HomeMy WebLinkAbout92-032REVIEWED ° i3wv� LEGr'eL C01-, <: � BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Ordinance Amending Title 18 of the Deschutes County Code Regarding * t "~ {� Lt -`r LLOi the Siting of Destination Resorts and COUNTY Declaring an Emergency 0112-0001 92-12524 ORDINANCE NO. 92-032 WHEREAS, Deschutes County has proceeded to implement LCDC Statewide Planning Goal 8 regarding destination resorts in a phased process; and: WHEREAS, the second phase of that process concerns consideration of the County's forest lands for destination resort siting; WHEREAS, the forest land component of destination resort siting, follows from the County's implementation of the LCDC Forest Rule; and WHEREAS it is appropriate that certain of the Forest Rule criteria be applied to destination resorts sited in forest zones; and WHEREAS, public hearings have been held in conformance with state law to implement the Forest Rule requirements; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF':DESCHUTES COUNTY, OREGON ORDAINS AS FOLLOWS: Section 1. ADOPTION OF AMENDMENT TO CHAPTER 18.113. Section 18.113.070, Approval Criteria, is amended to read as follows: "The development will not create the potential for natural hazards identified in the county comprehensive plan. No structure will be located on slopes exceeding 25 percent. A wildfire management plan will be implemented to ensure that wildfire hazards are minimized to the greatest extent practicable and allow for safe evacuation. With the exception of the slope restriction of this section, which shall apply to destination resorts in forest zones, wildfire management of destination resorts in forest zones shall be subject to the requirements of Section 18.40.070, where applicable, as to each individual structure and dwelling. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
