Box 6005, Bend, OR 97708-6005 (541) 388-6575 cdd@deschutes .org www.deschutes.org/cd MEMORANDUM DATE: May 9, 2018 TO: Deschutes County Historic Landmarks Commission FROM: Zechariah Heck, Associate Planner Nick Lelack, AICP, Director Peter Gutowsky, AICP, Planning Manager RE: Overview of the May 14, 2018, Historic Landmarks Meeting The purpose of this memorandum is to provide an overview of the upcoming Deschutes County Historic Landmarks Commission (HLC) meeting on May 14, 2018. There are two items for the Commission to review, discuss and act upon. I. Central Oregon Canal Nomination The State Historic Preservation Office (SHPO) has asked the HLC to review a nomination of a section of the Central Oregon Canal to the National Register of Historic Places. The proposed district is located southeast of the City of Bend and generally bound by Ward Road to the west and Gosney Road to the east. The HLC has held two previous public meetings on April 16 and April 30 to review the nomination and receive public comments.1 The HLC was scheduled to deliberate and provide comments on the nomination during the May 7 meeting. However, there was not a quorum at the May 7 meeting so deliberations were postponed until May 14. As part of the review of the nomination, the local Certified Local Government (CLG) is afforded the opportunity to review and comment. Evaluation by the CLG is expected to be through the completion of the National Register Nomination Evaluation Sheet (Attachment) and, if necessary, a supporting narrative. Any recommendation by the HLC regarding the proposed nomination will be sent to the Board of County Commissioners (Board) as well as SHPO and the State Advisory Committee on Historic Preservation (SACHP). The Board may decide to comment on the application as well. To be considered by the SACHP, the evaluation and any additional comments must be submitted in advance of their meeting on June 22, 2018. It is suggested that Commissioners provide comments on each of the review criteria contained within the nomination evaluation sheet. Staff will record notes and create a draft version based on the HLC’s decision for the acting HLC chair to sign. During the April 30 HLC meeting (meeting minutes attached), the Commission decided to conduct deliberations on the nomination under the following format: 1) The Commission will discuss the nomination vis-à-vis each specific criterion, e.g., “Integrity”. 1 The HLC also reviewed and commented on a previous version of the Central Oregon canal nomination in October 2017. 2 2) Once each Commissioner feels that their comments have been addressed, the Chair will call for a vote/motion on the specific criterion. The possible votes are in support (the HLC feels that the nomination is “OK”) or not in support/needs revisions (the HLC has “Concerns” with the nomination). 3) A majority vote will determine which box is selected: the “OK” box or the “Concerns” box. 4) Specific commissioner comments can supplement the nomination form if the Commission so desires. 5) The Commission will then repeat steps one through four for each review criterion, i.e., Description, Significance and Context, Facts and Sources, Supporting Materials. 6) Finally, the nomination evaluation sheet does ask if the Commission recommends the district to be listed or if it should not be listed in the National Register. The Commission will vote on which box to check here as well. The majority decision will determine which box is selected. II. Community Development Work Plan The HLC will hold a public hearing on May 14, 2018 to gain public input, discuss, and make a recommendation to the Board of County Commissioners (BOCC), regarding the Planning Division annual work plan for FY 2018-19. The public hearing on the work plan was scheduled for May 7. However, because there was not a quorum the public hearing was postponed until May 14. I. CALL TO ORDER Vice-Chair Sharon Leighty called the meeting to order at 5:45 p.m. Historic Landmark Commissioners present were Sharon Leighty, Rachel Stemach, and Bill Olsen. Staff present were Nick Lelack, CDD Director, Peter Gutowsky, Planning Manager, Zechariah Heck, Associate Planner, and Adam Smith, Assistant County Counsel. II. MINUTES The minutes from April 16, 2018, were approved unanimously as drafted. III. PUBLIC COMMENTS No public comments were provided. IV. CENTRAL OREGON CANAL NOMINATION REVIEW (WARD RD TO GOSNEY RD SECTION) Commissioner Stemach offered her opinion that responding in writing to each criterion is beneficial. She would like a similar format to take place. Commissioner Olsen encouraged the HLC to follow a public hearing process. Staff clarified the process has been open to the public from the beginning. The HLC held a public meeting to receive oral comments and allowed written comments to be submitted for review. Staff explained whatever process the HLC decides, the end result must include a completed Nomination Evaluation Form which has been provided by the State Historic Preservation Office. Leighty wants the agenda to be shortened to be respectful of everyone’s time. Staff responded that the agenda has been set, but the format can be altered to accommodate everyone’s personal time. There was a brief discussion about conducting deliberations, but the Commissioners decided they want to wait until May 7. Commissioner Olsen reiterated his concern that everyone’s opinion needs to be heard. V. OTHER ITEMS No other items were discussed. VI. COMMISSIONER/STAFF COMMENTS Zechariah mentioned the May 7 agenda has been published online and sent to the Commission. Peter addressed Commissioner’s Leighty’s concern about the agenda set for May 7. He acknowledged the agenda can be prioritized as the Commission sees fit. However, there are important items on the agenda that need to be reviewed and acted upon by the HLC. VII.
