WHEREAS, pursuant to the requirements of the Oregon har�t�nent
of Land Conservation and Development (LCDC) the County I-, Ten
required to review and update its County Comprehensive Lan0°,0selan
and implementing ordinances, including for Agricultural ,dg,,, to
assure continuing compliance with Statewide Land Use Planng Gals;
and
WHEREAS, pursuant to Ordinances 92-060 and 92-061, adopted on
this date as part of periodic review, Deschutes County has determined
that it should reconfigure its Exclusive Farm Use (EFU) Zones into
new subzones; and
WHEREAS, it is necessary to amend the zoning maps of Title 18,
the Deschutes County Zoning Ordinance, in order to effect such
changes; and
WHEREAS, public hearings have been held in furtherance of this
objective in conformance with state law before the Deschutes County
Planning Commission and the Board of County Commissioners for
Deschutes County; and
WHEREAS, the Board of County Commissioners has considered the
recommendations of the Planning Commission and the public; now
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
ORDAINS AS FOLLOWS:
Section 1. MAPPING OF NEW EFU SUBZONES. Title 18 of the
Deschutes County Code, the County Zoning Ordinance, as amended, is
further amended to replace the existing EFU zoning districts shown on
the zoning maps with new EFU subzones, as shown on the map labelled
"Deschutes County Exclusive Farm Use Zones" dated and signed on this
date by the Board of County Commissioners and by this reference
incorporated herein.
Section 2. FINDINGS. The Board of County Commissioners adopts
as its findings in support of this amendment the text amendments to
the resource element of the Comprehensive Plan adopted by Ordinance
91-063 and by this reference incorporated herein and the findings
attached as Exhibit "C" to Ordinance 92-062 adopted on this date and
by this reference incorporated herein.

Section 3. SEVERABILITY. The provisions of this ordinance are
severable. If any section, sentence, clause, phrase, area, overlay
or other separable part of this ordinance or any exhibit thereto is
adjudged to be invalid by a court of competent jurisdiction, that
decision shall not affect the validity of the remaining portions of
this ordinance or any exhibit thereto.
Section 4. REPEAL OF ORDINANCES AS AFFECTING EXISTING
LIABILITIES. The repeal, express or implied, of any ordinance,
ordinance provision, or code section by this ordinance shall not
release or extinguish any duty, condition, penalty, forfeiture, or
liability incurred under such ordinance, unless a provision of this
ordinance shall so expressly provide, and such ordinance repealed
shall be treated as still remaining in force for the purpose of
sustaining any proper action or prosecution for the enforcement of
such duty, condition, penalty, forfeiture, or liability, and for the
purpose of authorizing the prosecution, conviction and punishment of
the person or persons who violated the repealed ordinance.
Section 5. EMERGENCY AND EFFECTIVE DATE. This Ordinance being
necessary for the immediate preservation of the public peace, health
and safety, an emergency is declared to exist, and this Ordinance
takes effect on December 7, 1992.
