MINUTES
DESCHUTES COUNTY HISTORIC LANDMARKS COMMISSION
DESCHUTES SERVICES CENTER

JUNE 1, 2020 – 5:30 P.M.
I. CALL TO ORDER / REVIEW OF PAST MEETING MINUTES
Chair Madden called the meeting to order at 5:30 p.m. Historic Landmark Commissioners
present were Kelly Madden, Rachel Stemach*, Dennis Schmidling*, and Sharon Leighty*.
Staff present were Nick Lelack, CDD Director, Peter Gutowsky*, Planning Manager,
Zechariah Heck, Associate Planner, and Ashley Williams, Administrative Assistant.

II. REVIEW OF MAY 4, 2020 MINUTES
The May 4, 2020 meeting minutes were approved as drafted.
III. HISTORIC PRESERVATION CODE AMDENDMENTS / PUBLIC HEARING
Zechariah provided a PowerPoint presentation to the HLC that covered the background
and summary of the proposed amendments to Deschutes County Code (DCC) and the
Comprehensive Plan. He explained the amendments are in line with the 2017 Department
of Land Conservation and Development updates to the Oregon Administrative Rules and
the State Historic Preservation Office 2019 Model Ordinance.
Kuri Gill and Robert Olguin with the State Historic Preservation Office provided testimony
covering the background of the 2017 OAR updates and the 2019 model ordinance. The
SHPO representatives also stated the proposed amendments appropriately reflect the
2017 OAR updates and meet the requirements to maintain the Certified Local Government
status.
Commissioner Stemach asked staff why “Historic and Cultural Resources” as a phrase was
proposed to be deleted. Staff explained it is due to the change in terminology and that the
definitions still exist, just reflected in a different word/term.
Two members of the public participated in the hearing: Suzanne and Gary Grund. The
Grunds asked about the definitions of alteration. Staff recited the proposed changes to the
definition of alteration, and minor/major alterations. Staff also explained National Register
Resources listed after February 23, 2017 are not subject to an alteration review by the

County. The Grunds also asked for clarification on the National Register Historic Places and
the County’s role. Robert Olguin with SHPO explained the County’s role is an opportunity
to review and comment on nominations. Ultimately, the NRHP is a federal program
implemented by SHPO and the National Park Service and it is the NPS that makes the final
decision to list a National Register Resource.
Chair Madden asked for a motion to proceed with next steps. Commissioner Leighty made
a motion to approve the proposed amendments as drafted; the motion was seconded by
Commissioner Schmidling. During discussion, Commissioner Stemach suggested the
written record remain open for a week to facilitate more public comments. Commissioner
Schmidling moved to amend the motion to close the oral record and keep the written
record open until June 8 at 5:00 p.m. The motion was approved unanimously.
The HLC set a date for deliberations on the proposed amendments: June 15 at 5:30 p.m.
IV. HLC / STAFF COMMENTS
Nick Lelack expressed appreciation for the County’s relationship with the State Historic
Preservation Office. There were no other HLC or staff comments.
VI. ADJOURNMENT
There being no additional agenda items, Chair Madden adjourned the meeting at
approximately 6:45 p.m.
