned to some more appropriate zoning; and
WHEREAS, by Section 4 of Ordinance No. 90-029, the Board of
County Commissioners directed that such rezoning should occur on
or before September 30, 1990; and
WHEREAS, the Deschutes County Planning Department has
reviewed all residual SM and SMR sites to determine and make
findings on what the appropriate zoning for such sites should be;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. The sites identified in Exhibit "A," attached
hereto and by this reference incorporated herein, are rezoned
from SM or SMR, as the case may be, to F-2, while retaining any
overlay or combining zone.
Section 2. The sites identified in Exhibit "B," attached
hereto and by this reference incorporated herein, are rezoned
from SM or SMR, as the case may be, to EFU-320, while retaining
any overlay or combining zone.
Section 3. The sites identified in Exhibit "C," attached
hereto and by this reference incorporated herein, are rezoned

from SM or SMR, as the case may be, to EFU-80, while retaining
any overlay or combining zone.
Section 4. The sites identified in Exhibit "D," attached
hereto and by this reference incorporated herein, are rezoned
from SM or SMR, as the case may be, to EFU-40, while retaining
any overlay or combining zone.
Section 5. The sites identified in Exhibit "E," attached
hereto and by this reference incorporated herein, are rezoned
from SM or SMR, as the case may be, to EFU-20, while retaining
any overlay or combining zone.
Section 6. The site identified in Exhibit "F," attached
hereto and by this reference incorporated herein, is rezoned from
SM or SMR, as the case may be, to OS&C, while retaining any
overlay or combining zone.
Section 7. The sites identified in Exhibit "G," attached
hereto and by this reference incorporated herein, are rezoned
from SM or SMR, as the case may be, to MUA-10, while retaining
any overlay or combining zone.
Section 8. The sites identified in Exhibit "H," attached
hereto and by this reference incorporated herein, are rezoned
from SM or SMR, as the case may be, to RR -10, while retaining any
overlay or combining zone.
Section 9. The sites identified in Exhibit "I," attached
hereto and by this reference incorporated herein, are rezoned
from SM or SMR, as the case may be, to RSR -5.
Section 10. In support of the rezoning decisions set forth
in Sections 1 through 10 of this Ordinance, the Board adopts the
Findings included in Exhibit "A" through "I," respectively.

EXHIBIT "A"
Based upon the findings set forth herein, the Deschutes County
Planning Department recommends and finds that the sites listed on
pages A-2 through A -7 -and shown on the zoning maps on pages A-8
through A- N(v should be rezoned from SM or SMR, as the case may
be, to F-2.
Findings:
1. The Deschutes County Comprehensive Plan Map designates the
areas including these sites for forest use.
2. The sites are composed of existing and/or potential forest
lands, as shown in the resource element of the County's
comprehensive plan, suitable for commercial forest use.
3. The sites do not encompass forest land needed or specified
in the Deschutes County Comprehensive Plan for watershed
protection, wildlife and fisheries habitat, unusual or
unique recreational opportunities (i.e. wilderness areas).
4. Under the Deschutes County Comprehensive Plan, F-2 zoning,
with 40 -acre minimum lot sizes, is the appropriate zone for
commercial forest land.
5. The zoning surrounding these sites is F-2.

should be rezoned from SM to RSR -5 (Rural Service Center Residen-
tial - 5), while retaining any overlay or combining zone.
Findings:
1. The Deschutes County Comprehensive Plan Map designates the
area including these sites for rural service center use as
the Tumalo Rural Service Center.
2. The Comprehensive Plan for the Tumalo Rural Service Center
provides that lower density (5 -acres lots) residential areas
within the Tumalo rural service center be located on the
fringes of the community of Tumalo.
3. Sites 200 and 201 are located on the fringes of the Tumalo
rural service center area and are bounded by RSR -5 zoning.
4. Under the Deschutes County Zoning Ordinance, PL -15, the RSR -
5 zone with 5 -acre minimum lot sizes is the lowest density
residential zoning provided for rural service centers.
5. Under the Deschutes County Comprehensive Plan and the
Deschutes County Zoning Ordinance, these areas should be
zoned RSR -5.
