WHEREAS, the Deschutes County Planning Commission, after review
conducted in accordance with applicable law, has recommended approval
of the proposed Text Amendment to Title 18.
WHEREAS, after notice was given and hearing conducted in
accordance with applicable law, the Board of County Commissioners
have considered the recommendations of the Planning Commissioners
recommendation; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
ORDAINS as follows:
Section 1. Section 18.108.020 B. (b) of Title 18 is amended as
follows (with deletions bracketed and additions bold and underlined):
b. Conditional Uses. The following conditional uses may be
permitted subject to Chapter 18.128 of this title and a
conditional use permit.
1. Parks and recreation facilities, fire stations,
libraries, museums; but not including storage or repair
yards, warehouses and similar uses.
2. Utility substations or pumping stations with no equipment
storage and no sewage treatment facilities.
3. Off-street parking lots when contiguous to a less
restrictive zoning district.

Buildings over 30 feet in height.
Community building or church.

6. Temporary sales office for on-site dwelling units.
7. Time-share unit or the creation thereof. 0120--0046
8. Excavation, grading and fill and removal within the bed
and banks of a stream or river or in a wetland subject to
Sections 18.120.050 and 18.128.040 (W).
Section 2. This Ordinance is supported by the staff report
attached hereto as Exhibit "A" and by this reference incorporated
herein.
Section 3. This Ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency is
declared to exist, and this Ordinance takes effect on its effective
date.

The applicant, Shepherd of the Mountain Lutheran Church is
requesting a Text Amendment to allow churches within the
Multiple-Family/Planned Community Zone. The purpose of the
request is to construct a church on a 3.06 -acre parcel zoned
Planned Community/ Multiple -Family Residential Zone (PC/RM).
Other Conditional Uses listed in Section 18.108.020.B (b)
include parks and recreation facilities, fire stations,
libraries, and museums. Given the impacts created by those
uses to surrounding residential properties, including traffic
and noise, a church would generate similar impacts. Those
concerns would be addressed through the conditional use
permit process.
Based on the Sunriver Declaration Annexing the RM -11 Church
Site to Meadow Village, dated March 31st, 1989, the subject
property is included within Meadow Village, one of the
"villages" originally contemplated by the developer. Each
"village" has been designated through development plans as
residential within the context of the Consolidated Plan of
Sunriver. Based on this annexation declaration, the subject
property has been described as a church site since 1989, to
provide church amenities to the property owners and guests.
The Planned Community Section, 18.108 of Title 18, Deschutes
County Zoning Ordinance, has been written to comply with the
Consolidated Plan of Sunriver (1982). Staff finds the
addition of churches as a use allowed with a conditional use
permit within the PC/RM Zone, in conformity with the intent
of the 1989 annexation, the Sunriver Master Plan of 1982 and
Title 18.
Section 18.108.020 (A), Single -Family Residential (RS
District) of Planned Community Zone does not list churches as
a use allowed with a Conditional Use Permit. However, as a
comparable, Title 19, the Urban Growth Boundary Zoning
Ordinance allows churches as conditional uses within the
residential zones including, Urban Low Density Residential
(RL), Urban Standard Residential (RS), Urban Medium Density
Residential (RM) and Urban High Density Residential (RH).
