HomeMy WebLinkAbout81-039BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Ordinance Amending Deschutes ) County Ordinance No. PL -16, ) Sisters Urban Area Comprehensive ) L Plan; and Amending the Sisters )9 Urban Area Comprehensive Plan ) Map; Adopting Findings; and Declaring an Emergency. 1981 ROSEMARi ORDINANCE NO. 81-039 DESCHUTES .CQ NT y Q N- ERIC WHEREAS, hearings have been held relating to the amendment of Deschutes County Ordinance No. PL -16, Sisters Urban Area Compre- hensive Plan; and WHEREAS, the Board of County Commissioners has considered the proposed amendments; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. That Ordinance No. PL -16, Sisters Urban Area Comprehensive Plan, is amended in accordance with Exhibit "A," attached hereto and by this reference incorporated herein. Section 2. That the amended Sisters Urban Area Comprehensive Plan Map, marked Exhibit "B," attached hereto and by this reference incorporated herein, is hereby adopted as the Sisters Urban Area Comprehensive Plan Map. Section 3. That the findings, marked Exhibit "C," attached hereto and -by this reference incorporated herein, are hereby adopted. Section 4. This Ordinance being necessary for the immediate preservation of public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. PL -160 in order to comply with statewide planning goals and fulfill the acknowledgement requirements set forth by the Land Conservation and Development Commission. New material is underlined; material to be deleted is contained in brackets [ ]. GOAL 2 LAND USE PLANNING 1. Amend Part V, RESIDENTIAL AREAS Policies, page 58 7. New lots without community sewer service should have a minimum of [14,000] 12,000 square feet and shall provide for further segregation to the density de- signated on the Comprehensive Plan. 2. Add RESIDENTIAL AREAS Policies, page 62 45. Total Net Buildable Lands within the UGB for single family dwelling units is 262 acres. VOL 40 PAGE 468 Page 3. GOAL 11 PUBLIC FACILITIES AND SERVICES 1. Add CITY FACILITIES AND SERVICES Policies, page 67 12. The City has adopted a Street Plan, City of Sisters Street Improvement Plan of 2979, in the CG zone that identifies catch basin locations for storm runoff. These facilities will be constructed as development occurs along those streets. Storm runoff in other zones will be addressed and designed at the time of development. GOAL 14 URBANIZATION 1. Amend URBANIZATION Findings, page 89-90 1. Delete _[There are 45 acres of zoned commercial lands within the current urban area plan. No additional commercial lands are needed for the projected growth.] Add The Commercial Land Inventory, which is based on the Sisters BuiZdable Lands Inventory Map - CG Zone indicates that 15 acres are available for commercial use. Ten acres are currently in residential use and when coverted to commercial use will be subject to parking, sanitation and landscaping requirements. The total area is sufficient to meet the projected Year 2000 needs. Urban Area Reserve Zones in- dicate a total of 260 acres, of which 111 acres are committed or developed. The remaining 149 acres should be held in reserve to support the Year 2000 housing need projections. EXHIBIT "C" FINDINGS OF FACT IN SUPPORT OF LEGISLATIVE AMENDMENTS TO ORDINANCE NO. PL -16, SISTERS URBAN AREA COMPREHENSIVE PLAN The Sisters Urban Area Comprehensive Plan is in compliance with State Land Use Goals 2, 5, 10, 11 and 14, as is set out below. 1. The Plan is in compliance with Goal 2, Land Use Planning, because Residential Policy 7 is amended to be consistent with respect to minimum lot sizes. 2. The Plan is in compliance with Goal 5, Open Spaces, Scenic and Historic Areas, and Natural Resources, because of the adoption of Plan Policy 18 to provide for the retainage of valuable historic and cultural resources within the Sisters Urban Growth Boundary for future generations, and the amendment to the Plan Map to identify the route of the TransAmerica Bike Route. 3. The Plan is in compliance with Goal 10, Housing, because of the addition of the Buildable Land Inventory within the Sisters City Limits and within the Urban Area Reserve Zone, along with the new Plan Policy for residential area providing site plan criteria to prohibit discrimination of housing type. 4. The Plan is in compliance with Goal 11, Public Facilities and Services, because of the addition of City Facilities and Services Policy 12, incorporating the City of Sisters Street Improvement Plan, identifying the locations of storm run-off, and providing for the requirement of construction of adequate facilities for that purpose. 5. The Plan is in compliance with Goal 14, Urbanization, by the substitution of findings in the Plan consistent with previous findings in the recently submitted material regarding buildable commercial land and unavailable urban area reserve land.
