ORDINANCE NO. 83-038 MARY SUE PENjICLLOIAI, CO. CLERK(
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. Subsection 1 of Section 7, Ordinance 82-011, is
amended by the addition of the following:
"(d) For a solar access application, all owners
of record identified in the application."
Section 2. Section 7 of Ordinance 82-011, is amended by the
addition of the following:
"(4A) Notice of a solar access application shall be
posted as near as practicable or on each lot identified
in the application."
Section 3. Section 12 of Ordinance 82-011 is amended to read
as follows:
"12. Standing. Any person appearing on the
record at the hearing or presenting written evidence
in conjunction with an administrative action or
hearing shall have standing and shall be a party.
Additionally, any owner of property to be burdened by
a solar access permit shall be considered a party at
every stage of the solar access permit decision
process."
Section 4. Subsection 2(b) of Section 22, Ordinance 82-011,
is amended to read as follows:
"b. A person to whom notice was to be mailed in
accordance with Section 7 of this Ordinance, and to
whom no notice was mailed. A person who, after such
notices were mailed, purchases property to be burdened
by a solar access permit shall be considered a person
to whom notice was to have been mailed."
