HomeMy WebLinkAbout91-039' WRIT' E L ' BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTE An Ordinance Amending Chapter 2.28 of the Deschutes County Code, Relating to Historical Preservation, Designating Certain Violations as Infractions, Establishing Penalties, and Declaring An Emergency. 91-3090 ORDINANCE NO. 91-039 0107 1806 WHEREAS, when the Deschutes County Code provisions creating the Historical Landmarks Commission and relating to the designation, alteration and demolition of historical landmarks were adopted, no specific provisions were included relating to violations and penalties; and WHEREAS, where no specific penalty is provided for violations of county code provisions, violations are classified as "Class B" infractions, which are punishable by a maximum fine of one hundred dollars ($100); and WHEREAS, the Board of County Commissioners finds that historical preservation furthers important community interests and values, that alternation or demolition of historical landmarks in violation of the provisions of the Deschutes County Code represent significant damage to the public interest, and that such violations should be punishable as "Class A" infractions, which are punishable by a maximum fine of five hundred dollars ($500); now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That Chapter 2.28 of the Deschutes County Code, Historical Preservation and Historical Landmarks Commission, is amended to add a new Section 2.28.120, as follows: "2.28.120 Violation - Infraction. Violation of any of the 2.28.070 or 2.28.080 Class A infraction." provisions of Section of this Chapter is a K YP HED J 1 - ORDINANCE NO. 91-039 (9/18/91) 4 0107 1807 Section 2. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
