I. CALL TO ORDER Meeting was called to order at 5:30 p.m. by Chair Merle Irvine. Members present were: Vice Chair Chris Brown, Ed Criss, James Powell, Bill Rainey, Todd Turner, and Richard Klyce. Staff present were Tom Anderson, CDD Director; Nick Lelack, Planning Director; and Sher Buckner, Administrative Secretary. II. PUBLIC COMMENTS None. III. PUBLIC HEARING: Fiscal Year 2011-2012 Planning Division Work Plan — Nick Lelack, Planning Director. Nick spoke about the recent layoff at CDD in the Planning Division and its impacts on the Work Plan. Vice Chair Brown asked about a policy following the State on commercial uses of farmland. Nick said it is located under Code Amendments, Item #3. The Work Plan generally goes to the Board the first week in June, after a work session in May. Commissioner Turner asked about the Intergovernmental Agreement with the City of La Pine and whether we are compensated for that. Nick said that we only charge our standard fees. Nick and Commissioner Turner discussed internal applicants, such as Property and Facilities, and applications such as the Simpson Landfill. CDD functions as an internal consultant for these types of applications. Commissioner Klyce asked about Code Amendments, Discretionary Item #7 and whether this might not be addressed. Nick said it was proposed by a property owner a number of years ago. Commissioner Klyce also mentioned #4 under Natural Resources, also a discretionary item. He understands that as far as the State is concerned, as long as you don't kill plants you can mow grass, cut back willows, etc. Is that not what the County follows? Nick said he would check with the planner who deals with wetlands. Quality Services Performed with Pride Commissioner Powell asked if, in the cases of scenic waterways, the County or the DSL controls vegetation? Nick, Commissioner Klyce and Commissioner Powell discussed the State controlling this. Commissioner Klyce felt that the County follows the State guidelines concerning vegetation. He also asked what else besides zoning affects a piece of property. Nick said there is "public" and "private" property. On private property, CCNR's, easements can affect it. For public lands, federal and state regulations can control use, also historic districts, wetlands regulations. Commissioner Klyce asked if there is one place to find out all of the information affecting a piece of property. Nick said the County tries to show anything that would require a conditional use permit and we may point to the State regulations. The County system does show overlays. Commissioner Klyce felt that the Local Wetland Inventory (LWI) results in a decreased number of lots. If an individual wants to initiate a land use action on a piece of property zoned under the LWI, do we tell them to wait? Nick said we can suggest they wait until the LWI is completed, but if they choose to proceed we need to follow the regulations at the time of application. Nick said that once the DSL approves the LWI, we will initiate an amendment to the Plan to recognize it. Then the National Wetland Inventory (NWI) is out and the LWI is in. Updating Goal 5 is separate. Commissioner Criss asked about the Wickiup Junction TAC and whether they have been meeting. Nick said he would have to check with Peter Russell but he understands they are still active. Commissioner Turner asked about #14 of the Code Amendments regarding 19" Street and the status. Nick said the Board indicated the County is not going to initiate any work related to the LUBA remand. If any other entity such as DSL wants to proceed, the County may provide a supporting role but will not be providing a lead role. Motion: Commissioner Turner motioned to close the public hearing. Seconded by Vice Chair Brown. Motion passed. Vice Chair Brown asked about action items in the draft Comp Plan and whether there would be a correlation between this and the action items down the road. Nick said that it would not be this year because the Comp Plan has not been adopted. Commissioner Criss motioned to accept the Work Plan and recommend adoption to the Board. Seconded by Vice Chair Brown. Motion passed. IV. REVIEW: Annual Community Involvement Report— Nick Lelack, Planning Director. Nick and Commissioner Klyce spoke about trying to encourage more involvement from Redmond. Commissioner Klyce mentioned that there have not been many hot -button topics involving Redmond on the agendas. Commissioner Criss and Vice Chair Brown discussed community involvement and outreach. Commissioner Klyce mentioned the need for accessory housing in the Brothers area. V. PLANNING COMMISSION & STAFF COMMENTS. Nick said that we do not have any agenda items for the second meeting in April. Monday we will continue to discuss Deschutes Junction with the Board. On April 20, the Board will take up the event venue text amendment. The following week, we meet on the 27`" with the Board to discuss the Comp Plan further. The public hearing was continued until May 11, and at that point the Board will decide how much longer to take public comments. Commissioner Turner asked if the event venue text amendment will come before the Planning Commission again. Nick said that the Code does require Planning Commission review, but the Planning Commission does not need to have public hearings again. Nick spoke about the duplication in process when items come before both the Planning Commission and the Board. Sometimes people do not participate in the Planning Commission hearings and instead wait until Board hearings. For legislative amendments, the Code does not require the Board to conduct public hearings because the idea is for the Planning Commission to be the citizen -involvement body. The Board gives the Planning Director the authority to have the Planning Commission conduct public hearings. Commissioner Turner felt that it seemed like a "rubber stamp' process. Nick said that there were a lot of meetings regarding Deschutes Junction, for example. The meetings were very effective in focusing the issue down to one policy before it went before the Board. Commissioner Powell said he realizes the amount of work that was done on the Comprehensive Plan before he became a Commissioner. The value of that is lost only if people go to the Board and make their cases there instead, and nothing goes back to the Planning Commission afterward. With the event venue text amendment, he can understand how the Commissioners feel if they have participated in the process, but there are two current Commissioners who were not present for the discussions. Nick said there will be at least two future meetings. If the Board members receive new information with which they are not comfortable, they can also remand something back to the Planning Commissioners. Commissioner Criss felt that the Planning Commission and Board may need more joint sessions. Nick also said that we are working on one-year extensions for development applications for land use approvals (no change to building permit timelines). He also discussed HB 3615, which would allow regions of two or more counties adjacent to one another to create their own definitions of resource land. Jackson, Josephine and Douglas Counties have been identified as pilot counties for this project. The Pine Forest hearing will be tomorrow afternoon. Note that the next Planning Commission meeting will be May 12. VI. ADJOURN There being no further business, the meeting was adjourned.
