Building Safety
The Building Division continues to
experience a significant surge in single-
family permit applications, as well as the
usual assortment of accessory and specialty
permits. To help manage the workload, a
full-time position was granted and Rainer
Doerge has been hired. Rainer has been
working part time from our on-call list and
has been training in plan review and field
inspections. He is a licensed journeyman
plumber and has been working and living in
the area for several years. Welcome, Rainer!
All of the Model Codes that comprise the
State Building Code are being upgraded
this year, which means a lot of time training
and attending required Code Change
classes. The typical cycle for this has been
every three years, but the State is moving
to a six-year Code cycle, so the Codes can
be used for a more reasonable period of
time.
The rebuild of the highway through
downtown Sisters is 98% complete and has
substantially improved the appearance of
the highway. A small water park with a
performance stage has been built behind
the Shell station, which includes a public
restroom for the convenience of the hordes
of tourists who love Sisters.
Residential activity in Redmond is also on
the rise, along with multiple small
commercial projects—especially breweries
and coffee houses.
Some may remember Rex Turner, who has
moved up the state food chain and created
an opening here which has been filled by
Michael LeBeau, formerly of Pocatello,
Idaho. Michael takes over Rex’s former
position of Regional Coordinator for the
State Building Codes Agency. The position
works with Building Officials throughout
the area to help gain consistency in the
application of the Building Code.

People
The greatest places we work, live, visit, and recreate are often
defined by the people who make the experiences memorable and
meaningful. We are experiencing mixed emotions in the Community
Development Department (CDD) with significant changes in “our”
people who have and will shape our organization, our community,
and our lives. Today, Principal Planner Kevin Harrison retired after
serving Deschutes County for nearly 25 years. We already miss his
extraordinary expertise, institutional knowledge, calm demeanor in
any and every situation, and so much more. Permit Technician Marti
Mello has also announced she will retire at the end of September.
Marti has served Deschutes County for 15 years. Her exceptional
customer service skills, abilities to navigate any and all codes and
permits, and truly outstanding service in our La Pine office will be a
significant loss for everyone. We wish Kevin and Marti the very best!
In the midst of these retirement
announcements over the past month,
I experienced one of my best work
days ever. It was the day Senior
Planner Anthony Raguine returned to
CDD from the Deschutes County
Sheriff’s Office (DSO). I owe a huge
thanks to DSO for taking good care of
him for us. We are thrilled to have him
back. I am also delighted to welcome
Building Inspector Rainer Doerge to
our team as a permanent, full-time
member. Rainer has served us very
well as an on-call inspector and
performed superbly.
It is my pleasure to also welcome new Planning Commissioner Susan
Tunno (Redmond area). Commissioner Tunno joins the Commission
with a background in real estate and a deep understanding of rural
issues on both sides of the Cascades. She is already a true asset to
Deschutes County. Her term is through June 30, 2018.
Turning from our internal transitions to our customers, September
2014 will be one of the busiest months on record for CDD-related
Commissions (Board and Planning Commission), Advisory Committees
(Brownfields and Transferable Development Credits) and community
meetings. Please be sure to read the following newsletter articles
and monitor the County’s website for these meetings or give us a
call – we’re happy to help and hope to see you in September.

Environmental Soils
Oregon Septic Smart - SepticSmart Week
September 22-26, 2014: The Oregon
Department of Environmental Quality (DEQ) is
working with industry professionals to inform
Oregonians about their septic systems - the
importance of septic systems, septic system
inspections, and proper septic system maintenance.
Oregon SepticSmart is intended to provide
Oregonians with easy access to important
information about their septic systems and easy
access to industry professionals that perform septic
system inspections (Existing System Evaluations).
It is important to know what you own, what you are
buying and how to care for it. Understanding more
about your septic system will protect your
investment, protect community health, protect
drinking water and protect the environment.
Having a septic system inspection at the time of
property transfer is voluntary, but it is a good idea.
There are mandatory requirements when an
inspection is performed. A septic system inspection
must be performed by one of the following:
Certified Installer, Certified Maintenance Provider,
Licensed Environmental Health Specialist, Licensed
Wastewater Specialist, Licensed Professional
Engineer, NAWT Certified Inspector. Also, the
findings from the septic system inspection must be
reported on the DEQ Existing System Evaluation
Report form.

Building Official Dave Pedersen
continues participating in a State-
developed task force, reviewing and
addressing Code requirements which are not
efficient or do not fit requirements and
conditions in rural Oregon. The “one size fits all”
philosophy of Code administration has been
shown to be limited and unreasonable in the
context of remote and rural communities. Recent
legislation is enabling the State Building Codes
Division to reach out and, with the help and input
of local Building Officials, create more efficient and
cost effective rules and processes that will, among
other things, help with economic development and
streamline permitting processes. Off-the-shelf
engineered drawings for accessory structures are
among the first developments being offered.
Coordinated Services
& Code Enforcement
La Pine Satellite Office Relocated: The La Pine
satellite office has been relocated to the La Pine
City Hall, effective August 19, 2014. This move
will provide the opportunity for one-stop
shopping for the customers located inside the
city limits of La Pine, now that the City of La Pine
has land use application authority. Customers
will be able to apply for all necessary permits in
one location! Please feel to stop by and check
out our new office; hours will be on Tuesdays
from 9:00 a.m. to 4:00 p.m. The La Pine City
Hall address is 16345 Sixth St, La Pine and our
phone number is (541) 536-5852.
Code Enforcement Procedures Manual: A
Board of County Commissioners hearing on the
draft update of the Community Development
Department Code Enforcement Policy and
Procedures Manual was conducted on August 27,
2014. The oral record was closed at the end of
the hearing. The written record remains open for
seven days. Key longstanding policies (complaint
policy, compliance policy, and penalties and
fines) have been identified for review and
deliberation. The proposed draft update,
reflective of current practice, is available for

Marti Mello is Retiring! Marti has announced
her retirement after 15 years of service to
CDD. During her tenure, Marti has worked as a
Permit Technician and an Assistant Planner. She
has staffed the La Pine satellite office for many
years and is very well liked by the La Pine
Community. Marti’s last day will be
September 30.
Current Planning
Thornburgh Destination Resort Appeal
(A-13-8): Loyal Land, LLC, filed an application
asking the County to hold a hearing on the
remand from LUBA on the issue of whether the
conceptual master plan (CMP) for the resort has
been initiated. The Hearings Officer found that the
CMP had not been initiated and that the CMP is
void. Loyal Land appealed that decision to the
BOCC (A-14-1). The BOCC held a hearing on June 4,
2014, and rendered an oral decision by a 2-1 vote
on July 7, 2014, holding that the CMP has been
initiated. The BOCC issued its written decision on

Sunriver Service District Plan Amendment and
Zone Change (PA-14-1, ZC-14-1): Sunriver Service
District applied for a Plan Amendment and Zone
Change for a 4.28-acre portion of a larger 332-acre
parcel located along the eastern boundary of the
Sunriver Urban Unincorporated Community. The
request included changing the plan designation
and zoning of the 4.28-acre portion from Sunriver
Forest District (SUF) to Sunriver Utility District
(SUU), adding a Limited Use (LU) Combining Zone,
and taking an exception to Goal 4, Forest Lands. A
public hearing was held before the BOCC on
August 13, 2014. The BOCC approved the
proposal on August 27, 2014, and adopted the
associated Ordinances 2014-021 and 2014-022.
The ordinances will become effective in 90 days.
The amendment would allow for a fire training
facility for the Sunriver Fire Department.

Sunriver Text Amendment (TA-14-5): Busch Law
Firm, PLLC, for AT&T, applied to amend the
Sunriver Community General District Zone (SUCG)
to allow wireless telecommunication facilities as a
conditional use. The BOCC will hold a public
hearing on Wednesday, September 24, 2014. Staff

TA-14-2: Gary Knight and Alex Robertson applied
for a Text Amendment to Chapter 18.32, Multiple
Use Agricultural Zone (MUA-10) and Section
18.128.050 of Title 18 of the Deschutes County
Code (DCC) to allow potential creation of new
manufactured home parks in the MUA-10 Zone
adjoining the City of Bend Urban Growth Boundary
and lessen the requirements for expanding
existing manufactured home parks in
the same zone. The Planning Commission held
a work session regarding this text amendment
on June 12, 2014, and two public hearings
on July 10 and August 28.
The Planning Commission continued the hearing

NNP IV-NCR, LLC (“Newland”) Comprehensive Plan
Amendment (PA)-13-1/Zone Change (ZC)-13-1:
On April 28, the BOCC voted 2-1 to deny these
applications proposing to amend the Deschutes
County Comprehensive Plan designation from
Agriculture to Rural Residential Exception Area, and a
zone change from Exclusive Farm Use (EFU) EFU-TRB
to Multiple Use Agriculture (MUA)-10 for a 171-acre
parcel located near the intersection of Butler Market
and Hamby roads east of Bend. A County Hearings
Officer denied the applications on October 23, 2013.
After conducting public hearings in February and
March, the BOCC on April 28 found that the subject
property constitutes agricultural land based on the
criteria in Oregon Administrative Rules 660-033-0020
and directed staff to complete a written decision,
subject to its review and approval. The BOCC’s
written decision denying the applications was mailed
out on July 11, 2014. No appeal to the Land Use
Board of Appeals was submitted and the decision is

Central Oregon Irrigation District (COID) Text
Amendment (TA-13-4): COID applied to amend
Title 19 of Deschutes County Code, Section 19.20.020
to add as a use permitted outright in the SR-2.5 Zone,
the “operation, maintenance and piping of existing
irrigation systems operated by an Irrigation District,
except as provided in DCC 18.120.050.” The
Deschutes County Planning Commission held three
hearings on the proposed text amendment, on
February 13, March 13, and March 27, 2014.
Additionally, the Planning Commission conducted an
onsite tour of the proposed piping area on March 27.
On May 8, the Planning Commission made a
recommendation for denial of the text amendment
application to the BOCC.
The BOCC conducted a site visit to the Pilot Butte
Canal on June 30, 2014. The BOCC then held a public
hearing on the proposed text amendment on July 2.
The oral record was closed at the hearing, and the
written record was left open until July 16. The
applicant submitted a letter to the BOCC dated
August 13 requesting that the BOCC hold the text
amendment application in abeyance for a few months
to allow the applicant to pursue possible mediation
with opponents. The BOCC held a work session on
the applicant’s request for the abeyance on August
13th and voted to extend the review of
the application with a final decision by March 25,

Leading Edge Aviation Site Plan (A-13-4,
SP-13-7): On August 13, the BOCC
deliberated and verbally approved Leading Edge
Aviation's site plan approval (A-13-4, SP-13-7) to
establish an aviation fueling station at Bend
Airport. Opponents had previously appealed the
decision to LUBA and LUBA remanded the decision
back to the Hearings Officer for further

Tetherow Destination Resort Text Amendment
(TA-14-4): Tetherow Vacation Homes LLC has
applied for a Text Amendment (TA-14-4) to amend
Deschutes County Code Title 19 to change the
number of weeks overnight units in destination
resorts must be available for rental from 45 to
38. This change updates local code to meet state
law. A BOCC hearing date is tentatively scheduled
for September 15, 2014. Staff contact: William

Miller Tree Farm Subdivision and Conditional Use
(247-14-000242-CU/243-TP; 247-14-000244-CU/
245-TP; 247-14-000246-CU/247-TP; 247-14-
000248-CU/249-TP; 247-14-000250-CU/251-TP):
The Planning Division received five conditional use
permit and tentative plat applications to establish a
planned unit/cluster development (subdivision).
The proposal proposes 50 two-acre residential lots
and over 422 acres of permanently preserved open
space, most of which will be publicly accessible via
a comprehensive trail network. Staff is currently

Weston Investment Co. LLC Improvement
Agreement (247-14-000237-IA): Weston
Investment Co. LLC has applied to extend the
improvement agreement for required overnight
units at Tetherow Destination Resort. The BOCC
approved this request on August 27, 2014. Staff

Deschutes Junction Comprehensive Plan
Amendment and Zone Change (PA 14-2, ZC14-2):
The Deschutes County Hearings Officer held a
Public Hearing on August 19, 2014, on a Zone
Change and Plan Amendment to rezone 2.65 acres
of property from Exclusive Farm Use to Rural
Industrial located in Deschutes Junction (Tax
Map 16-12-26C, Tax Lot 107). Staff contact:

Long-Range Planning
Agricultural Lands Program: The Board of County
Commissioners directed the Community
Development Department (CDD) to conduct a public
outreach campaign to understand community,
stakeholder, and landowner opinions about
Deschutes County farm designations and land uses.
In May, the Planning Division conducted six
community conversations in locations throughout
the County. The meetings were held in Alfalfa, Bend,
Brothers, La Pine, Sisters, and Terrebonne. Each one
provided an overview of Deschutes County’s
agricultural lands program with details focusing on
its history, relevant Comprehensive Plan policies and
recent land use trends. Staff utilized a variety of
public engagement techniques to generate public
comments, including facilitated exercises and
questionnaires. An online survey was also made
available on the CDD website. In addition, staff
approached numerous organizations in the region,
offering to hold stakeholder meetings. A final report
summarizing the results of this public outreach
campaign can be downloaded at:

A joint BOCC-Planning Commission work session was
held on June 26, 2014, to discuss the public out-
reach results. Staff gave a presentation and fielded
questions from the Commissioners. The public was
also given an opportunity to comment. Prior to
determining the next steps of the project, the BOCC
directed staff to address issues raised at the meeting
and the previous public outreach campaign. A
second joint meeting is scheduled for September 25,
5:30 p.m. at the Deschutes Services Center, 1300
NW Wall Street, Barnes and Sawyer Rooms. Staff

Central Oregon Large-Lot Industrial Land Need
Analysis: Staff continues to coordinate with the City
of Redmond regarding a site owned by the Oregon
Department of State Lands (DSL) adjoining its Urban
Growth Boundary (UGB) as a plausible location for a
regional large-lot industrial campus. Redmond and
DSL are currently coordinating with Central Oregon
Intergovernmental Council (COIC) for an official
endorsement. Following its approval, DSL will initiate
a City/County UGB plan amendment. Staff contacts:

Destination Resort Map Amendments: On
September 2, CDD will initiate a press release
announcing a three-month window to accept
applications to amend Deschutes County’s
destination resort eligibility maps. The current
eligibility maps became effective
February 20, 2012. Oregon Revised
Statutes (ORS) 197.455(2) allow counties to
remap eligible lands for destination resorts
once every thirty (30) months. The deadline for
submitting an application to CDD is Monday,
December 1, at 5:00 p.m. Applications to remove
or add property to the eligibility maps must be
accompanied by the appropriate filing fee. All
applicants must demonstrate compliance with
Deschutes County Comprehensive Plan Policies
3.9.3(a), 3.9.3(b), 3.9.3(c), and 3.9.3(d). For
applications adding properties to the eligibility
map, applicants will also be required to
demonstrate consistency with the Transportation
Planning Rule (TPR) at Oregon Administrative Rule

Destination Resort Tracking: Staff is preparing
a table/matrix to monitor resort land use
histories, requirements and agreements, and
annual reporting obligations in coordination with
Goal 8 Destination Resort representatives. Staff
expects to conduct a work session with the
Planning Commission and BOCC later this fall.

Goal 11 (Sewer) Exception for Southern
Deschutes County: The Planning and
Environmental Soils Divisions continue to
support the Oregon Department of
Environmental Quality (DEQ) South Deschutes/
Northern Klamath County Groundwater
Protection Project. Staff anticipates a draft
burden of proof and map of the affected area
justifying a Goal 11 exception will be available
from the Department of Land Conservation and
Development (DLCD) and DEQ by the end of
September. DEQ and DLCD are interested in then
initiating a series of informal public review
meetings through February prior to commencing
a formal Goal 11 exception application and
public hearing process in Spring 2015. A
schedule of those informal meetings is
forthcoming. Planning staff continue working on
a Request for Proposals (RFP) to assess the
potential traffic impacts of the development of
nearly 1,500 high groundwater lots. The RFP is
expected to be issued later in the fall or early
winter. The traffic analysis is needed to comply
with the state’s Transportation Planning Rule

Historic Preservation (A-13-3 and
DR-13-6): Cline Falls Power Plant - PacifiCorp v.
Deschutes County, LUBA No. 2014-016. In
response to the BOCC’s Declaratory Ruling on the
Cline Falls Power Plant historic site in February
2014, PacifiCorp appealed the decision to the Land
Use Board of Appeals (LUBA). On August 1, 2014,
LUBA issued a Final Opinion and Order, remanding
the case back to the County for the BOCC to further
review the definition of “penstock.” The LUBA
decision was not appealed to the Court of Appeals.
Since this is a County-initiated declaratory ruling,
the County will determine when to start the remand

Historic Landmarks Commission (HLC): The
Deschutes County HLC will be visiting a number of
historic sites in Sisters Country on September 9,
2014, including stops in downtown Sisters, Camp
Polk Military Site, Cemetery and Homestead,
Freemont’s 12 Mile Tree Blaze and Tumalo Dam. For
those interested in attending, a detailed agenda

Historic Preservation Strategic Plan: On
September 2, CDD will initiate a press release
announcing the development of a historic
preservation strategic plan for rural Deschutes
County and the City of Sisters. The strategic plan
will provide a framework for shaping the rural
county and Sisters preservation programs and
services over the next five years and create a
blueprint for allocating Certified Local Government
(CLG) grant funding. Community workshops are
scheduled to receive public input on September 22
at Sisters City Hall from 6:00 to 8:00 p.m.;
September 23 at the Deschutes Historical Society in
Bend from 6:00 to 8:00 p.m.; and October 8 at the
Deschutes Services Center, 1300 Wall Street, Bend,
in the DeArmond Room, from 6:00 to 8:00 p.m.

Oregon Spotted Frog: On August 28,
the U.S. Fish and Wildlife Service
announced its decision to extend protection
to the Oregon spotted frog as a threatened
species under the federal Endangered Species
Act. The final rule designating critical habitat is
expected this fall. Once it is released, CDD will
schedule a work session with the BOCC and use a
matrix to discuss options for responding to critical
habitat from a land use standpoint. Staff contact:

Sage-Grouse: As a cooperating agency, staff
continues to participate with the Bureau of Land
Management (BLM), which last November released
a draft programmatic Environmental Impact
Statement (EIS) for federal land use and resource
management plan (RMP) amendments to
incorporate sage-grouse conservation measures in
Central and Eastern Oregon. Staff is also
participating with the Governor’s Office, Sage
Grouse Conservation Partnership. This involves
interagency and interstakeholder coordination on
issues related to sagebrush and sage grouse
habitat conservation on non-federal lands. The
State’s goal is to demonstrate that listing the sage-
grouse as a threatened or endangered species
under the federal ESA is unnecessary. The Final EIS
and Record of Decision (ROD) are scheduled for

Transferable Development Credit (TDC)
Advisory Committee: The TDC Advisory
Committee held its first meeting with Planning
Division and Environmental Soils staff on
August 21; the next meeting is scheduled for
September 11. The purpose of the committee is to
discuss the existing program in light of the City of
La Pine administering a zoning ordinance as it
pertains to the Neighborhood Planning Area and a
pending Goal 11 Exception for southern Deschutes

U.S. Environmental Protection Agency
Community-Wide Brownfield Assessment Grant:
The Community Development Department is
convening two meetings, one on September 17
at the Deschutes Services Center, 1300 NW Wall
Street, Bend, in the DeArmond Room, from
6:00 to 8:00 p.m.; and the other on
September 24 at Redmond City Hall,
716 SW Evergreen Avenue, Conference
Room A, from 6:00 to 8:00 p.m. for citizens to
learn about Deschutes County’s efforts to promote
Brownfield redevelopment.
Brownfields are properties where previous uses
such as former gasoline stations, dry cleaners,
and industrial operations may have left
contaminants behind. Brownfield redevelopment
often requires environmental site assessments and
regulatory review. To help property owners
navigate these processes and access resources
that can help pay for the assessments and review,
CDD secured a grant from the U.S. Environmental
Protection Agency (EPA) to provide environmental
site assessments for eligible properties, and give
technical assistance to property owners, citizens,
businesses and other stakeholders. Brownfield
redevelopment protects human health and the
environment, supports economic growth, and can be
an important tool to realizing property owners’
plans for their properties as well as the city’s plans
for housing, parks, and economic development.
Whether one is a property owner who has questions
regarding a property’s environmental condition, a
citizen who is curious about brownfields, or a
developer evaluating a project, this meeting may be
of interest and value to you. Speakers will include
representatives from Deschutes County and their
consulting team, Apex Companies LLC. More

Harper Bridge Access Task Force: Sunriver staff is
preparing a report on the group’s recommendations.
The report is expected to be completed in late
August or early September. Sunriver has
constructed a fence along its property line, but has
placed the fence across the 1908 John Peters public
right-of-way without County permission; the County
legal department has informed Sunriver and its legal
counsel of the County’s position. The fence has
restricted the area available for parking, so the Road
Department has placed signs requiring parallel
parking only. Additionally, the Road Department
has placed rumble strips across Spring River Road
and added signs to alert drivers they are
approaching an area with high levels of pedestrian

Bend Airport Zoning Map Amendment:
The Deschutes County Planning Commission
held a public hearing, deliberated, and
recommended approval of a City of Bend land
use application (247-14-000156-ZC) on
August 28. The application amends the zoning
map for the Airport Development (AD) Zone in
Deschutes County Code (DCC) 18.76 and its
subzones of Airfield Operations District (AOD),
Aviation-Related Industrial District (ARID), and
Aviation Support District (ASD). It also corrects a
procedural error from the 2003 adoption of the
subdistricts and the 2002 Bend Airport Master
Plan Update. A public hearing before the BOCC is
anticipated in late September or early October.
