ORDINANCE NO. 90-025 THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. FINDINGS. The Board of Commissioners finds: Procedural Background. 1. On November 1, 1979, the Board of County Commissioners adopted a comprehensive plan and zoning ordinance identify- ing certain sites as surface mining or surface mining reserve, denoting the presence of aggregate and other mineral resources on those sites. 2. The comprehensive plan and zoning ordinance were reviewed by LCDC on April 10, 1980, and April 30, 1981, and found to comply with the statewide planning goals. 3. The Court of Appeals in Coats v. LCDC, 67 Or App 504 (1984), subsequently reversed and remanded Deschutes County's acknowledgement based upon the fact that the County's comprehensive plan and implementing ordinances would have allowed conflicting uses on sites surrounding SM and SMR sites without any ESEE analysis and without any protection of the mineral and aggregate resource. 4. Under an order dated January 30, 1986, LCDC acknowledged Deschutes County's plan and implementing ordinances except for areas zoned surface mining and surface mining reserve outside the County's urban growth boundaries and except for compliance with the requirements of Goal 5 with respect to mineral and aggregate resources under Goal 5. 5. Pursuant to that order and several continuances granted since that time by LCDC, Deschutes County has undertaken a new process to inventory mineral and aggregate resources outside the urban growth boundaries in the County. 1 - ORDINANCE NO. 90-025 (7/12/90) 0895 6. In December 1985, the County conducted an initial inventory of lands zoned surface mining and surface mining reserve in the County. 7. After reviewing the initial inventory and information pro- vided by the Department of Geology and Mineral Industries Bulletin 89, Geology and Mineral Resources of Deschutes County 1976, and the information used in the development of the comprehensive plan in 1980, in March 1986, a written request for updated information on surface mines was sent to all surface mining owners and operators. The request was made for information regarding location, quantity and quality of the resource. 8. In May 1986, a request for technical assistance was made to DOGAMI. This request was prompted by the lack of response to the earlier request for information from owners and operators. In August 1986, DOGAMI replied to the County's request for assistance stating that due to limited staff and financial constraints, they would be unable to lend any staff assistance. They did provide access to the Depart- ment's library files. 9. In November 1986, due to a lack of response to the first two notices, a third request for information was mailed to owners and operators. Accompanying this notice was a data sheet that could be filled out and returned. 10. Based upon information from the County's own files, the information made available from DOGAMI and the responses from owner and operator surveys, the County compiled a preliminary list of aggregate and mineral resources for the County. 11. In May 1988, the County hired Robert Deacon as a consulting geologist to assist the County in analyzing its inventory. 12. Beginning in June 1988, eight public hearings were held before the County's hearings officer to obtain final infor- mation on location, quantity and quality of the mineral and aggregate resources in the County. During the inventory and hearings process, information was accumulated on approxi- mately 457 sites. 13. In July 1988, staff requested production data from DOGAMI. The requested production data was received from DOGAMI in October, 1988. 14. In September 1988, the hearings officer made his recommenda- tion to the Board of Commissioners on the County's new inventory. 2 - ORDINANCE NO. 90-025 (7/12/90) OW02 �U 089G 15. On October 11, 1988, the Board of Commissioners held a public hearing on the inventory of mineral and aggregate resources. 16. On December 14, 1988, the Board of Commissioners held a final public hearing on the inventory and by Ordinance No. 88-039, adopted the Deschutes County mineral and aggregate resource inventory and supporting recommendations of the hearings officer and staff. 17. Starting in February 1989, the Planning Commission held hearings on individual inventoried sites to address con- flicts between mineral and aggregate resources and other Goal 5 resources or land uses and to recommend whether to protect the mineral and aggregate resources on those sites through zoning. During the course of those hearings, the Planning Commission considered the addition of certain sites to the inventory and the deletion of other sites from the inventory. Such changes were considered by the Planning Commission at its hearing on April 12, 1990, after which date the record for additions to the inventory was closed in order to allow the Goal 5 process to proceed toward finality. 18. Starting in May of 1989, the Board of County Commissioners held hearings on individual inventoried sites to make final ESEE decisions. Information received during the course of those hearings and subsequent review of the record by staff requires changes to be made to the inventory adopted previ- ously by the Board. Sites within Urban Growth Boundaries. 19. The County's preliminary list and the inventory adopted by the Board in December 1988 include sites that fall within the Urban Growth Boundaries of the Cities of Bend and Redmond. The Board finds that sites inside the urban growth boundary are not included in this review process and are therefore not a part of the inventory to be adopted by this process. However, the quantities and qualities of minerals, if any, identified at those sites are included in the overall calculations of quantities of available mineral resources. Those sites are listed in Exhibit A. Stockpile Sites 20. The inventory and ESEE hearings process has identified numerous sites as mineral and aggregate storage and/or processing sites not having any resource on site. The primary purpose for such sites is to store road building and 3 - ORDINANCE NO. 90-025 (7/12/90) t)0(' 3 Lot - 0897 maintenance materials for use on public road projects. These sites are owned primarily by the federal government, the State of Oregon Highway Department, and by Deschutes County. Most federally owned storage sites are leased for use by the State or County. The Board finds that those storage and processing sites having insignificant amounts of unextracted material are not Goal 5 resources and hence should not be placed on the Deschutes County mineral and aggregate inventory. Goal 5 protects only those storage and processing sites having significant unextracted resources. The Board finds that those sites listed in Exhibit B are sites that fall into this category. Irrigation District Sites. 21. The inventory and ESEE hearings process has shown there to be a class of mineral sites owned and maintained by Central Irrigation District (COI) for the purpose of supplying mineral resources for the repair and maintenance of its irrigation supply system. These sites are primarily small quantity dirt sites located at or near the COI irrigation supply system. The Board finds that, given the fact that the resources on such sites are used primarily on site by the owner and not made available to the general public, the resources at these sites do not constitute Goal 5 resources. Accordingly, the Board finds that these sites should not be listed on the County's aggregate and mineral inventory. The Board finds that those sites listed in Exhibit C are sites that fall into this category. Federal Sites 22. Under Goal 5, the County is required to identify all those sites that lie within the physical boundaries of its juris- diction. The inventory and ESEE hearings process has shown there to be a number of aggregate and mineral sites on federal lands within the County. These sites include a listing of 228 mineral sites on Forest Service land prepared for the County by the Forest Service as well as other Forest Service and Bureau of Land Management (BLM) sites identified through the inventory and ESEE hearings process. These sites also include sites - primarily BLM - that were placed on the County's December 1988 inventory as non-federal sites and which the County has subsequently determined to be in federal ownership. 4 - ORDINANCE NO. 90-025 (7/12/90) 00194 101 - 0898 The Board finds that it has no authority to place zoning restrictions or conditions upon federal land held by the federal government and managed under federal land management laws. Federal land management laws prevail over local laws that would designate federal lands for particular uses. Accordingly, the Board finds that the County may go no further in the Goal 5 process with respect to such lands than to identify and inventory them as mineral and aggregate sites. These sites will be left on the inventory list for informa- tional purposes, since they are a significant source of minerals. These sources have significance in that they are resources utilized by the United States government, the State of Oregon, and public agencies in Central Oregon. Some of the resources could also be used by private inter- ests if they are deemed surplus to public needs. The Board finds that due to short supply, it is the policy of the Forest Service and BLM to reserve its aggregate sources for use on National Forest and BLM roads and other public agency roads. The Board finds that these sites should not be compared against sites utilized by private industry in determining relative significance of those sites for future use in Central Oregon because (1) with respect to aggregate, their availability to the public is limited, and (2) the County has no control through its land use process over whether any of these sites can be developed in the future or can con- tinue to be developed. With regard to mineral resources on the Deschutes National Forest such as pumice and cinders, there appears to be more than enough resources from pri- vately controlled sources to meet regional needs. Pursuant to intergovernmental agreements entered into between the County and the BLM and Forest Service under federal land management laws, the County will take whatever steps it can to participate in any federal land management decisions made on these sites. The Board finds that these sites are listed in Exhibits D and E. Exhibit D includes the list of the 228 sites sup- plied by the Forest Service. These sites compose the first 228 sites on the County list. Exhibit E is composed pri- marily of BLM sites and other federal sites that were assigned County inventory numbers in the inventory process. In some cases, federal sites already included on the list in Exhibit D were assigned separate inventory numbers. Those duplicate numbers are noted on Exhibit E. 5 - ORDINANCE NO. 90-025 (7/12/90) 0005 C)I - 0890 Insignificant Sites 22. The Goal 5 rule requires that only those sites with signifi- cant mineral and aggregate resources be placed on the inventory. During the inventory, ESEE hearings and staff review process, it was determined that several sites for which a preliminary inventory number was assigned did not contain significant or any resource. Those sites are listed in Exhibit F. Inventory Sites 23. In developing information concerning quality, quantity, and location for each site, the County has relied upon informa- tion supplied by owners as well as from government publica- tions and permit information. Where such data is not disputed, no expert opinion has been required by the County and the opinion of the owner or operator has been accepted. The Board finds that without great expense, more accurate information concerning quantity and quality could not reasonably be obtained for these resources. The Board finds that such uncontroverted information is sufficient under the provisions and implementing regulations of Goal 5. Under the Goal 5 rule the County is allowed to develop its data from as many sources as possible, including land owners. The Board finds that the County is not required to commission its own resource data study for each site. The few sites having conflicting inventory information have either been designated as having insufficient information to proceed under OAR 660-16-000(5)(B), or have been placed on the inventory with the aid of expert opinion. The sites with conflicting evidence are examined separately below in Findings Nos. 31 - 37. 24. The Board finds that where the quality of an aggregate resource is in dispute, the resource will be deemed to be significant as to quality if the aggregate resource is determined through testing to meet the following Oregon Department of Transportation standards: (1) Resistance to abrasion of aggregate by use of the Los Angeles machine (OSHD test method 211) - test sample shall have a loss of no more than 35% by weight; (2) Sodium sulfate soundness (OSHD test method 206) - average loss of aggregate after 5 alternations of the Sodium Sulfate soundness test shall not be more than 18% by weight; and 6 - ORDINANCE NO. 90-025 (7/12/90) 0006 0900 (3) Oregon air degrade (OSHD test method 208) - the ag- gregate source material shall when tested meet the following specifications: Passing No. 20 sieve 35% Max. Sediment Height 3% Max. The Board finds that these tests are good indicators of aggregate quality for construction purposes. 25. The Board finds that for inventory purposes, it was not necessary to establish a significance threshold for quan- tity. Although there may have been an issue with respect to some sites as to the sufficiency of information regarding quantity, whether or not a site had a quantity of mineral resources sufficiently significant to be placed on the inventory was never an issue as to any particular site. Consequently, the Board finds that all sites in the proposed inventory are significant from a quantity standpoint as resources that are or may be needed in the future. 26. The Board finds that there is sufficient information on location, quality and quantity to adopt as its inventory the sites listed in Exhibit G. The sites listed break down as follows with respect to mineral type and available quantity by cubic yard: Sand and Gravel: 49,938,000 Rock: 13,650,000 Cinders: 40,940,000 Pumice: 13,500,000 Diatomite: 2,500,000 Dirt: 4,360,000 A detailed summary of the more controversial sites, where evidence of quantity and quality was in dispute, is incor- porated below in Findings No. 31 through 36. 27. In determining relative significance, the sites have been identified within one or more of the following categories, depending upon which minerals are present: sand and gravel (including aggregate and crushable rock), cinders, pumice, diatomite, and dirt. Within these categories, the sites were evaluated in terms of their quantity, quality and location. Quantities are measured in cubic yards of resource at the site. For most sites, the quality is listed as "excellent," "good," "meets ODOT specs," or "mixed." "Excellent" means of superior grade; "good" or "meets ODOT specs" means that the material has been tested to meet specifications for construction use or is anticipated to meet such standards; "mixed" means that the resource is uneven on the site. 7 - ORDINANCE NO. 90-025 (7/12/90) oono ` I. 28. For purposes of significance, the location of a resource at a particular site is analyzed under two factors. First is the actual physical location of the resource as reflected in its legal description. The second factor is the location of the resource vis a vis its market area. The Board finds that an area with a radius of approximately 10-15 miles from the market area is the maximum area for which these resources can be commercially usable. Beyond that range, the transportation costs for these resources will have an adverse impact on their commercial use. The Board finds that it is appropriate to consider market location factors in determining relative significance given that, unlike other Goal 5 resources, the significance of mineral and aggregate resources is measured largely by their commercial value. Market location factors include proximity to urban areas and to major roads and highways. The Board finds that it is difficult to rank Goal 5 sites of this nature with precision. Because of the bulk of the resource, the importance of many of these sites is dictated by whatever the particular needs may be for material and where that need is located. For example, if a construction job is slated for Highway 20 east of Bend, those sand and gravel sites east of Bend take an increased importance because of the particular need. In such instances, it becomes important to have preserved nearby sand and gravel sites for materials. The Board finds that in general, most demands for sand and gravel will come from urban centers, such as the City of Bend, where construction activity is centered. For commercial operators supplying the general commercial construction market location, this becomes a critical factor. 29. The relative rankings of each site are set forth in Exhibit H by resource type. With respect to sand and gravel, the best resource in this category can be found in the terraces along the Deschutes River. Crushable rock, which is generally used in shoulder and base material and for asphalt, concrete and chip seal is the other general source. The Board finds that the most significant sites are those that have relatively more quan- tity and are located within 10 to 15 miles of a commercial market area and whose quality is either excellent or good. Cinders are generally used for minor roads as a base mate- rial and to cover snow and ice on roadways in the winter. The Board finds that the most significant sites are those that have relatively more quantity and are located within 10 to 15 miles of a commercial market area and whose quantity is either good or excellent. 8 - ORDINANCE NO. 90-025 (7/12/90) 0008 .., 191 09O2 Pumice is generally used as building stone, filter material, abrasive material, and "kitty litter" and is a considerable export product from Central Oregon to other markets in the United States. The Board finds that the most significant sites are those that have relatively more quantity and are located within 10 to 15 miles of a commercial market area and whose quality is either good or excellent. Dirt is generally used as fill or landscaping material. The Board finds that the most significant sites are those that have relatively more quantity and are located within 10 to 15 miles of a commercial market area and whose quality is either good or excellent. Rock is generally used for aggregate after it has been crushed. The Board finds that the most significant sites are those that have relatively more quantity and are located within 10 to 15 miles of a commercial market area and whose quality is either good or excellent, i.e., identified as "select fill." Diatomaceous earth (also known as diacolite) has a commodity value for ultimate use in glass, mushroom growing, filters, kitty litter and decorative uses. The Board finds that the most significant sites are those with the most quantity. Impact Area 30. The Board finds that the off-site impacts from surface mining generally include the following: (1) Noise from operation of heavy equipment, trucks and processing equipment; (2) Fugitive dust associated with the excavation of the mineral resource, the stockpiling of mineral resources, the transport of excavated mineral resources and the operation of processing equipment; (3) Changes in topography and physical scarring of the landscape, including removal of vegetation, that are visible from off-site. (4) Increases in truck traffic on roads leading to the site; and (5) Increased human presence. The Board finds that considering these impacts, an area within a radius of one-half mile from an inventoried site is a reasonable impact area to apply to the inventoried sites. This was the outer limit of the impact area previously 9 - ORDINANCE NO. 90-025 (7/12/90) 0009 y 1fly. 0903 adopted by the County in the 1979 comprehensive plan surface mining provisions. Many of these sites under consideration are undeveloped and the exact noise impact cannot be estab- lished without knowing what equipment is likely to operate on the site. Furthermore, the Board finds that noise levels at any one site are affected by a variety of factors, such as existing background noise and topography. The Board finds that it is not required to commission noise studies to set the impact areas; under the Goal 5 rule, it may utilize available information. The Board recognizes that some impacts, such as truck traffic and, in some cases, changes in the landscape, may be felt more than one-half mile away. The Board does not believe it would be reasonable to extend the impact area to cover all such impacts. Defining the limits of an impact area for truck traffic would be difficult given that trucks may travel many varying routes depending upon the delivery site of their cargo. Similarly, the limits of off-site aesthetic impacts can be difficult to describe and define. Topographical variations in and around a site can produce situations in which there may be virtually no impact on properties near the site yet be aesthetically displeasing to viewers several miles away. The Board finds that the single one-half mile impact zone obviates the need for separate zones for separate impacts, and simplifies the inventory process, particularly in instances such as this legislative process involving a multitude of sites. This uniform one-half mile impact zone was recognized by the Department of Land Conservation and Development in its November 7, 1985, Response to Continuance Order of February 1, 1985. Compared to other impact areas found in the County's zoning ordinance, such as 100 feet to one-quarter mile for Landscape Management Zones, and Wild and Scenic River corridors of one-quarter mile, the impact areas adopted herein are appropriate. Twin Bridges (Site No. 368) 31. For the purposes of this inventory ordinance, the Board incorporates inventory findings made under Section 4, Inven- tory, in the ESEE statement for this site adopted on this date under Ordinance No. 90-029, which findings establish that the site has 577,000 cubic yards of aggregate meeting Oregon Department of Transportation quality standards. Klippel (Site No. 294) 32. For the purposes of this inventory ordinance, the Board incorporates inventory findings made under Section 4, Inventory, in the ESEE statement for this site adopted on 10 - ORDINANCE NO. 90-025 (7/12/90) 00,10 10*1 - 0904 this date under Ordinance No. 90-029, which findings es- tablish that the site has 777,000 cubic yards of aggregate material meeting Oregon Department of Transportation quality standards. Rose (Site No. 392) 33. The Board finds that the best estimate of quantity of material is that presented by Joel Smith of 7 1/2 million cubic yards of dirt and 10 million cubic yards of basalt. These figures are derived from Century West engineering reports, although it is difficult to determine from the record how these figures were arrived at. Despite the lack of certainty as to the quantity of each type of material present, the Board finds that even amongst the experts there is agreement that a significant amount of material exists at the site. Therefore, the Board finds that there is suffi- cient quantity of mineral resource at the site to justify its inclusion on the inventory. 34. The Board finds that the quality of the basalt resource and the select fill at the Rose site is sufficient to include those mineral resources on the County's mineral and aggre- gate inventory. With respect to the basalt resource, the Board finds that testing performed on samples obtained by Joel Smith showed the rock resource to meet ODOT standards. The Board accepts that finding for purposes of placing this site on the inventory while noting that conflicting tes- timony on the issue of quality may affect the issue of whether the resource is actually zoned. With respect to the select fill material, the Board finds, based upon the 1979 Century West engineering report, that the material is from the same geologic deposit as that present in the adjacent Knott Pit. The resource in the Knott Pit is well known for its unique qualities as select fill for use in construction projects in Central Oregon. Accordingly, the Board finds that the select fill resource is significant with respect to quality. 35. The Board finds that the site is situated within 10 miles of the City of Bend and that consequently the mineral resources of the site are significant because they may be economically utilized. Eric Coats (Site No 400) 36. The Board finds, based upon the testimony at the ESEE hearing on this site, that the inventory of mineral resour- ces adopted by the Board in December 1988, does not ac- curately reflect the quality or quantity of the resource. The December 1988, inventory shows that the site contains 11 - ORDINANCE NO. 90-025 (7/12/90) 001i s 1�1 0905 2.5 million cubic yards of sand and gravel meeting ODOT specifications. That information has been contradicted by the opponent's expert and even by the owner's expert, as to quantity. The owner's evidence tended to show that the site contained 1,600,000 cubic yards of rock. Opponent's expert testified that the site contained only 1,313,700 cubic yards of rock. The Board finds that the owner's figure results from more in-depth calculations than the opponent's figure and the Board adopts the owner's quantity figures for inventory pur- poses. This represents a substantial reduction from the figures the owner presented during the inventory process. During the inventory process, the owner presented testing analysis tending to show that the rock tested met ODOT specifications. The Board accepts that finding for purposes of placing this site on the inventory while noting that conflicting testimony discussed below and in the ESEE decision may affect the issue of whether the resource is actually zoned. Opponents have presented expert opinion discounting the value of the rock. The opponent's expert geologist, Lewis E. Scott, testified that the site is located in the Newberry Crater basalt flows, which are generally known not to produce quality rock. Mr. Scott cited to expert opinion already in the surface mining record offered by personnel from the State Highway Division that the quality of such flows can only be determined by subsurface testing. The owner's expert, Patrick Lynch, testified that the owner's test samples were taken from exposed rock sources in three different loca- tions. Mr. Scott's site observations confirmed that no subsurface test samples had been taken. The Board accepts Mr. Scott's testimony on the questionable quality of the mineral resource and for this reason discount the value of the mineral resource at the site. In addition, the record shows that the rock consists of large fragments of basalt that would require extensive crushing. Such evidence also tends to discount the value of the rock. Sites with Insufficient Information 37. Under the Goal 5 rule, the Goal 5 process may be deferred on sites with insufficient information as to quantity, quality, or location to be placed on the inventory until enough information has been developed to determine whether or not each such site has significant mineral resources. The Board finds that a number of sites included in the previously adopted inventory fall within this category. The findings on these sites are listed below in Findings No. 38 - 50. These sites are listed in Exhibit I. 12 - ORDINANCE NO. 90-025 (7/12/90) ri 101 -1 0906 38. Site 287. This site is located southwest of Tyler Road and is owned by T. C. Lyster. No testing to determine the quality and quantity of mineral resources on the property was undertaken. The only information tending to establish that a mineral resource was present on the site was testi- mony from the owner and from R. L. Coats that the site contained the same material as is contained on R. L. Coats' 80 -acre site immediately adjacent (Site No. 290). Other testimony indicated that Mr. Coats had made previous state- ments to the effect that the site did not have much good gravel on it. Given the conflicting testimony and the lack of test data for the site, the Board finds (with Commis- sioner Prante abstaining) that there is insufficient data to place this site on the inventory at this time. 39. Site 290. This site is located off Tyler Road at the junction with Kuhlman Road and is owned by R. L. Coats. No test data was presented to verify the quantity and quality of the resource at the site. The file on this site is missing a letter submitted by Mr. Coats that may provide information concerning quantity and quality. The staff report amount of 1,500,000 cubic yards of aggregate presum- ably was supplied by Mr. Coats. Mr. Coats admitted in his testimony before the Commission that he had made conflicting statements in the past concerning the amount of aggregate present at the site. Other testimony received indicated that Mr. Coats's son had made statements that the rock was of poor quality and hardly worth mining. Given the lack of test data and the conflicting testimony on the quantity and quality of aggregate at the site, the Board determined at its October 25, 1989, hearing (with Commissioner Prante abstaining) that there is insufficient data to place this site on the inventory at this time. 40. Site 298. This site is located west of Johnson Road just to the west of Shevlin Park and is owned by Crown Pacific. During the ESEE hearing, it was determined that the location of the resource area was not well defined. Because of questions as to the location of the resource, the Board finds that there is insufficient data to place this site on the inventory at this time. 41. Site 312. This site is located east of Bend near Johnson Ranch Road and is owned by Mr. Clyde Carlson. A request was received from a Mr. Christen Brown to zone the property for surface mining, with the assertion that the property con- tained 1.5 million cubic yards of gravel. No data was received to verify what quality resource was on the site, despite a request of the owners from the Planning Department to provide further information. Given the lack of data on quality, the Board finds that there is insufficient data to place this site on the inventory at this time. 13 - ORDINANCE NO. 90-025 (7/12/90) 00 J �� 101 0907 42. Site 337. The site is located on the north side of Pershall Way west of Highway 97 north of Redmond and is now owned by Deschutes County, which took title by foreclosure subsequent to the inventory and ESEE hearings on this site. The former owner, Robert Comstock, stated in 1986 that 750,000 cubic yards of good quality cinders exists on the site; this figure served as the basis for the staff report figures. There is no additional information on quality and quantity; Mr. Comstock did not participate in the hearing process, as the property was in foreclosure. The site has been mined previously, but there is no verification of what the remain- ing resources may be. Given the lack of any current data on the quantity at this site, the Board finds that there is insufficient data to place this site on the inventory at this time. 43. Site 353. This site is located on the northern side of Laidlaw Butte just west of Tumalo, is owned by Tumalo Irrigation District and is leased by Cascade Pumice. Information submitted by the owner in the past tends to demonstrate that there is good quality pumice on the site but that the quantity could be anywhere from 50,000 to 200,000 cubic yards. Testing on quantity is not complete. Given that quantity data is not complete, the Board deter- mines that there is insufficient data to place this site on the inventory at this time. 44. Site 362. This site is located on the West side of 85th Place on the flank of Long Butte in Tumalo and is now owned by Commercial Bank (formerly owned by Patricia Pruitt). The site has been mined for cinders previously dating back to prior to 1974. The site has an open pit with a depth of about 75 feet. Although the staff report indicates that 250,000 cubic yards of good quality cinder is present at the site, nothing in the file indicates where that figure came from. There is no information in the record to verify the staff report figures. Given the lack of verified data on quantity and quality for this site, the Board determined at its October 26, 1989, hearing that there is insufficient data to place this site on the inventory at this time. 45. Site 363. This site is located just off Kiowa Road along the southerly flank of Long Butte in Tumalo and is now owned by Deschutes County (formerly owned by Robert Comstock). The site has been mined previously and appears to contain cinders. Robert Comstock submitted a statement in 1986 that the site contained 800,000 cubic yards of cinders. The staff report contains a figure of 250,000 cubic yards of cinders for the site. There is no way of knowing which of these figures is correct. Given the discrepancy in data on quantity for this site, the Board determines that there is 14 - ORDINANCE NO. 90-025 (7/12/90) 0014 Lot " 0908 insufficient data to place this site on the inventory at this time. 46. Site 367. This site is located just north of Tumalo one- quarter mile west of Cline Falls Road and adjoins the Highland site (Site No. 488). The site is owned by Charles Kelly. The site has apparently not been mined previously. The only information concerning quantity and quality came in a letter from the applicant. No testing information was provided. Given the lack of hard data on quantity and quality on this site, the Board determines that there is insufficient data to place this site on the inventory at this time. 47. Site 388. This site is located approximately .75 miles south of Stevens Road along the extension of Ward Road in southeast Bend and is owned by Glenn and Ann Maroe. (Change inventory to reflect proper owners. Check to confirm ownership.) The site is a dirt site and has been mined previously. Although the staff report indicates there to be 50,000 cubic yards of fill material remaining, nothing indicates where that figure was obtained from. Other information indicates that the site has been exhausted of fill material. Given the discrepancy of data as to quan- tity, the Board finds that there is insufficient data to place this site on the inventory at this time. 48. Site 496. This site is located on the old Bend -Burns Highway, about 2 miles west of the east end of the road, and is owned by William Walton. The site has not been mined previously and the file contains no information of any kind as to quality and quantity of mineral resource. The Board finds that there is insufficient information to place this site on the inventory at this time. 49. Site 539. This site is located on the north side of Pershall Way, just west of 10th St. in northwestern Redmond. The site is a large cinder pit owned by the City of Redmond. Although the staff report indicates that there are 50,000 cubic yards of good quality cinders on site, nothing in the record verifies that data. The Board finds that there is insufficient information to place this site on the inventory at this time. 50. Site 540. This site is located southeast of Bend on Arnold Market Loop Road. There is known cinder butte on the site, but the quality and quantity of the site were not estab- lished in the process. 15 - ORDINANCE NO. 90-025 (7/12/90) 001.5 Section 2. ADOPTION. 1. Based upon the findings set forth above, the Board of County Commissioners hereby adopts as its Goal 5 Mineral and Aggregate inventory the mineral and aggregate sites set forth in Exhibit G and shown on the maps in Exhibit I. 2 Based upon Findings No. 37 through 50 set forth above, the Board further adopts a list of sites about which a decision to place on the inventory is deferred until more information on those sites is forthcoming. Those sites are set forth in Exhibit J. Section 3. EVALUATION OF DEFERRED SITES. The Board directs that the sites on which an inventory determination was deferred under Section 2 of this Ordinance be evaluated in early 1991, with hearings to start shortly after January 31. Section 4. REPEAL. Ordinance 88-039 is repealed and replaced by this ordinance. Section 5. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on July 16, 1990.
